I can't combine incomes with household members according to uscis. I don't quite understand that. I'm going to file my 2017 tax return tomorrow my income before deductions is close to $65k. After deductions, it's $53k for our household of 3. I have to make a correction to my I-864 so I'm going to call NVC tomorrow and see what they want me to do. Thank you everyone for the helpful advice.

How many dependent did you claim when you filed your taxes in the past?

Maybe all these deductions you had confused the person whoever did examine your AofSupport.

    You can use assets too.

I have been doing.some reading about affidavit of support and in my case as. Widow receiving SSA Survivor Benefits with two minor sons we are Household of 3+1(intending immigrant) USCIS in Poverty Guideline we are Household of 4. My sons are my dependents,ALSO I can't claim them on my taxes because they make enough income on their own(SSA 1099) BUT I cannot combine their income(benefits) to mine, yet they are in my household. But because they are minors, they can't sign that form to have their income add to.mine. crazy how it works.

Hmmm I’m sorry to be blunt, but that daycare of yours doesn’t seem like a daycare or “self-employment” to me. It just seems like you’re taking care of your children who live in your house. You don’t have a business license and you don’t seem to be making any money off of it except a few deductions in your tax bills. You need to show USCIS that you make 125% of poverty line in your job. If your tax refunds don’t show that, then you need to make up the difference with assets and you can’t use the car your drive and the house you live in.

TNJ17- darn, I was going to use my house as an asset. My house is paid off no, liens, is clear but is my only residence. Can you send me a link of where it state that it can't be use?(if you have any)

Hi. I am applying for a Green Card based on my marriage to my American Citizen husband. We are currently in the phase of filling out I-864 and have run into some confusion. My husband is still in college and can not meet the income requirements and his parents (my in-laws) have therefore agreed to help us out to sponsor me. Which documents should my husband fill out and which documents should his parents fill out and are they therefore joint sponsors or how does that work? I appreciate all the answers and help I can get.

    Emma

I believe they both have to fill the Form i-864- on page 1, part 1- husband check the box as petitioner and the inlaws have to check the box as joint sponsor.

My son filed I-864 and I-864A which we both signed. It was accepted by NVC and forwarded to Islamabad, Pakistan, embassy but they are not accepting and want another person's I-864A. That my income is low. Although it is $44500 for 3 dependants. They they don't want to explain and talk. What should I do? Please help.

Did you meant household of 3?

I think they want you to have a co-sponsor, also if you have assets you can use them.

  5. Chances are a record will appear of your marriage in the Philippines. You can try and see if your name is cleared on certificate of no marriage. If it came back you're married, you might need to go through an annulment in the Philippines.

You maybe able to use the SSA SB as income for the family.

Four years ago I did the same when I filed for a K1 and had no problems but that is not to say anything has changed so maybe a little more research is required.

    Thank you.

When do I have to provide the Affidavit of Support? Is it during I send the files to petition or was it during my beneficiary's visa interview? Or both?

    1.  Yes the children are dependents

    2. You, your children and your mother.

    3. Yes that is your tax return as well.

    4. USEM is not known to accept assets, they look for income.  Are you drawing from the 401K ?

I'm using multiple assets, I have enough in my 401k if I have to draw from it. Do I have to show my children's SSA survivor benefits as part of our household's income?

    Thank you.

    1) Yes.

    2) 4 (you + 2 kids + prospective immigrant).

    3) If you filed jointly then your previously-filed tax returns are your tax returns also, yes.

    4) Not sure on this one.

    Thank you.

  9. I am planning to petition my mom, but before I make her go through the hoops and loops I want to make sure that I am cleared on my end here.

I am widowed, stay at home mom of  my two sons, 6yrs old and 8months old. My husband passed on 9months ago and with that being said me and my kids are receiving Survivor Benefits. Since i can't claim my kids benefits as part of my income-

    QUESTION 1: are they(my kids)my dependent?

QUESTION 2: Which number of household should I consider to define which poverty Guideline to consider. Household of 4 or Household of 2?

QUESTION 3: I've been stay at home mom and my husband always filed our taxes MARRIED FILING JOINTLY, can I consider it my tax return too, right?

QUESTION 4: with SSA benefits alone, I doubt I will meet the required income, So I am considering to use my assets x5 the poverty level, is 401k also considered as asset?

    Thank you.

  10. Hello!

I am a Naturalized Citizen and planning to petition my mom to live with me.

I became widow last year and I have two sons 6yrs old and 8months old. We are all receiving SSA Survivor Benefits.

    Questions:

1.I am currently unemployed and stay at home mom. With SSA benefits I am getting, how am I going to do my math of how much I make? I don't think I make enough but I own the house and no mortgage, not a lot in my bank account.

Should i include my kids SS benefits as part of our household income?

    2. Since my kids are receiving their own income, should I consider them as my dependent?

    3. Since it is obvious I don't make enough money, is 401k counted as an asset?

Thank you,It is nice to be back. I was here on visajourney when I started my k1 visa back in 2009.
