  1. Hey, I was in a similar situation.

    I married in Thailand and we came to the US, I was/am going for another degree and she planned to stay with me for a few months on a B2 visa. She was going to head home but our local congressman said to apply for adjustment of status. He has backed us up and we are going for our interview on the 5th of August.

    Call up your local congressman's office and see what can be done. I doubt you will have any trouble.

    I hope this is some help/encouragement. Btw, we arrived in late OCT, and applied in Feb.

  2. OK, so this might be a unique situation.

    We have our interview date coming up on 08/05.

    We had everything submitted, however at the time of the visitation at the civil surgeon my wife was pregnant.

    Recently she had a miscarriage and we are trying again.

    So our original letter they have states that she was unable to receive the vaccinations become she was pregnant. As it stands today she may or may not be, and we won't know until after the interview date.

    Would we just have the civil surgeon write a letter stating that she can no receive the shots until later, or can her OBGYN do this for us?

I was reading the question "Your relative is in the United States and will apply for adjustment of status to that of a lawful permanent resident at the USCIS office in:" and thinking: "Well, I am sending all the paperwork to Chicago as indicated, just it says, but why would it have me fill it in, does it deal with my local USCIS office???"

    OK, that's another chunk of paper work done thanks to your help payxibka.

  4. OK, short and sweet.

    I am sponsoring my wife and I don't make the $. My father is going to joint sponsor and his income is more than enough.

    Now, I fill out an I-864 (including last 3 years of tax info)

    My father fills out an I-864 and an I-864a (including last 3 years of tax info)

    Correct?

    It seems he only needs to do an I-864a, but I have been told they like as much info about anyone connected to the immigrant.

    Thanks, been working on this for awhile, but getting some of the required paperwork out of Thailand during the past "coup" and then having to wait for my taxes to be amended have put me way behind schedule :/

    I can get the letter from work, but the thing is that I will be working commission (not 100%) . I worked for them before while in school and I was earning about $11 an hour. I used this to do as you say, make a conservative speculation.

    Gah, I graduate, move to Thailand and make great money for the country and now I move back to get a second undergrad degree because I don't want to do anything related with my first degree. So here I am stuck filing all these forms, oh well. it will all be worth it once I am done with everything...

    Furthermore I have another question. My mother is a housewife, so I would not be using her income, so when I add up family members in section 5 21 h I get a total of 3, but my father would have a total of 4

    Should I just write in 2 people for letter g so that our household totals are equal, despite the fact that my mother has no income to combine?

  7. First let me just say that I have a deep respect for anyone who has completed all these forms...

    OK, here is some history before I ask some questions.

    I moved to Thailand to work and met my wife over there, we have been married for 1.5 years and now are working on getting her status adjusted. Since I have been earning Thai Baht for the last 2-3 years and just recently got a job at a electronics store as I go back to school, I am below the poverty line.

    My father will be sponsoring my wife as well.

    So we both fill out an I-864, this much I know. but should we file as joint, or both put sponsor?

    Further more, since I just started work, for annual income, should I speculate, or simply state that I have just recently started my job.

  8. OK Thanks for all the help! I will check out the forum and get working on our K3 visa this week.

    If you have been a resident of Thailand for six months or more, you may be eligible to file an I-130 directly with the Consulate. If you have 11 months before you actually want to live in the US, I would definitely forget the K3 visa and go the CR1 visa route all the way. This works filing directly in Thailand or mailing your petition to the appropriate US service center of USCIS.

    Yes, there is an income requirement and if you don't meet it, you'll need a joint sponsor who does. This too is far more reliably accomplished going the CR1 visa route. The remaining issue will be US domicile. You'll need a US address. If you didn't maintain one, you could use parent's or another family member's address.

    Start by reading the "Guides" here.

    B2 is a visitor visa. Use it to visit, not to "reside".

    Great, I've been here for 2 years, this should speed things up. My parents are going to Joint sponser etc etc since both of us will go for further education once we get back so it's back to being a perpetual student :/

  9. Hey everyone, I have a few questions, I am sure my situation has occured before and was wondering if I could get pointed in the right direction!

    My wife is Thai and we were married this past March. We were given a b2 10 year visa to come visit my family and we would like to plan on moving the the US in Oct 2008.

    So should we apply for the k3 visa right away from Thailand or should we come over next Oct and begin the process for a greencard from the US.

    If it is possible to start in the US, are we allowed to visit Thailand for say; a one month vacation?

    I saw that for the K3 visa there is a salary requirement, currently we are both teachers and I moved here after I graduated University so the last job I had was at an electronics store, not exactly big $. Will this pose a problem?

  10. Hey everyone, I just want to say thanks for all the help I recieved here, though I was here briefly and may not be remembered. I have to update my Sig, but at the moment I am sitting here in the US and my Wife is sleeping in the next room. She was granted a B1 visa and tomorrow we are able to have our second wedding recetpion so that everyone can join in, since only my mother could make it to the wedding in March.

    Now my wife and I are looking at moving to the US for good and eventually naturalizing her. So naturally I have some questions.

    She has a b1 visa now, can she apply from within the US for her K3?

    If yes, what are the rules, can she leave the US during this time to visit family?

    If we apply in Nov for her K3 and it is given on the first attempt, am I right to assume about 8-10 months for the process?

  11. Hello everyone I stopped by awhile back to look around after my Fiancee was denied (in August) We are both teachers so the next chance to get to America is this April. We only want to visit for 30 days since my father can not travel and will miss the wedding in Chiang Mai (3/31/07)

    She had the following at the interview

    All the forms correctly done

    Proof of a steady job (3 years)

    A house in her name

    A car in her name

    And enrollment into the Master's program at Payap.

    She was denied on the vague statement of " not enough evidence to return to Thailand"

    We DON'T want to move there yet, when we do we will file those correct forms, but now we just want a 30 day tourist visa. This time we have a few more letters and I hope to be enrolled in Payap prior to applying again as well as having a letter from work that I will be returning for year #2. Just to hope that the proof that the Farang plans to return as well.

    Anyone who has had success is BKK or CM more giving? Is there a day when a nicer person is working? I have heard that the Consolate in CM are, well a long string of thing I don't need to repeat. We work 60hrs a week so it seems like forever trying to get ready for try #2

  12. Hey everyone so I will give a nice background story.

    in Oct 2004 I was finishing my supposide last semester of college. I needed just to take a spanish 3 night class and walk in the spring. Well these two wonderful profs from another school came in and told me about Thailand. Upset I missed the chance to study in Thailand I said "Who cares about debt, I am going to Thailand!"

    So in Jan 2005 I set out to Chiang Mai Thailand, I studied Thai language, culture, history, Buddhism. I lived with a Thai family. I lived with hill tribes, I did Tsunami relief work, I also tutored at a Buddhist university, working with a bunch of 2nd-4th year monks. I chose this over another opportunity of teaching at a local Gov't school, I decided I couldn't pass up the chance to work with the monks. But it was a hard decision for me and I didn't know why.

    Well as you can see I loved it here (err there, I am sitting in Newark Airport waiting to get home after my month back in the US). So after trying to find a job in the US for 7 months (Have a BA in Marriage consoling, not easy) I said "Hell I miss Thailand, I want to teach" So I returned January 2006, took a teaching cert class and moved back to Chiang Mai. I ended up working at that local Gov't school I passed up the year previous.

    Well I soon met a wonderful girl, woman I should say, and we quickly realized everything was right. The wedding ceremony is on 3/31/07 the legal marriage will be much earlier (for visa reasons). She was denied her 30 tourist :crying: But we will get her to meet my dad (my mother had visited me and met her).

    She is 28 (yes I know you will say she looks 17) Has a BA in English, her MA in TEFL and is just so amazingly sweet, intelligent and beautiful.

    p.s. her family loves me, they are also well educated, Both families are excited to be joined together :)

  13. Hey everyone, I had a few questions and the search engine here is a lil funky, so I was hoping to just ask for some help.

    I am sitting in Newark Airport waiting for my flight back to see my Fiancee and get back to work on monday. We were sad because she was denied the 30 day tourist visa, as I have been home for this past month.

    We plan on getting married legally in nov/dec and the ceremony is on 3/31/07. Now what we want to do is this.

    We only want to return to the US for 2-3 months in may-aug. She will begin to teach again in Sept and I will be starting my MBA here as well. So trying to move perm. to the US is out for the next 2-3 years.

    What is the best Idea to bring my soon to be wife to America for a nice vacation?
