Okay, so he is under F2B.
He must remain unmarried until after entry on the visa. If the petitioner becomes a US citizen, then he can elect to stay F2B or change to F1.
The children must remain unmarried and be under 21 to qualify as dependents when the visa number becomes available.
Keep checking the visa bulletin for current progress: https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin.html
Thank you so much for your comments

F2B is for a son/daughter who is unmarried AND CSPA age 21+. There is no visa category for married children of permanent residents: https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2020/visa-bulletin-for-january-2020.html
What is his current age?
Son is 36 and he has never been married, but he has two kids.

Hi,
I have a couple of doubts regarding the a F2B visa.
1) Can a LPR petition a son who is over 18, has never been married, but has two kids?
2) If so, I guess I have to add the name of his children in the I130 form (under item 25: beneficiary's family). Any idea if I have to attach his children's birth certificate as well?
3) Is it true that the beneficiary's children will only be considered if they are younger than 21 by the time that the NVC process ends?
4) Would that petition affect another petiiton that is currently in process, same LPR but requesting a different daughter?
I appreciate any comments you can share with me. THanks!

If acceptable for your visa purposes, rather than submitting all of your tax forms and associated schedules, etc., can you obtain and supply tax return transcripts. There are much fewer pages involved. They are free, and available from the IRS.
Yes I have those ones. But not sure if I can put them all in one file. Or if they want the most recent in one file and the old ones in another.

Hi, I would like to know if I can upload all tax return from the past three years in the same file. or do I need to create a different file for the most recent year and another one for the past years. Any idea?
I am also wondering if the employment letter goes in the same file with the paystubs. I am not sure under which category to upload the paystubs.
Any info would be appreciated. Thank you!

Hi. I want to know if I can submit the civil documents without completing the AOF yet. I am not sure if I have to have both ready to be able to submit. Any idea?
Thanks

Hi, I am in the NVC stage and have three questions about documentation I need to upload:
1) Does it matter the size of the digital passport picture I need to upload? I mean it is least than 2MB, and althought the printed pic is 2x2, the image on digital is bigger than that. Is that a problem?
2) We filled out two I864A for two household members who lives with the petitionary. When uploading the supporting documents do can I upload their proof domicile, W2s together? or it is better to upload w2s separately per each member and also separately proof of domicile per each member. Any idea?
3) How can I make a file smaller than 2MB. I am having trouble uploading some forms because the file is too heavy.
Any infor provided will be appreciated.
Thanks! -
Does it matter the size of the pic that we need to upload? I know it is a 2x22 one, we have one with that size printed, but the one online is bigger than that. Any idea?

That is odd. I think they made a mistake
The law says the visa cannot be issued until the PD is current and there is a visa number available.
I tried to pay fees, but it says my Visa is not current. That is okay, but I don't understand why I get an invoice number and so, if I can proceed. Is that normal??
-
Hi, I am really confused. LPR requested child over 21 this year PD: January 2019. The I130 was approved in September and today we received the Welcome Letter with invoce numbers. I thought that type of visa is not current. ANy idea how does it work?
Once I paid and proceed with NVC, will the beneficiary be able to immigrate. or will have to wait until visa is current?
Thanks!

I have a similar doubt. I am petitioner (i864) who doesnt make enough money. My friend will help as sponsor (i864), but he files taxes with his wife, so I will need a i864A for her. When uploading I guess I have to put him as -Sponsor and then add his wife as household member. Is that correct or how does it work?
I'd apprecaite any help.
Thanks!

Hi Jane, Im confused also. My mom is petitioning my sister. My mom didn't make enough money so me and my husband wanted to help her out. A household members is a person who lives in the same address but in the form i864 you can only put relatives (spouse, daughter, son). So I was wondering if my husband should fill up i864A also or diff. form? Thank you.
Well...I was told that I needed to fill out 4 forms. One for me (petitioner-1864) and one for my husband (1864A) because we filed taxes together. One for my son-in-law (sponsor-1864) and one for my daughter (1864A) because they filed taxes together. I am not sure how to upload all 4 forms in the system though. I also read the I1864A instructions and it says that form is only for certain relatives (parents or children) that are household members. I havent received the WL yet, so I am still doing research about. Please let me know how it goes. Thanks!

Thank you both for your response.
Question number 3 was in regards to the form that my son-in-law will sign to help me sponsor my children. My daugther and him filled out an affidavit of support for me when I was applying for my residence. So I guess he may have to check that box. The thing is that he didnt sign I864 or I864EZ. He signed I864A.

Hi,
I am a LPS rwho requested two underage children. I am in the NVC stage and I would like to which form do I need to fill out since my income is not enough and my son-in-law will be helping me as co-sponsor. I thought he had to sign the I864A form because we live in the same house, but in the instructions it says that only a sibling, a parent or an adult child should fill out that form.
1) Does it mean that he needs to fill out 1864 instead?
Since I am a resident, I had to file a separate petition for each of my children, but my children's cases have been approved and handled at the same time. So I am not sure what to put in Part 3.. Number 2: "I am sponsoring the following family members immigrating at the same time or within six months of the principal immigrant named in Part 2. (Do not include any relative listed on a separate visa petition)''
2) Do I need to check that box and put my other child's information so both or them are counted when doing the sponsors's household size?
I was planning to check that box, but then I read what is on parenthesis and not sure if filing a different I130 for each of my children counts as a separate visa peition.
Also in part 5, number 6. It says: ''if you have sponsored any other persons on Form I864 or form I864EZ who are now lawful permanent residents, enter the number here''.
3) My son-in-law was one of my sponsors, so I could come to US as LPR. Do we need to put a number there? He signed I86A, but not form I864 or I864EZ.
I appreaciate any help you can offer me. Thanks!

Thank you. What kind of custody documentation do you mean? Any idea if we have to add that documentation to the I130 form?

Hi everyone,
Any idea if an unmarried over 21 son can be requested along with his kids (He is no married, but has kids) by a green card holder (mom)?
-
Thanks. One more question. Do I need to look at the first (final action) or the second chart (date for filing) in the buleltin?
-
Hi everyone,
I am really confused. I just got the I130 approved for f2B (unmarried child over 18 of resident). I am really excited, but also confused. I thought the whole process take 5/6 years.
Our PD is January 2019. It says that the case will be sent to NVC, but I am not sure if they will make us wait there until the visa is current. I dont want to get any hopes imaging that we will be done with this process in 6 months when it may take many years. Any idea if that is normal? I thought USCIS only approved forms when the visas were availaible.
ANy comment would be helpful!!
Thanks!

My case is there sadly becuase that is the slowest center based on my research. They are working on May 2017 cases

Which center is your case? I just realized that the approvals highly depend on the center where you case is

Hi, I would like to know if I can send my I130 by mail instead of doing it online?
I think you can do it online, but I prefer to do it the old fashion way since that has worked in the past for me.
Also, does it get approved faster or slower depeding on the way I submit it. Any idea?
Thanks!
