  1. Anyway, back to the original topic. It sounds as if you have a pretty strong case for her crossing the border legally. I doubt there are very many British Nationals who sneak across the border without being inspected. I just think it would be very rare. You might want to consult another lawyer.

    If I were you though, I would go ahead with your applications. When asked for the I-94 on the form, just write none and add a letter of explanation. This was what I did, as I had also crossed a land border from Canada and had no I-94. Either you will be given a hard time about it or you won't. Your story sounds pretty valid, so I am doubting you will be given a hard time.

  2. Yep not including Joint tax returns will get you a RFE they are a must. As there has been such a big backlog of applications it is no wonder it has taken they this long to request the information you failed to include when you filed.

    I am sure once they get the information you will get your approval very quickly.

    I did not include joint tax returns or any tax returns at all and didn't get an RFE.

  3. :unsure: I filed in July to the VSC Till today, i am unable to see my case online, i called the hotline, and they told me they were backlogged to entered my case online, we did the biometrics already and they told us they updated it, has this every happened to anyone before

    Make sure that you are using the case number from the BIOMETRICS letter and not the one from the NOA. The one from the NOA doesn't work. I am not sure how good case status online is for VSC. My case status has not changed once sinceit was initially entered. It still has last date as May 21, 2009, where it states my application was received. I already have an approval letter. I think that they don't bother with case updates much.

    Ok it clearly states detained for breaking or violating a law or ordinance. Did your detention at the border have anything to do with the breaking of a law??

    If not, I would put no.

    If you are really uncertain, just put yes and add a note explaining it. I have added notes, indicating that parts of the form where confusing and I added details.

  5. My appointment time was 11 AM, and due to logistics, I was in Boston shortly before 8 AM and right near the ASC.

    Not wanting to wait around I went into the ASC. I had to wait until all the 8 AM people did their biometrics. I was put in a special section with this other guy who was a day early or something. They were somewhat miffed and said that I had to come in at the correct time, next time.

    So anyways, it worked out, wasn't a long wait maybe 40 minutes or so, and I just faced a bit of hostility.

    Hi, if he received a 1 year extention letter, then he did file for removal of conditions.

  7. It sounds as if you filed the removal of conditions paperwork with him. I suppose your next step would be to send a letter to whichever USC Service Center that application is pending with and tell them that you no longer want to jointly remove conditions. I don't know what else you can do. It sounds as if you have a rocky on and off relationship. Be sure that you do not plan to get back together with this person, before you take that step.

  8. I don't think that it is any more worrying to travel due to the RFE, then it was before the RFE. You'll only be gone for 10 days. Personally, I would send in the evidence ASAP with delivery confirmation so that you make sure that they get it, then go on your trip and try not to worry. The RFE shouldn't be any reason to deny you entry back into the US. I think it is a very slim chance that they will A> outright deny your application without an interview or a good reason and B> be able to process your information in that 10 day timeframe and send you notification of your denial.

    But I do see that it could feel stressful. Hopefully all goes well and you will get an approval notice soon after your RFE response.

  9. Hmm, I did not send in my tax return with my package. I filed as married filing seperately (or whatever it is called). I added in a note, explaining how and why I filed that way. I also said that if they need a tax return, they can ask me and I'll send it (maybe I should have sent it anyway, but it didn't seem important). I believe that a tax return is not mandatory at this stage. I would just include a letter explaining that you had no income and did not file and send in the tax return from the year before.

    stereotyping Asian women being meek is far from the truth my wife speaks what on her mind and i commend her for this .

    For my self I do spend money home to my wife family being married to a Filipina is just a acceptance and I'm sure allot of other men on-line here do also

  11. Excuse me, but he is here looking for help. These forums do not exist so that ####### like you can come in with an axe to grind. They are here for advice and assistance, not for someone with nothing positive to contribute to use as some soap box. Any reasonable , compasionate human being could relate to what this person says. The law may be the law, but sometimes people get unfairly caught in up in the laws. This is someone's life here. Step into his shoes, he was brought here as a child and his life is here. Imagine, you were in that situation and had to leave your life and return to a country that you do not feel is your own. Boo hoo that you have to wait a bit for your spouse to come, don't expect much sympathy for that.

    Hi everyone, yesterday I watched the movie crossing over and it brought reality right back into my life. I actually got chills from that.

    I came to the US when I was 12 and then when I was 16 I went to Brazil for 2 years and came back at the age of 18.

    I'm 35 now and have spent the majority of my life here. I own a home, I work, I file my taxes but still live under the fear that I can lose it all due to my

    illegal status here. Sometimes I get sad thinking of how unjust things are. I didn't choose to come, my parents decided and I had to follow along.

    My parents are legal now, my mom is a US citizen and my dad has a green card. My mom petitioned for me in 2005 and my priority date is nov 2005.

    I have 2 beautiful kids, a girl 7 years old and a boy 3 years old.

    I've noticed that priority dates move really slow.

    I wish it wasn't this hard to become legal in a country that I gre up basically. Here I had my first girlfriend, got my HS diploma, Married, had kids, bought a home, work, file taxes and it still not enough. I guess I just have to overlook the bad and be hopeful for the future.

    You didn't have to share all that personal information about your situation, but since you did - here's my reaction.

    Sometimes I get sad thinking of how unjust things are. What's unjust???? That this is a nation of Law, and that we have the right to enforce our laws?? Get real. You are not owed anything here. You broke the law, now you complain it is "unjust" that that law may be enforced against you?

    I didn't choose to come, my parents decided and I had to follow along. I don't buy that. When you are 18, you are already of age of majority. You could have chosen not to return illegally to the US at age 18, you are not dependent on your parents at that point. Moreover - you could have left the US at any point after that, voluntarily. You are not here due to "lack of choice". You've made that choice each and every day that you are here.

    Look, I appreciate that you are a decent person, hard working, law abiding (other than the law you've broken!). That's all fine. And if you are on a path to citizenship that works legally, than I have no quarrel with that. But so long as you are illegal and in the shadows don't expect much sympathy from me, or from many on this forum. This website is dedicated to people who are patiently waiting very long times to LEGALLY bring a loved one to the US. My fiancee is in Thailand separated from me for nearly a year because we want to do it the right way. What sympathy should I have for you who entered illegally and complains about the "unfairness" of it all.

    The US has a problem with illegal immigration. In the aggregate, we need to do something about the 12million or so illegals in this country. I recognize the practical need to address the problem. But whenever I hear of an individual case like yours, especially one who thinks they're being treated "unfairly", my blood boils.

    Sorry for the bother but am freaking out with the gathering of my documents for my I-751. SO far these are all the documents that i am planning to send to USCIS aside from the insurance or loan we have in both our names.

    1. Copy of front and back of my Green card.

    2. House deed (house bought during our marriage).

    3. Joint Bank account we have for the past 2 years we been married.

    4 . Tax Transcript for the joint filed income tax

    5 .Birth certificate of our 11 month old son (born to our marriage)

    6. Utility bills some in both our names, some in mine and some in Hubby's name but same address.

    7. Copy of our visa debit cards in same joint acct.

    8. Pictures of us on our trips and with the family and friends.

    9 .Copy of Notice of approval of my I-485.

    10. Copy of NOA 1 of my husband's I-130 petition for my kids(him being the petitioner).

    11 .Letters and cards addressed to both our names ,some in his and in my name but same address.

    12. Bank statements at least 3 in each year(to cover the 2 yr. period)

    My questions are:

    1.Do You think this is enough or do i need anything else?

    Yes, personally I think it is enough, someone else may have a different opinion.

    2.DO I need to send a copy of my old and New passport? Just renewed my passport with my married name on it now.

    3. Do i need to send the application with a passport photo of me?(coz i read some that they send with their photo)?

    Yes, send them 2 passport photos.

    4.Do i need to send also a copy of our marriage certificate?What else ?

    No.

    5.Do I need to also send a Phone bills?

    No, but if both your names are on it, it can be sent as evidence.

    6.Lastly yhe form I-751 that i filled out and signed was the version that expires on October 31, 2009..would this be ok?

    Yes, that form is not expired, it is fine.

    I know am just so worried but any suggestions you may have will be appreciated.

    let a free education in the world's most desireable country slip thru your fingers just because your marriage failed? now what kind of fool would do that? good luck in milking it all you can.

    i would love to hear the other side of this story, but on it's face...

    Gee, I am sure glad that I am a non-American taxpayer and won't have to foot this bill.
