  1. Hi folks,

     

    My partner and I (US and UK citizens respectively) just started the K-1 process, and received NOA1 on Nov 6 - estimated time for processing is late April 2018. I have a couple of questions about employment that are quite specific to my situation, but which I'm hoping someone here will be able to answer.

     

    1. I want to apply for a specific position that's being advertised in my field in the US. The application deadline is Dec 1, 2017, and the start date for the position would be September 2018. I've corresponded with the employer and told them my situation, and they say they are already recruiting from an international pool and encouraged me to apply, saying if I am selected they will work with whatever stage I am at in the process. However, from some things I've read on here and elsewhere, I'm concerned that applying for a US-based job while the K-1 is in progress might look a bit dodgy to USCIS. Could someone please tell me a) whether I am legally allowed to apply for this position while the K-1 is in progress, and b) if so, are any other reasons why I shouldn't?

     

    2. I've been doing some online volunteering (informal writing and editing) for a US-based nonprofit since last year, and the director has suggested that from early next year they might be able to offer me some paid freelance work. Same questions as above, essentially: a) is this allowed for someone applying for a K-1? b) is this advisable for someone applying for a K-1?

     

    Would really appreciate any advice anyone can offer! The first question is very time-sensitive and I'm putting together application materials at the moment, so would be extra-grateful for quick responses on that :)
