  1. My husband did not earn enough to file tax returns so he does not have them. Thats why i thought he needed W2 as proof of that. Sorry i didn't mention above.

    He has a new job now where he earns enough but it has only been 5 months so again, he does not have the tax returns for this. 

    His father said he will sponsor me and he earns enough. We can get the tax returns for him though.

     

  2. So my husband is the petitioner for the i-130.

    His father will be my sponsor, so does this mean he would fill out the i-864

    My husband does not have all the w2 for the past 3 years and will be unable to get them because the business shut down. Will this be a problem if he is not the main sponsor?

    If my husbands father makes enough money and we live with him do we even have to use my husband as a joint sponsor? Or can we just use his father alone.

    My husband has been working at a new job for 5 months so does not have a w2 for his current work. 

     

    I'm really confused and would get a attorney but we can not afford one.

    Hi thanks for helping, Do you know if you are looking at the most recent version of the form, my page 10 does not say that. Sorry for being confusing.

    When i search what a U nonimmigrant is:

    The U nonimmigrant status (U visa) is set aside for victims of certain crimes who have suffered mental or physical abuse and are helpful to law enforcement or government officials in the investigation or prosecution of criminal activity.

     

    I am a wife not a victim of crime. I am very confused.

  5. Q27 says to refer to the who may file form section. However it is not clear what category i fall into.

     

    I came into the US as a visitor with my ETSA. I got married. I am now applying to stay with my husband here in the US. 

    Would anyone know what section this is? I can not find it myself and i called immigration and asked for clarification and they told me i have to ask a attorney. 

    I think it may be c 9: Adjustment applicant under section 245, but its all gibberish to me and i am un certain. 

     

    I can not post all the option here as there are 12 pages of it.  But here is the question:

    I don't suppose you would know what my immigration status would be when i entered america. I came in on a ETSA i was not intending to immigrate, so would i just say no status?

    and also what my current immigration status is? I am married to a american citizen and am applying to stay.

    I'm sorry all the codes get confusing. 

  7. Correct me if i'm wrong but i have a i-765 form here.

    It seems to be different from the completed form version in the guide section.

    At the bottom of my form it is dated 05/31/2018 is this a new version? If so has anyone got help on this version of the form?

    The help sheet one is dated 1/17/17.

  8. 1)If i entered on a ETSA what is my class of admission?

    I entered 2 months ago and we just got married, so we are filling in forms, My ETSA visa will expire in a month.

    2) when does the process start which allows me to stay over the 90 day period?

    or do i have to go home and then submit another set of new forms because we didn't get these ones done fully/ hear back in time?

  9. I Just got married to my American partner. We got sent a pack of all the paperwork we would need for me to stay in america with him (i am english). 

    The documents are:

    i-130

    i-130a

    i-765

    i-485

    i-693

    i-131

    i-864

    What is it we need to do first to start the process? We was told on the phone that while it is pending i can remain in the USA. 

    But which form is the main one and can i fill out the others while the most important one is pending?

    I understand that it is probably best to send it all off together but i am getting very confused with the amount of paperwork given to us and we have a limited time to start the process as my visa will expire in 1 month and i do not want to be here illegally!

  10. For some reason the form we downloaded doesn't run smoothly.

    I've tried downloading it again, straight from the uscis website, but again i have issues.

    1) It doesn't save everything. Some boxes will be blank next time it is opened.

    2) Some boxes can not be clicked on at all. For example, 38.a name of previous spouse. can not be clicked on at all. we only want to add N/A. 

     

    Why is this so hard. I just do not know what i am doing wrong, how hard should it be to fill in boxes! :(

    I had a freak out today about how stressful this was (there were tears involved) and started talking about hiring an attorney or using them websites to try and make this easier.

    However, Re-reading everything said here really helps and the more i read the more i understand.

    I think we will be able to do this.

  13. This is all far too confusing for me, i'm really struggling with this. I am from England and my fiancé is american. 

    I understand he (the US citizen) will need to file for the K-1 visa, correct? 

    So im looking at the step by step guide on the site:

     

    Forms Needed to File for a K-1 Fiancé Visa:

    1. I-129F
    2. G-1145 (optional) 

     

    Does that mean there is only 1 form to fill in?

     

    because then, i click on the  I-129F link and then more forms come up:

     

        I-129F, Petition for Alien Fiance(e) [USCIS Instructions](also used in K3 apps): This form is used to petition to bring your fiance(e) and that person's children to the United States for marriage to you or to bring your spouse and that person's children (K-3 and K-4 visas, respectively) to the United States to complete processing for permanent resident status (under the LIFE Act and Amendments of 2000); please see section 12 of the Instructions to the form.
        I-134, Affidavit of Support: To file a promise with the Bureau to support an alien entering the United States and that the alien will not become a public charge. A separate affidavit must be filed by the sponsor for each person.
        G-325A, Biographic Information: To provide biographic information on an alien. You file this form only as instructed on another Immigration application or petition.
        DS-160, Online Nonimmigrant Visa Application: This is an online form which the embassy requires to obtain your visa.
        DS-156K, Non-Immigrant Fiance(e) Visa Application: This is only needed (and should be provided) by the US Embassy issuing the Visa.
        DS-156, Non-Immigrant Visa Application: Only needed at once you reach the US Embassy handling the Visa. Should also be provided by them.
        DS-230, Application for Immigrant Visa and Alien Registration: Only needed by US Embassy handling the Visa. Should be provided by them also.

     

     

    So my question is what exactly does he have to fill in and what do i fill in?

    Also I've seen website that say they can help by paying them to do it? Would that be worth it? Will it make this less stressful?

    I'm sorry i'm just struggling to get my head round this.
