  1. OK, we are uber-excited and just came to know (over the phone) that our interview is scheduled for July 2nd. Its so soon and we cant hold our excitement. BUT we haven't received a letter/email yet - we will need it for the medical exam and the biometric-procedure which we scheduled for in 10 days. Will we receive it by then? Or should we call NVC again?

     

    PS - Its strange - we called NVC because we got a strange "false checklist" from NVC (by email) whose last page was in Greek! Yes, in Greek! Well, it was transliteration from English to Greek (where "see" was written as "sigma-epsilon-epsilon", etc). And we called NVC to inquire about it, and guess what? The NVC-person told us that our case is complete and interview is scheduled! Back to the question - when will we receive the letter?

    Technically, you can answer all three questions with a yes, but I would use the I-864 in your case anyway.  Just leave all the asset questions blank.  You'll waste some paper but it really shows the same information when there are no assets listed or household members income used.

    Thanks pushbrk. Do you think not having a joint sponsor might make my case weaker? I mean my W2 and paystubs should be enough, right? 

  3. I was in Ireland for three years until July 2017. Then moved back to the US and joined a company in Aug 2017.

    Now, my 2017's W2 shows a gross pay/wage of 30,000 (for the work I did from Aug-Dec) and my annual income is 72,000. Do I still qualify for i864ez? 

     

    My reasoning for me being eligible for i864ez is that the W2 income, even though a part (Aug-Dec) of my annual income, is above the Poverty Guideline (125%). And I will also be sending my 6 months' pay stubs (Nov to Apr). What do you guys think? i864ez or i864?

     

    PS - Joint sponsor ain't an option at the moment.

    1. You need to send both packets in one mail. Do no send it separately. You can however send the whole packet before you complete online D-260 since you have your cover page. 

    2. You have to send by regular mail and not upload/email as India is not under electronic uploading (PIVOT)

    If you recently issued passport less than six months then it does not take more than week to get PCC.My wife just gone through this process.

     

    Many thanks for the quick reply. Any idea about how long does it take to get one if the passport has been issued ~9 years ago?

    A super quick questions -- As far as I know, there are (hopefully at least) two places where I can get a Police Clearance Certificate from  -- (i) https://pcs.mahaonline.gov.in/Forms/Home.aspx , and (ii) http://www.passportindia.gov.in/AppOnlineProject/online/pccOnlineApp . 

     

    Where should I get the PCC from? I hope its not both but (ii), only. But I would like to know from other people's experience. Many thanks in advance.

    OK, did I screw up? I, the petitioner, just paid AoS (Affidavit of Support) fees of 120$ just minutes after my wife, the beneficiary, filed DS-261 (agent choosing form). Is that OK or did I really eff things up bad? In my defence, I received an email with a 4-page attachment showing me the Affidavit of Support Fee Invoice. But on the first page, it did say I should have waited for 3 weeks for DS-261 to be approved to pay the fees. 

    She is screaming at me over the phone... Please help. Urgent.

    I see, so, let me get this clear -- even if the sum of my wages, salaries, etc (line 7 of 1040) having income more than the 125% of the poverty, they would still look at "total income" on line 22 or 21 which subtracts the foreign earned income, huh? It seems a bit weird...

    You will either qualify as sole sponsor of your spouse based on your current income that will continue from the same source once in the USA.  Maybe you are already in the USA.  Otherwise, the information from tax returns is purely required historical information.  If you don't qualify, you'll need a joint sponsor.  Are you working in the USA now or will your current income continue from the same source once you return to the USA?

     

     

    Yes, I am in the US since Aug 2017.

    The total income on my previous tax returns (2015, 2016) shows 0$ as I was in the UK and was using 2555 to exclude foreign earned income. Is that going to hurt my case? 

    In 2017, my income was a mixture of W2 (US income) and 2555 (foreign earned income), and excluding the foreign income in my 1040 brought the total income (on IRS transcript) down from 60k to 28k - will that hurt my case?

    PS - 28k does pass the "125% poverty-line" limit set my USCIS. 

  11. I (petitioner) and my wife (beneficiary) are preparing ourselves by looking at forms that we might need to fill and submit to the NVC. In 2017, I was partly in the UK and partly in the US (7 months and 5 months, respectively), so I have two sources of income -- UK (not on W2) and the US (on W2) - have pay-stubs for both of them. I filed my taxes showing both the incomes and already have the 2017-return-transcript downloaded (yup, filed it in March).

    Question - Since my UK income is not "documented using the IRS Form W-2", can I still file 864-EZ? I do have the UK pay stubs with me not only for 2017 but also for the 2015, 2016 along with irs-return-transcripts for all those years.
