Finally found out why k1 was refused the letter from embassy mentions 212(a)2(A)(i) which says general criminal history (my fiance' had an assault charge where he paid 10000JMD fine or 6 months imprisonment He did not do any jail time and was two year ago that was expunged).  The letter mentioned filing a waiver which is $930 form 601.  Do I need an attorney now?    Or should we get just married wait and reapply for CR1 or either way we would have to file the waiver 601? It was a minor crime but guess considered moral turpitude? the INA says certain amount time has to pass for some violations but those crime were habitual offenders or a year or more jail time. Any advice please??

    What is your status online? Does is say administrative processing or refused die to medical not being received?? Please assist as we are having trouble with medical reaching embassy and status updates.

    first you need to email the embassy and inquire about the refusal on ceac.  You cannot respond to anything until you know.

  4. Soo I got a response from the US Embassy after inquiring as to why our status says refused online. The officer reassured me that our petition was still under review and is in administrative processing. I understand that the government website states most cases are resolved without 60 days. But does anyone have a firsthand experience as to how long this process can take in Jamaica??

    If you are a K-1 in JA, and you submitted requested information from interview, went to AP, then refused, then there was a problem with his medical or police certificate.  You will need to wait to get the letter.  You can email the embassy and inquire about the refusal in ceac to make sure you have been refused and to see If you may qualify for a waiver.

    That is completely different....

    Sooo we didn't get a letter stating the refusal after the interview that was reflected on the case status online. He had a basic info sheet from interview.  NO document was given after interview to state refusal and why. Still waiting for passport and  letter from DHL that embassy said would come when I emailed about refusal.

    So the case was NOT denied????  "Refused" does not mean it was DENIED!!    After my wife's interview, she received a 221g which asked for additional documents......THE CEAC STATUS CHANGED TO "REFUSED".........then 2 days later, it changed to "issued"...

    I'm already going through the pain of the process,and to get the visa approved : bonafide and honest.

    So why would i even post if I'm going to lie? He said he didn't know and i believe him.  I wasn't at the interview but I did add comments to review the process from what he informed me.  We thought we were waiting to get the visa instead noticed refused for case update and there was no letter or anything given at the interview except DHL instructions to submit more documentation

    This is what is most confusing to me.  The CO gave him a paper requesting more documents he sent the pic to me and I sent additional pics and info to prove our relationship.  The case was NEVER denied at the interview, only more info was requested.  I suppose we may be jumping the gun and need to see why it was refused and perhaps i didn't send in enough proof? Because we thought we were waiting for call to pick up passport with visa...

    I have. He went to DHL today and they informed him they will email a tracking number when his passport and letter are ready.  We learned the case was refused due to ceac online case tracker tool which does not state any other info.

    The point of at least getting tourist visa is so at least he can visit me and meet my family.  Even if we learn what caused refusal and appeal or go through process to correct it, who knows how long it will take? Still waiting to learn why is was refused as he hasn't received his documents back yet.

My fiance' had his interview on February 23rd and did not have the police record.  (We overlooked this requirement, he had ordered it but did not have time to get it before going to interview) He was given his passport back as the CO said he would not be able to pick up the police record without it.  My fiance' submitted the documents the following Monday February 26th and they were received the next day.  As to date, our case is STILL saying administrative processing.  The site said not to inquiry unless its been over 60 days as cases are often resolved within that time.  Any opinion as to how long the wait could be expected?  The CO told my fiance' that he should hear something from them the following week  but nothing so far....

  13. Hoping to get some feedback about the interview at the US Embassy in Jamaica.  How long is it? How early do you need to arrive?  Are interviews done in order of arrival? What is approval rate? What things caused denials?? What kind of questions do they ask?  Should he (my fiance') bring the petitioner's (Us citizen/the writer) birth certificate? How long if approved to get the visa? What do they look for on police record?  Would 1 fine stop k1 visa approval if no incarceration? Please assist! Very nervous about upcoming interview.
