    No power for several days at a time is still a common feature in many parts of WA. We often have no power for 3 or 4 days here in the Cascades after a storm or even just a bit of snowfall. You need a gasoline generator here for those days. 

     

    She is required by law to file a tax return every year, even if she doesn’t owe any tax. Unless she earns less than $10,000 a year. 

    She is making $ 0.00 a year.

    K3 are rarely granted anymore so dont waste your time there.  And you dont live in a country with a USCIS office.  You will start the CR1 process with an I-130 mailed to the Chicago lockbox.  

    If you make sure you've been married for 2 years upon entry after acquiring your visa, you will recieve a 10 year green card and wont need to remove conditions.  Shouldnt be too hard considering spousal visas currently take 12-16 months.  

    Taking the 12-16months in consideration, then we would fall within the 2yr timeframe

  3. Dear JFH,

    She is originally from Guam (Pacific Islander), but we lived in the Pacific NorthWest from 2010 till 2015 together, to include that terrible winter where we had no power in the Lacey Area for almost a week.

    We got married on May 31, 2018 in Guam (US Territory). She has the fullest intend to establish re-establish domicile in Texas as her daughter lives there. She has not filled taxes in the USA since she left, but that is something I will advise her to do ASAP.

    Please allow me to explain my situation to you:

    In 1999, I met in Mexico a female from the USA, even after returning from vacation, we continued dating, resulting us getting married in The Netherlands in 2001, after which she applied for my K3 visa. In May 2002, the USCIS granted me a K3 visa and I entered the USA via the Port oif San Fransisco (Airport). Unfortunately I found my (then) wife cheating on me with her hairdresser. We seperated and I fsent her the documents for divorce.

    In March 2009, I met a gorgeous female in WA, we dated and in May 2010 she and her son (3yrs at that time) moved in together. After visiting the Netherlands in 2014 for the wedding of my sister (I gave her away), my son (stepson) didnt want to return back to the USA. After long talking, we decided that we would move to the Netherlands to try life out there.

     
    We live now in the Netherlands. My wife (sinds May 2018, as we got married in Guam) and son (14yrs) are US citizens and both are status holders in the Netherlands. I can be honest and say that we are home sick. Our son has difficulties at school and my wife cannot get usesd to the weather. 

    Currently I am the only one that is working. My wife has no income in the USA, so she can therefore not apply for my visa. She does have a daughter who stated that her husband and her are willing to sponsor. But I would like to ask you what Visa would be the best and fastest way for us to go?

    I married in 2001 a USC in the Netherlands. She filed for my K-3, which was finalized in May of 2002. I moved to the USA on May 2, 2002.
    Unfortunately we seperated and got divorced in 2013.

     

    As I moved in 2015 from USA to Netherlands with my fiance, we totally forgot about my GC, which is expired on 11/10/14. As we are considering to move back to the USA as our son (her previous marriage) can not get adjusted to the language and the way certain subjects are presented at school, we think it is of the best of his interest that we move back to the USA. Okay, not renewing my GC can be seen as aboandement of my GC. 

    When I was looking through al my USCIS documents, I found a receipt dated 11/02/2007 I-90 Form: Application to Replace Permanent Resident Card.

     

    When I look at my old card, it states:

    Resident since: 10/21/2004

    Card Expires:     11/10/2014

    When you apply via a I-90 would the new card not have a new expiration date?

    I have not visited the USA after we left in November of 2015. Unfortunately my Permanent Resident Card expired on 11/10/2014

  7. Unfortunately starting a DCF I-130 process in Amsterdam isn't possible anymore, unless you qualify for exeptional circumstances.

     

    WASHINGTON - Effective Aug. 15, 2011, petitioners residing in countries without USCIS offices must file their Form I-130, Petition for an Alien Relative, with the U.S. Citizenship and Immigration Services (USCIS) lockbox facility in Chicago. This change makes the filing process more efficient and gives USCIS greater flexibility in managing its workload.

    Petitioners residing in a country with a USCIS office may send their petitions to the USCIS Chicago lockbox, or file at the USCIS office in that country. Overseas petitioners filing with the lockbox should expect processing times similar to petitions filed domestically, which currently stand at five months.

    Based on a Policy Memorandum published in July 2011, these petitioners will also be granted more time to respond to Requests for Evidence (RFE). Applicants and petitioners residing outside the United States are now given up to 12 weeks to respond to RFEs, plus an additional 14 days to account for overseas mail.

    Previous regulations permitted individuals overseas, who comprise about 5 percent of all I-130 petitioners, to file with USCIS or their local U.S. Embassy or consulate. Under the new process, USCIS may authorize the Department of State to adjudicate their case in certain emergency situations, including when:

    • A U.S. service member stationed overseas becomes aware of a new deployment or transfer with very little notice.
    • A petitioner or beneficiary is facing an urgent medical emergency that requires immediate travel.
    • A petitioner or beneficiary is facing an imminent threat to personal safety.
    • A beneficiary is within a few months of aging out of eligibility.
    • The petitioner and family have traveled for the immigrant visa interview, but the petitioner has naturalized and the family member(s) require a new, stand-alone petition.
    • The petitioner adopted a child and there is an imminent need to leave the country.

    What did you do with your previous green card? Also you say you lived together from 2012-2015? What happened with the other two years?

    Personally I would choose the CR-1. That way you can keep your job and health insurance until you move to the USA.

    Hello Beachlover,

    My GreenCard expired in the meantime and  when that occured, we had not eventhought to move back to the USA. I met my (now) Fiance in 2009. In 2010 I picked her and her littleone up from Oklahoma, we drove to Wa, where we lived till we moved (all 3 of us) in November 2015 to the Netherlands.

    i lived in the USA from 2002 - 2015 on a GreenCard. I got divorced in 2013.

     

    met a awesome female (US citizen), we lived together from 2010 - 2015. In 2012 we got engaged. Her son (previous marriage) wanted to move here after visiting in 2014.

     

    so we moved. Now I know he has difficulties with tha language (has extra help at school), but also my fiancé has difficulties settling.

     

    we are now considering to move back to the good old USA. But what would be the best way to go? We are engaged and consider to marry in the USA, but if need to, we can do that here also.

     

    what would be the best Visa to apply for and ofcourse not the expensive route!!
