what's the point of your post seriously? i know if i had not overstayed i could have used the vwp....

respect rules, yes i agree but u didnt know my situation there ...

something I was wondering : the fact to change passport, meaning getting new passport number, how can they know about the overstay?

Hi guys

in 2007, i was in usa for 3 months + 60 days under vwp.

I know the consequences about overstay are :

- between 180 days/ 1 year = not allowed for 3 years

- more than 1 year = 10 years

- less than 180 days = obligation Visa , no more vwp.

I will plan to go to usa this summmer for vacation.

I will ask VISA B2 to my embassy. I dont know how long i want to stay yet. one month or two? ( no I am not asking u lol )

I have a question about what it can happen once in usa:

When I go with a visa , the border officer will send me automatically to an office for interview and check/debate if i can enter?

or it depends, just asking me about the overstay and say like " dont try again or u are done" ?

I went 5 times in usa, it was my first problem I got in 2007 ( coz i had to help someone who got problems and i couldn't resist or say no , yeah it was a girl)

i think i will buy return ticket to prove I want to go back to france, not staying... ( well, it doesnt mean it proves it but maybe it can be positive)

I didnt stay "that" long .. if they allow a guy after 10 years to enter, why i stress for my 60 days .. but we never know ...

do u think coz the overstay, and getting a visa, i should stay just few weeks instead of months?

any guys who got experience about interview coz overstay?

I really hope if i have the visa I can enter without problem !

but even if they have the right , i wouldn't understand why ppl gave me a visa if finally just one person thinks differently and doesn't care about ruining your day and money.

since few months, Tourists need an authorization (ESTA) , do you think It can help to know if there is a really problem?

This is my situation :

In 2007 ( october) I went to usa with my passport only ( i am from france, so I didnt need visa)

So i was allowed to stay 90 days in usa. But I got some problems which made me delay my return.

I stayed around 60 days more there. Once I got money for the return ticket by a friend, I went back to france by myself ( I mean I wasn't caught or something and left usa without problem)

At the airport, the "cop" noticed I didnt got visa for that extra period, she talked with her boss ( they were standing not far from me, then i saw her boss like " it's ok, let him go". so they gave me back my passport then no problem.

I am planning to go back to usa for few weeks, but I am scared I am listed somewhere in their system.

I am afraid of being not accepted at the usa border coz that period.

I sent an email to the embassy to get information which will give me official info.

I have read that the consequences of staying more 180 days illegaly would be 3 years. ( no visiting usa)

I am not in that situation, and it's more than 3 years now anyway.

Any people got a situation like that?

Ok I think I am right to think an american citizen doesnt need to apply visa to go to france (or shengen space ), only the passport is needed ( and a round trip ticket)

It s the same condition for french ppl to visit usa...

But when I go to embassy websites, I find visa form for short stay ( 90 days)

So I am lost... does it need to apply or not??

I need to meet someone who get married with US citizen, without asking visa k1

I mean, the person went to usa as tourist ( so no visa) and "by surprise" (ehem) he get married with the other person.

I know it s allowed

and not allowed if the wish of being married was wanted before going to usa.

let's say we don't know we will get married,

i need to know the process , all details,

Just a correction.....I have been with my fiance 4 times since we filed for the visa and about 12 times over the past 2 years. I am pretty sure you have to meet with your fiance TWICE before you file for the K-1 but I could be wrong on that. Hopefully your lawyer knows what he is doing and is telling you the right info. I only say so because I've heard alot of people have had trouble with lawyers in this process. I don't even think the assistant of a lawyer is needed in this case unless you have had trouble with the US before. Good luck and I hope your journey goes well

A friend got the visa k1 ( they met once before filling it) she adviced me a lawyer

Have you not met your fiance yet??? I am not sure I understand you. If you haven't met then yes...it will take a long time and you will probably be denied because you have to meet at least twice in 2 years and you have to have proof of it as well. No.....no problems with our case. I think it just took us so long because there was a backlog with our US Service Center.

No I didn't say we will fill visa K1 without meeting a first time.

we will in february. I don't think we need to meet twice in 2 years, once is enough ( my lawyer would have told me that) The most important ,as you said, is the proof we really met.

When i said no meeting, it was after filling K1 visa and while waiting for the visa.

You waited for 10 months to get it, that meant you didn't see you lover for 10 months.

it was long. I just asked if while these 10 months, u were able to meet your lover again.

I think about that, my gf in usa will fill K1 in 2007 for me (i am from france) , i am scared it takes so many months, without meeting.....

Well, what i said is I want to meet her before asking K1 ( as YuAndDan said) i will take pics of us, to show we are together, make proofs.

but we will ask k1 once i am in france. I don't want to go there as visitor and stay.... too risky, i love too my bebe lol

I am french, i met my gf on the internet. ( don't laugh ) it s very serious, we are together since 1 year and we want to meet each other coz we are sure we are meant to be together. we want to live together and get married.

but i read somewhere it can be a visa fraud

I explain :

we want to get married, before having met. we want to meet each other before asking K1 coz it is a condition.

But they say it is a visa fraud, coz i will go to usa, as tourist ( so no visa) knowing i will get married with a US citizen later.

is it right??
