Hi all,
If my wife applies for naturalization from the USA (n-400) once she is eligible, can she do biometrics, interview, and oath from overseas? We would like to move overseas right after she becomes eligible for citizenship in the USA.

My wife (green card holder of almost 2 years - through K-1 > marriage route) and I (US citizen) would like to move overseas to work as missionaries. We know she needs 3 years in the usa before she can apply for citizenship. we have heard that there are exceptions for missionaries and people working for the usa gov't, where their time can be spent overseas but count as time in the usa for this 3 year requirement. I used to have a document explaining this, and i didn't really understand it, but i can't find it now. any help?

My wife's Employment Authorization card came with her name wrong. It has her maiden name with a middle initial that is not her middle initial. What should we do?

I have a question about traveling after the green card is received. The paper we got when the visa was granted said something about not leaving the united states for more than six months, but if you leave for more than one year you need a re-entry permit. What if we want to leave the USA for 9 months when she has a green card, but not citizenship?
Also, when we get the green card, can we apply for citizenship, then wait three years, or do we need to wait three years then apply for citizenship? Also, if we leave the USA for, say 9 months, how does that affect our 3 year requirement for citizenship?

for adjustment of status i need to translate my wife's birth certificate. I just called a service and they quoted me at $150... is that normal? do i need some special certificate that shows the translater is certified?

i am reading the instructions for the adjustment of status (my fiance just got here on k-1 and we are now married)... and it says all we need is the vaccination suplement from the medical exam we did for the k-1 interview... but the only thing we have is a card from the clinic where she got the vaccinations.. it has some stamps for which vaccinations she got... is that all they want for this??? we have nothing directly from the doctor we paid the 100 dollars to for the medical exam. the consulate kept all of that stuff. any advice would help! thanks!

Paul,Arrival/Departure Record, filled out on the airplane prior to landing in the USA. The immigration officer took the Arrival portion and stapled the Departure portion into the passport on the page opposite the visa. Should have, anyway.
You will never have one - citizens and LPRs don't use the form.

My fiance is here, with the K-1 visa... we are married now... so that makes her my wife... and i am working on the AOS I-485. It asks for the I-94, and my fiance says she never got something like that... neither did i... what is that? -

Hi All... i have been busy. My fiance got the visa... entered the US, and we were married a couple days ago in FL. We live in MN now... but I have no idea what to do. How do I change her status? any help would be great!

Hi All
I had a public notary stamp my I-134 and sign it... but the instructions say something about an official seal or certificate that needs to be affixed if done by a public notary. What is that?? I already an in brazil with the documents and dont know if i can get some seal or certificate from the person who notarized it.

Hi everyone,
my finace got packet 3 (brazilian) and when she went to the state police to ask for the criminal record, she gave them the paper from the packet 3 that is supposed to go with the police record and they took it, then lost it... so... is there any way to get another one? it is just that one sheet that explains to the police who wants the record and why.

Eveyone here is so helpful.. after i get through this, i'll have to stay on and repay the favor to all those where i am now. anyways... the I-134 says self employed people need the 1040 taxes from the last couple years, but not employees. the instructions my fiance got seem to indicate that any sponsor on the i134 needs to show tax returns.... any insights??

about support documents... the instructions my brazilian fiance got say something about a I-864 document about support... but all I know about is the I-134. Which do I need? The I864 is really long
also... she is filling out the form she got in packet 3 to send back which says she has everything ready (we almost do, so we are sending the letter now... cuz by the time they get the letter, we should be good)... and she made some mistakes about her places lived... can she just white it out??

My sister is gonna be the financial sponsor for my foriegn fiance. There is a question about whether or not my sister intendos to make contributions to the support of my fiance.... does it matter what she puts? she doesn't expect to give us any, but she would if needed. Just not sure how to answer that, and if it matters.
also, what should my sister put for her relation to my finace?

For a spouse the rule is 3 years 18 months, with periods ounside the USA of no more than 6 months.
The exemption for non profits has to do with non-profits that promote the USA.
You will need to obtain a re-entry permit if you plan on being away from the USA for longer periods of time.

SEC. 319. [8 U.S.C. 1430]
(a) Any person whose spouse is a citizen of the United States may be naturalized upon compliance with all the requirements of this title except the provisions of paragraph (1) of section 316(a) if such person immediately preceding the date of filing his application for naturalization has resided continuously, after being lawfully admitted for permanent residence, within the United States for at least three years, and during the three years immediately preceding the date of filing his application has been living in marital union with the citizen spouse, who has been a United States citizen during all of such period, and has been physically present in the United States for periods totaling at least half of that time and has resided within the State or the district of the Service in the United States in which the applicant filed his application for at least three months.
(B) Any person,
(1) whose spouse is
(A) a citizen of the United States,
(B) in the employment of the Government of the United States, or of an American institution of research recognized as such by the Attorney General, or of an American firm or corporation engaged in whole or in part in the development of foreign trade and commerce of the United States, or a subsidiary thereof, or of a public international organization in which the United States participates by treaty or statute, or is authorized to perform the ministerial or priestly functions of a religious denomination having a bona fide organization within the United States, or is engaged solely as a missionary by a religious denomination or by an interdenominational mission organization having a bona fide organization within the United States, and
© regularly stationed abroad in such employment, and
(2) who is in the United States at the time of naturalization, and
(3) who declares before the Attorney General in good faith an intention to take up residence within the United States immediately upon the termination of such employment abroad of the citizen spouse, may be naturalized upon compliance with all the requirements of the naturalization laws, except that no prior residence or specified period of physical presence within the United States or within a State or a district of the Service in the United States or proof thereof shall be required.
Thank you so much for that legal stuff... even though it confuses me. I sort of think I should consult a lawyer to explain that law... but missionaries don't really have budgets that can handle lawyer fees!! Thank you though.. it makes me want to pursue it more. Or maybe I could just contact the government office that handles that stuff... we haven't even gotten married yet, but we want to plan ahead because the mission organization we work with would like to know when we can come back to work... we have both left the organization until we get her citizenship squared away, I am just doing accounting and university until i can get her here, get her green card, and figure out how soon we can go back to work as missionaries in Russia, and how long we can go for before she is a citizen. Any clue which government office I would need to contact about this?

Thanks so much for the help! I thought she has to be in the USA at least 18 months of the first three years. Do you think an immigration lawyer is worth asking about this kind of question?

Hi all,
My fiance and I, after getting married and getting the green card, would like to move out of the usa for a while, as we are missionaries. She is Brazilian and I am and American. We met working together in Russia, and want to move back to Russia for work asap after getting married here. I was wondering if anyone knows where I can go to get the facts about how soon and how long we can leave. I know she must be in the usa for at least 18 months of the first 3 years to meet the citizenship requirements, but also that there are exceptions if you work for non-profits. Anyways, I thought maybe that someone out there has had a similar situation, or would know where to point me to get the facts. I am sure some gov't office would be able to help me, but I don't even know what office handles these questions.

I got the noa2, then the nvc sent me a notice that they are sending my stuff to the embassy in Rio de Janeiro, Brazil. Can I contact the embassy there to know if they got my stuff?

Oh I am so happy.. i got the email today that my petition for the k1 was approved. now we are waiting for russian police records. i am praying they don't take 4 months like they said.

I got touched today. i almost screamed, but i was in a quiet study room at my university. now i will be hovering over my mailbox even worse than before. Some people say they got meaningless touches... but they have to mean something... just not what we wanted them to mean. i hope mine means that noa2 is in the mail!

yeah i know that law about 30 days, and i told the russian embassy in teh states that, and they gave me an excuse. it takes time to move information, blah blah.
Police reports are needed from every place lived at 12 months or more since age 16.Russian police certificate should take no more than 30 days to get.

The law states that in Russia, MVD offices must provide the certificate within 30 days. Those residing outside of Russia, both Russian citizens and non-citizens, may either delegate a Power-of-Attorney to apply for the certificate on their behalf in Russia, or apply directly to the Russian Consulate. Police certificates should note all names that the person has used in Russia, and should note the MVD branches in all locations that were queried.

Hi Everyone,
My wife will apply for citizenship based on marriage next week. If the process doesn't get all the way done before september, when we need to travel out of the country (for 5 months) we planned on writing and asking for the interview/oath to be held when we get back. Are there restrictions on traveling out of the country while the N-400 is in process? She has a 10 year green card.
