  1. Heres my scenario.

My fiances mom already has sponsored a family member. Will she be able to sponsor me and my fiance under K1? My fiance will need a co-signer as she is only a student and cannot support me. Is there any rules that say you cannot sponsor more than one person? or does it depend on income of that person?

    thanks

  3. I see that on the USCIS Website that the I-129F forms are only good until Today (18th). Then there will be some sort of updated one. Well can anyone help me out on where to find the most current (hopefully free) K-1 forms??? I am only in NY until tommorrow with my fiance and we planned on filling these out today.

    thanks

The one that is posted on the USCIS website now (Rev. 11/2006 & expires 2010) is the current form. The notice is for acceptance of the older form (Rev 5/2006 expired 12/31/06).

    Thanks again!

  6. The k-1 is a tad bit quicker then the k-3, so they say. You can download the forms for free. Good luck!

  7. Hey Canada!

I feel so overwhelmed with all of these forms and acronyms. Basically my american better half and I have decided to get married and live in the USA. I being a pilot (poor) have many questions about all of this especially when it comes to the "getting work as soon as possible" thing. We wanted to originally go for the K1 and now we are thinking about the K3. Whenever I ask a question about this on these forums I get links to guides on this site. As informative as they are...they seem to still be aimed at people who know quite a bit about this process. I basically want to find out if it is easier/quicker to marry move with her and file an adjustment of status while "visiting" her down there (risky I know) - or - file a K3 from Canada - How long would both ways take til I was able to work and live with her. Looking forward to simple answers. hah.

    thanks

  8. What makes you think I wont be able to work in the USA as a pilot after K1? Im not arguing the point Im just curious as to how you came ot this conclusion. The whole thing is making me have sleepless nights. My better half and I are just looking for the quickest way that we can be together and that I will be allowed to work and fly for an american company. As we have both learned the hard way through our relationship that the opportunities for us are better down there.

My airline has had many foreign national pilots (Canadian, Greek, German, etc...) who were LPR's working with greencards. The only issue is the background checks take longer.

The only problem is with the K1 I will not have a greencard yet. I might be taking a big risk in the fact I dont have one and will only have a work permit to get hired.

  9. G, you probably won't be able to work in the US as a pilot after you get the K-1. Potentially after you get your EAD. If I were me, I'd be looking into what's required by US airlines ASAP.

I agree that your employer should help you get a crew visa; that will explain your crossings and cover you during your K application period.

  10. Ok, so my girlfriend and I are going to be getting engaged soon. So we are going with the K1. Now I am a pilot in Canada for a living. I will hopefully be able to work as a pilot on the USA after getting the K1. I have heard that during this process...( waiting at least 6 mnths for the K1 to get approved) that I being Canadian cannot travel to the USA until my paperwork is cleared. If this is true, it would really make my life complicated if I fly into the USA for my job during the waiting process. (which I occasionally do - and have to clear customs). Can anyone give me some insight on this?

    thanks

  11. So my girlfriend and I have decided that we are going to get married. We are going to do the K1 visa as its seems the quickest way we can be living together and that I can get working as well ( I hope ). I am Canadian - shes in NYC. I believe from reading up on all the past posts and guides on this site that the K1 is about a 6 mnth process if all goes well - am I correct? Also what would be the timeline in getting a work permit once you enter the USA. ( I am moving to NYC when the process is done so my entry point will be JFK). Does the work permit come as soon as you get approval for K1? Or do you have to wait and go through more processes?

    Thanks!

  12. What are the cost associated with seeing an attorney ?

    G,

The basic issue here is something that you should discuss in a consultation with an immigration attorney.

I am Canadian. My American Girlfriend and I are planning on getting married on Christmas. Now we are trying to decode this whole process. I have searched topics on this site for quite a while before posting.

    My questions are :

Can we get married in the states and go throught the paperwork while i live there (starting december)?

Once the paperwork is started how long until I can live down there with her and work?

Whats a recent estimate of timeline before obtaining a greencard?

If I stay down there and wait for papers to come, can I return to Canada when I want to during that time?

Do I have no choice but to stay in Canada after we file the paperwork until it comes through?

What are the costs associated with this...

thanks for your patience and answers.

  13. Where do you two currently live? Is she living in the U.S. and you are living in Canada? If so, you can't do DCF from Canada as they will only do it for U.S. citizens that are actually living in Canada.

She is living in the USA. I am currently living in Canada. She cannot come here as she has her obligations there for another 6 months.
