    This might be a silly question, but I don't think I could find this here (probably because it's so obvious!), but I wanted to make sure about it. My husband moved here last year and got his EAD card. Then he applied for adjustment of status and got his permanent resident card (green card). His EAD is about to expire - does he just let it expire because the green card allows him to work, or does he have to renew the EAD also? It seems strange that he would have to continue renewing the EAD once he has the green card since that lets him work, but we wanted to make sure. The way we understood it was that the EAD is what you use to work while you're waiting for your green card, and then after that, you just need your green card to live and work here.

    My fiancee just got Packet 3 in the UK, and we have a couple questions:

    - Does he actually have to have my I-134 and supporting documents in his possession before he sends Packet 3 back?

    - The example form on VJ for the K1 shows part 1 and part 2 of DS-230 filled in. Do we need to do DS-230 part 1 and part 2?

    I have a similar question I thought I'd add on... I'm also getting ready to send originals to my fiance for his interview. I know that in the I-129f package, personal letters/cards to each other and boarding passes can just be photocopies, but for when he goes to the interview, does he need the original letters and boarding passes? Has anyone been asked to provide original letters or boarding passes at the interview?

    I’m not sure if this should go here or under the service center forum, but I’ll try here… I am getting ready to send off the I-129f package for my British fiancé to get a K-1 visa. However, I don’t know which service center to send it to because I’m kind of “between” states. I was living in Michigan until the past few weeks when I came to Kentucky to stay with my mom before I fly to Britain for a few months. So currently, I am residing in Kentucky and will return to Kentucky in January for a few weeks, but will then move back to Michigan. Should I file through the Vermont center since that is the one for Kentucky? I will be using my mom’s Kentucky address for the application. Will it be a problem that I will move to Michigan (which goes through the California center) next year while the K-1 process is still going? Will they have to transfer the case to the California center or keep it with the Vermont one?

    Also, the I-129f asks where he will live once he moves here. When I get back from visiting him in January, I will go to Michigan and get an apartment. I don’t know the address yet, so can I just write that he will be living in an apartment in Michigan with me?

    Sorry for so many question! This is so confusing with two states! Thanks for any help!

    My fiancé (UK) is going to be filing for a K1 visa soon, but I have a question about me using public funds. I know that the person immigrating to the US cannot use public funds, but can I (the US Citizen) use public funds? I might need to use emergency Medicaid for an emergency room bill I just received. Is Medicaid considered public funds? Would it hurt our case (either for the K1 or for when he adjusts his status) in any way if I use Medicaid this one time?

    My fiancé (UK citizen) will be applying for a K1 visa soon, but I had a question about his work situation. He works for a UK company where he can do his work at home, which means he could do his job from the US. Is it legal for him to continue working as soon as he gets here on the K1 or does he first need to get an EAD, even though it's a job in the UK?

    I have a similar question to loudnlow so I thought I'd post on here before starting a new topic. My fiancé (UK citizen) and I (USC living in US) are trying to decide between K1 and K3 visas. If we decide to go the K-1 route and I file an I-129f for him, can I then go visit him in the UK for a couple months on the visa waiver program while it is being processed? I would use my parents address in the US to receive mail, but I just didn't know if I need to be physically present. Is this completely legal to be with him in the UK during the process? Does anyone have a website link saying that it's legal? I can't seem to find anything...

    Any help is appreciated!

  8. Are you a UK resident? If so you may be able to file in England. Have a look at the US Consulate website in the UK because it can be much quicker. I am in New Zealand with my husband until he is approved but I filed in the US by mistake. Didn't realize I could file in New Zealand. Hope this helps. Good Luck.

    My UK boyfriend and I are planning to get married this fall in the UK. He is then going to get a K3 visa to immigrate to the US. I know that the I-130 and I-129f are filed at US offices, but can I mail them from the UK (after our wedding) so I can stay with him during the process, or do I have to physically be in the US when I file? If I have to be in the US when I file, is there any other time during the process that I can go visit him?

    I have several questions and concerns but am unsure about which forum to post in, so hopefully this one will work. Next year I am planning to emigrate from the US to the UK to marry my boyfriend Nathan. Before I apply to emigrate, he wants to come visit me again in the US (on the Visa Waiver Program) to meet my family since he hasn’t done that on his previous trips. However, we are a bit worried that he will be denied entry because of things the CBP officer said to him on his last trip.

    He has visited me twice before on the Visa Waiver Program. He visited once in January for one week and came back again in February and stayed for 3.5 weeks, but he was hassled quite a bit on his second trip. Part of the reason the officer didn’t like the situation was because Nathan had just visited the US three weeks prior. The officer said that he should wait at least 3 to 4 months before trying to come back again; it has now been 7 months since he last visited. Also, Nathan lives with his parents and works for them in their family business, but the CBP officer said that the job with his parents didn’t count as a proper job and since he doesn’t own a house or have a lease that he has very few ties to the UK.

    Because of this officer hassling him so much last time, do you think he will be able to get in even though he still works for his parents and lives at home? Will this show sufficient ties to the UK? Would it be beneficial for him to tell the officer that I am planning to emigrate to the UK and get married there? Would that help show ties to the UK? However, I have not started the emigration process so we do not have evidence of that. Does the length of his stay have an impact on if he will get in or not? We were thinking he would come for about 3 weeks, but we would like to make it longer if we think he would get in. If he is denied entry on this visit, will that affect him applying for a K3 visa or direct consular filing in case we want to move to the US in the future? Would there be a certain number of years before he could even visit the US again if he is denied?

    We really appreciate any help with this. Nathan is wanting to come visit in November or December, so we are wanting to know if this visit will be possible. Thanks for any help!
