  1. I have a few questions concerning the DS-230 form. I am the sponsor, and also was designated as the choice of agent.

    1. When signing the form, it only has 'applicant signiture', not the usual section or signing if somone else filled out form other than the person. So, my question is because I am my spouse's agent can I fill this out and sign it? Or does my spouse need to fill it out, sign it, and send it to me, where I can then mail it to NVC?

    These questions relate to anyone who might know anything about process coming from New Zealand:

    2. My spouse only needs to fill out part 1 of the ds-230, correct?

    3. Does my spouse only need to send me a photocopy of her bio page of passport? Anything else she should send?

    4. Once the case is forwarded to the consulate, what will my spouse need for pre-interview and interview?

    I also have one more question. My spouse's father is currently in a remand prison, on the ds-320 it asks for current address. What should be put? Will N/A be sufficient, or do we have to list the prison address?

    Also, will the fact that her father in prison affect proccess in anyway?

  2. Hey everyone, I have a question that is really nagging at me. I apologize for not having a complete time line, but I will try to explain my situation before asking question. Right now both a K3 visa and a CR1 visa application are both being processed.

    For the k3: Today I just recieved letter from NVC that within a week the consulate in my spouse's country will receive package. So according to flowchart/time lines, there is perhaps just over a month left before the k3 would be approved and my spouse could come to US.

    CR1: Yesterday I received the I 864 package that I need to fill out and return to NVC. My spouse has emailed (twice) and also mailed the power of attourney form, but has yet to recieve a response. Again, roughly geussing, but perhaps there is still a good 2-4 months left for CR1 to be complete for my spouse to enter US.

    I live in California, my spouse lives in New Zealand. So I imagine anything that is being processed over there will happen relatively quickly, however anything proccessed in California is probably going to take a long time.

    So here is what is nagging me and asking for opinions:

    Without going into anything, I feel like I have wasted a lot of time the last couple years organzing my life and my spouse's life while we figured things out(pre-marriage). Now, I am worried that though we have been apart for so long, if my spouse returns as soon as possible as on the k3 we will be wasting a lot more time. According to time chart they are proccessing AOS from May. So if my spouse enters on a k3, she will be unable to work or go to school for half a year or more(this is correct, right?).

    Of course the other hand is, we can wait for however much longer(maybe close to how long AOS would take?) for the CR1 to process, and just have her enter already on temp status.

    We defenitely want to be together in april, which is our annivsary.

    I geuss it comes down to logic(cr1) vs heart(k3). I don't completely trust of any the time charts, so I don't know for sure which visa would be the most worth benefit vs loss. For now, of course, we are still going through with both. I geuss I am just looking for any advice, help, supoprt. Thanks in advance.

    The I-864, and I-864A do not need to be notarized. The I-134 used at the K-3 Visa interview does.

    The I-864A is used by a co-sponsor in the same household as the sponsor. The sponsor files an I-864.

    You are filing this as part of the I-130 at the NVC?

    You don't have many details in you profile as to what part of the process that you are at.

    Thanks for the help, this is actually for my spouse's interview for the K3 visa. The reason I don't have a time line, is because I was not keeping track of dates and such unfortunetly. By the time I started using these forums, and saw that people make these time lines it was a bit late.

  4. I am assembling the packet to send to my spouse for her interview for K3 visa. I just want to confirm, that what the guide has posted is still accurate:

    A copy of the entire I-129f and I-130 package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).

    2. I-134 / I-864 Affidavit of Support form. Ensure it is notarized (by a public notary), with all required supporting evidence. Some consulates may require one or the other forms. You will need to verify with the consulate which they require. You can call or email the consulate to check ahead of time. Additionally, the consulate will notify your fiance(e) via mail correspondence which they prefer. Attempt to start collecting the required information ahead of time, as it can often take several weeks to collect it all.

    3. You will need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these asap after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134/I-864.

    4. A copy of the NOA2 that you received in the mail.

    Is this all I need to send her to ensure everything will be ok on her end? Thanks in advance.

  5. I don't know which forum to post this, so I did both;) Today nov. 20th , I recieved the approval notice for the 129 f. However, for the past couple weeks I also have been going through the process of completing the CR1 visa. I will try to update situation now:

    For CR1:

    I sen't my 70 dollars affidavit fee just over 2 weeks ago and have not received the next package containing the affidavit forms yet. To boot, the address of the beneficiary was oringially listed wrong, so 2 weeks ago I changed the address with the NVC and had them send her a new package-which she is not recieved aswell(the package I believe contains the form of who will represent her). Tommorow I was planning on calling the NVC and asking them to re-send the package to my spouse and also to check on the progress of the check I sent.

    Like I said I just recieved the approval letter for the 129. I have gone over the guidelines, and the next steps seem pretty similiar to the cr1. The guide outlines that the next step for the 129 is all to do with consulate and the beneficiary(is this correct? Or is there another step involving me besides mailing my spouse the affidavit documents?) .

    I am going to call the NVC tomorrow and talk to them about this, but I am posting to get some feedback from the experinced and helpful people here. What is the suggested next move? It seems that the CR1 and K3 are pretty much at the 'same point' process wise. I have been reading forums and getting unsure feeling of which is quicker, or if it even matters at this point.

    Tomorrow, I think I will probably have the CR1 packages resent just in case, but at this point can anyoen give some feedback of which is easier/quicker/better. Thank you in advance.

  7. First, I would like to apologize for being vauge. I did not realize that this filing of these forms could lead to two different visas. Next, I would like to thank everyone for thier replies and help. To update: Upon reading everyones posts and especially Rebas(thankyou). I looked back at all my notices and indeed it was as you said. The 129 was the one that was transferred and the 130 was the one that was approved. I took your advice and started looking into aspects of that visa.

    To update my situation further:

    I sent the 70 dollar fee back to the NVC. And I should be receiving the 184 documetns and package soon(hopefully). I also called the NVC, because my wife's address was listed wrongly, and was glad to find out I could update over the phone. I was also able to have a new package that was sent to her old address sent to her new address that contains some forms she needs to fill out and send back to the NVC.

    So I hope that clear it up a bit, it seems that I am now trying to obtan this cr1 visa. Unfortunetly, I now have more concerns/questions that I hope I can find some answers to with the help of all you again:)

    I looked on the forums a bit but I can't really find answer to my questions yet, here they are:

    1. So now that this CR1 visa seems to be the better route-what about the 129-Do I just continue to let that proccess untill my wife is heading her way here? Or should I call in and cancel that?

    2. I have read the guide for the CR1-my question is- and it might be answered when I get the package, but im impatient:) The guide has two lists to compile: 1. for pre-interview and 2. for the interview - These lists are almost identical. I am a bit confused on how these lists work.

    I assuming the first list is for myself, the sponsor, to compile- and then am I sending this list to NVC or to my wife?

    second, I looked on the time charts, but 1. I could'nt find any info for immigration from New Zealand, 2. Honestly, the charts just gave me a headache:) . Can anyone give a rough ballpark of how much time is left for: NVC to send me 184 package, NVC to process signed form from spouse and contact consulat, Consulat to arrange interview.

    Lastly, I is there any advice or things I should know for the rest of the process. To remind me of my current status: I just sent the 70 dollars affidavit fee to the NVC at the begining of the week. THe NVC resent the package for my spouse as well.

  8. Hello everyone, I am new to these forums, but I have been using this website to complete my K3 spousal visa. I have been reading the forums a bit, and everyone looks helpfuly, so I thought maybe I could get some as well. Here is my update:

    -Send in all the packages and followed guideline as outlined on website

    -Got approval notice and letter said it was sent to the NVC.

    -Recieved a transfer notice saying that my application was transfered for quicker proccessing

    My latest mail was this package telling me to pay a 70 dollar affidavit fee, and they will send me the forms with further instructions.

    Okay, so now for my questions: While I assume and hope this is normal, this was not mentioned on the website as far as I saw. After I send the fee, I assume that they will send me the forms and give me instructions to send the forms to my wife so she can continue the process in her home country-as outlined on website.

    Can anyone confirm this? Or is this something else, perhaps new procedure? Lastly, if this is all correct, can anyone link me to, or explain the proper format to send the check, it makes vague guidelines to send it, but I don't like to take ANY chances.

    My next question:

    My spouse moved during this process, and the adress they have listed is wrong. Again, they give vague instructions to send change of adress information to a place. However they give no instructions on format or if there is a form to fill out for change of address.

    Can anyone help me with proper format or form for changing address?

    I Forgot one last question. The package keeps saying to send everything to the NVC, however, like i mentioned I got a transfer notice saying my application was transfered to a california department for quicker proccessing. So where Do i send everything?? NVC or the California one?
