Thank you for answering, so citizenship starts counting from day he moves to USA.

What of green card, how to advice not to loose it? As I mentioned he has a gc valid for 10 years, can that be revoked if he doesn't enter yearly?

I have mentioned to him the need to file taxes, he plans to visit soon so will convince him to file all past years.

Please be specific how far is he from citizenship if he moves to USA May 2016.

If he doesn't move and forgets about citizenship for now as he does have a 10 year Greencard, will he loose it if he doesn't travel yearly or every 6 months?

My friend is living overseas, he is married to a US citizen. He already has his green card through marriage. He wants to get his citizenship so he is planning a 1 year leave from his job overseas, move to USA for that 1 year with his family. He is asking if he qualifies with the time he has travelled in and out to keep his green card or he has to wait and live in USA as a resident for extended time? When would he be eligible?

Below is his outline of his immigration history

They got married on: March 9 2009

Baby 1 was born in: September 1 2010

Applied form I-130, petition for alien relative for himself and baby 1 on January 17 2011

Got an immigrant visa on March 31 2011 valid till September 29 2011

First visit to US as a family (himself, wife us citizen and baby 1) from April 10 2011 till May 09 2011

Conditional green card issued on April 10 2011 valid till April 10 2013

Baby 2 born in: August 12 2012

Baby 3 born in: October 5 2015

Visits to United States:

1) April 10 2011 - May 9 2011 (First visit with family mentioned above) (30 days)

2) October 4 2011 - October 14 2011 (11 days)

3) March 6 2012 - April 2 2012 (all family) (28 days)

4) September 25 2012 - October 2 2012 (8 days)

5) February 19 2013 - March 1 2013 (Himself and wife) (11 days)

6) March 21 2013 - March 28 2013 (8 days)

7) January 21 2014 - February 11 2014 (22 days)

8) March 26 2014 - March 28 2014 (3 days)

TOTAL DAYS IN US: 121 days

Unconditional green card: received on March 3 2014 Valid till March 3 2024

Traveling Document (White Passport) issued on: July 15 2014 valid till July 14 2016. He applied for this because the immigration officer at port of entry noticed he is not staying in USA and threatened to take away green card if he doesn't apply for travel document.

I don't know if he qualifies to apply for citizenship yet, if so when? He has no applied for any income taxes since becoming a resident as he made no income in USA.

He does not intend to stay living in USA, he wants to keep his job overseas that allows him a 1 year unpaid leave.

What are his options if he doesn't qualify? Can he renew white passport indefinitely? His aim is to not loose his Greencard if he stays over 1 or 2 years overseas, the yearly trips are expensive.

Thank you for the replies, well this sucks, i had already spent $80 between the 2 courts to get the documents pulled, and mailed to them and then paying for court to mail to me...plus the waisted time....i mean seriously i have had enough of USCIS, it is enough that they had my file on the shelf for 2 years for so called name check back in 2006. I am at the end of the rope and i know i have to be patient but the way the whole journey was, I don't recommend it to anyone, i think i will take a vacation when this is done with, 5 YEARS OF STRESS so far....we did everything by the book and they still messing with us....god knows what is coming but i am moving with caution as you can see

Hi Everyone and thanks for the help in advance....

I have applied for N400 and have an interview in a month. I received a yellow letter today saying that i have mentioned I have arrests and that i should bring court records with me to the interview. 1st of all i don't have any arrests, i had 2 traffic citations, one in Plano TX (where i live) and another in California (where i was visiting on vacation)...both where paid and under $500. I have printed my driving record from Texas and i have proof that the fine has been paid in San Diego California via credit card payment on statement...what should I do more other than bring proof of payment....do I need to contact San Diego and Plano courts and ask for a record?

I am so confused, why would it say arrests when i clearly said TRAFFIC CITATION-NO ARREST....i have no other records with any court....PLEASE HELP! I want to go prepared to this interview...

We did send a a lot so we do not get REF'ed, it might work against us too but we covered all fronts and it is in their hands now to discard what is not necessary from the file. We want to get immigration out of our life asap and never think about it again so we will file N400 as soon as the window to apply opens. Being a citizen as you know protects immigrants and gives them rights as any other born citizen...

Thanks for all the responses, It makes sense to us but I am afraid that is not always the case with USCIS....we went through a tough time with them with name check that took almost 2 years to complete) and the constant waiting game.....I-751 is the focus now but we sent tons of proof so we expect no problems. Everything will remain the same, her address will be here but she is signing a lease with her room mates in the state she is attending school, do u think I should add my name to that as well? I will be visiting and probably staying for few days but her 2 other Pharmacy students will be living with her.

Nick, she is graduating from her 4 years (pre-Pharmacy) this coming May and the school she will attend has a 3 all year round program ( 2 years courses and 1 rotation)....after that she will be Pharmacist. True it will cost us over $120K for tuition but she has been a Pharmacy Tech for over 6 years and can't see herself doing anything else but that.

I have to keep my job to help pay for the expense....She will transfer her current job to a job there (CVS Pharmacy) but we will try and keep her pay address sent to our current home....She will use the same bank and I will keep adding her to the bills, that is what we can do....If the IO during the Interview for N400 if we live together, I will tell the truth hat she moved for school and show her school info.....

Talking about joint utility bills, not a single company allows both of our names on it (weird I know), they claim is it there policy....we have separate utility bills in each of our names and ONLY the cell phone bill is joint....I will try and change utility companies before she moves just to have that part covered....I hope it will not be an issue for the pending I-751 as we sent tons of proof.

We are in the process of I-751 removal of conditions for December 2009 VSC center, based on the current time line we expect to get the 10 year card sometime in April 2010. BUT, my wife who is the US Citizen just got accepted for a 3 year Pharmacy school in a different state (Our city doesn't have a pharmacy school and most schools are 4 years, she wants to go to that private school that is 3 years only to graduate)....I on the other hand have a great job and cannot find a replacement in the state she is moving to as unemployment is really high there....so one of us has to work and pay the school loans....

The question is, she expects to move end of May 2010, by that time we will hopefully have the 10 year card but we want to apply for citizenship in December 2010 as I will be eligible. Do you foresee a problem? I will travel every month to see her and she will come on breaks from school but what will we have to do in order to apply for citizenship together since we will not be living together the last 6 months before applying. We have been married 5 years and we never lived apart, her dream is to become a Pharmacist and I cannot tell her wait till we are done with immigration as we are both sick of it......

She will still be on the lease and some bills and we will file taxes together but what are the problems and what can we do to make sure we don't have any issues come N400 application time...What kind of proof do we have to show for N400?
