    I know it just really hursts that he gave up so quick. I am hoping that we can work it out. But already had his lawyer file and the divorce is in process. He does not trust anything I do or say. It's like trying to win a losing battle. I had no idea how hard it was going to be when he came here. That created alot of stress our first year. I was really hard on him, but have aplogized may times for that. I am having a very hard time digesting that fact that we are no longer going to be married.

    I have a question....I know the process of filing for a waiver to remove conditions in the event of divorce. I know what is needed to prove a bonafide marriage. I am going through a divorce and want to work it out with my husband (who is the immigrant). He has filed for divorce and wants to go through with it. We have had a rough time this first year. But i think we can work on things. So I am hoping we can reconcile. I do not want him to go back to his country. He wants to stay here as well.

    Does anyone know .....In most cases of divorce, things just did not work out. But it was true and bonifide. Are most waivers approved. Who else has gone through this proccess and been approved on here? Any feedback will be helpful.

    You situation is clear and not complicated. Support your husband and encourage him to reconcile, maybe try counseling. If you'll get divorced and he files for a waiver, you can provide an affidavit for good faith marriage. Waivers are rarely denied unless there is solid evidence of fraud or other wrong doing. I see no reason to worry!

    No not yet trying to figure out what is best. I want to work things out with my husband. From what I understand if we are not "divorced" but "legally seperated" we still still file removing conditions jointly. He is living out of the home right now. If we work things out we can go and explain our situation. I am sure couples have problems like this all the time. Meaning.....they seperated then reconcile. My husband does not understand any of this and is afraid if we do not get a divorce USCIS will think the marriage is fake. Because he is living outside the house or "was" if we work it out.

    If he files while not living together but not divorced he stands a good chance of being denied if you filed jointly.

    If you want him to stay in the US it would be better to divorce and then file the I-751 as long as he can prove he married "with good faith".

    Does anyone know of cases where if you are leagally seperated and file for I-751 together? I understand that you can still file jointly if you are seperated. We would not be legally divorced. My husband and I are having problems. We are trying to work it out. He has moved out and notified USCIS of an address change. We are talking and thinking about filing for divorce. We are still trying to work on things. Our plan was for us to divorce, him file a waiver on marriage based on good faith marriage. We will continue to try and work on the marriage. If we can work things out we could re-marry in the future. My thought was ...would it be better to just leagally seperate and still file jointly? What are the chances that he will get approved based on we are still married but seperated? I owned my home prior to marriage. So there are not lease agreements or his name is not on the mortgage or deed. All the bills were in my name due to him not having the job or credit in the begining. The only evidence we have are

    1. Car insurance policy with his and my names

    2. He was on one of my credit card accounts.

    3. Mail of his sent to home address

    3. His checking account with home address

    4. Him being on my health insurance

    5. Pictures of us

    6. 2008 joint tax return

    7. He has some cancelled checks where he wrote to me for houshold bills.

    8. Letters from friends that marriage was bonafied.

  7. My husband received his work permit and travel permit in the mail a few weeks ago. Then a few days ago he received his green card. No interview, just got the green card in the mail. My question is....when we travel out of the country does he need to use his travel permit? Or can he come and go with his green card? He has condtional perm. residencey based on a k1 visa.

    Does it usually take longer to get the green card?

  8. I just got married in Vegas on May 17th. I have been fillling out paperwork as well. You should of gotten your marriage liscense from whoever married you. You can make a copy of this and send it with your paperwork. Just take the orig with you to your biometric appt. I have talked with a few others who have done this and everything was fine. If you read the intructions on the i485 it states that you can send copies. Which means that it does not have to be a certified copy.

    I got today the letter and the pack 3 from the embassy today. Now things are moving faster for us, I still have to fill out the forms, to have the pictures done and set an appointment up for us for the medical exam and what about the shots? Do I have to get it now or when i go for the medical exam?

    Who else is ready for the embassy appointment now from the may-june filers?

    I filed in June and just got my notice from the NVC today, they received my case. So now just waiting for pack 3 from the embassy. I already have all forms filled out and ready to go.

  10. Hi, I am a US citizen and am going to marry a Costa Rican. I really want to get married in Costa Rica in March 2007. I do not want to wait to file for a k-3 visa after we are married. Is it legal to get a K-1 visa, marry legally in Costa Rica and then bring him to the USA and marry here as well. My thinking is he will get the K-1 visa by March and be able to come home with me after the wedding. We then could marry in the USA as well.
