I do have a job in my home country and I do take with me a letter from my workplace indicating how many days I will be off and when is my expected return to work. I have never been asked for it but I ensure that I travel with it. I will be visiting shortly in 3 weeks and will be staying for another 3 weeks. This well be my 4th trip since we filed the petition. Try to have your spouse visit you as well. If their job is more flexible. My husband visits every month as it job allows him to do so. I ensure that I save all over boarding passes for the embassy interview as proof of an ongoing relationship.

     

    Plan your trip

    Take your proof of ties to your job

    Enjoy your time together with spouse as this process is not an easy one.

    It gets harder for the next time you get in if you visit for a long period of time, a few cases where people was not allowed in as they appeared to be trying to "live in the US" given the time they spent. A job also keeps your tie with your home town. I cannot say how long you should stay but i'm sure you will get an idea after reading everyone's experience on that thread, from 2014 to 2017.

    On visa journey only where people list down their timelines , you can do a search on 129f . Yes , in many cases where the processing comes down to the same time as a corresponding CR1 (if under processing) it gets cancelled and only CR1 is processed. 

     

    I have also also read people saying that it's bad or could delay the CR1 processing timeline if you file for a K3 visa, I don't see any truth or logic in that ?

    If your husband is a citizen, the process would take a year or maybe a little over that as long as you guys properly follow up with the agencies involved. I would suggest to wait it out and don't complicate your case. One more thing, you really need to have a lot of patience when dealing with USCIS and NVC.

    Thanks for replying. Yes, I have started believing from all you guys input that patience is only what will keep one sane in this long journey. 

     

    Sorry, but what context did you speak about complicating the case , is it going on a visitor visa ?

    I have visited twice every 6 months apart when we started this process, staying 10 days each time given i have a full time job and we want it to be sustainable so i can support myself when i'm still here. Husband visited once and coming again for christmas.

    I spent time reading through the "visiting US at NVC stage" thread and it would be more convincing if you visit multiple times with short period, they will still let you in even your case is at NVC stage.

    Last time i visited in July our case was still at USCIS, officer asked where i'm going and for how long, and then i was in! But i did prepare the following with me even it was not necessary:

     

    - A letter from company stating my employment and annual leave duration

    - My tax transcript

    - My monthly mortgage slip 

    - NOA1 copy

    - My salary pay stub for past 3 months

     

    Husband bought me a ticket for thanksgiving visit next month and our case is now at NVC stage pending for case number to be assigned. Will need to add NOA2 copy to the pile.

    I have had this thought in my mind and I was thinking that I will decide on my job based on for the period that I could stay with my spouse on a visitor visa

    Thanks for your response. Yes, I guess it's best to stay in a job if I want to visit. What are the other options to prove your intent to go back to your country other than the job. I don't think there are many other options to prove this. 

     

    I wonder though why would they suspect ones intention since the petition is already filed

     

    i would have gone for a k3 Visa but I have heard it takes as long as the CR 1 processing

    Yes, you are right Jose. Which is why I want to have views from people like yourself who must be having first hand experience with the I 130 petition.I am just anticipating things right now hence thought abt the 3-4 month period. Thanks again

    Yeah .. I guess you  are right though my intention is really to come back , quitting job would not be a good idea atleast the Officers will not be convinced that I really want to come back as I will have to be present here for the consulate processing

    That's bad news 😒 I was thinking to quit and go btw . I would just like to stay positive and wish that the processing time get faster for everyone .Thanks for your reply though 

  10. I plan to only visit and have a complete intent to come back at home. However , I have travelled a few times to US on business before and was always given an I 94 for 6 months so was thinking if you can by ofcourse telling truth to the CBP office has a chance to be given the I 94 for that long again 

     

    I don't want to take any risk , if by people experience , I could only be allowed for a shorter duration , I should only plan for that

    Also, I have been told by various attorneys that it's usually not a good idea to visit as it's on the cbp officer discretion and if they send you back because you have a dual intent being I 130 in process, the sending back could impact the I 130 processing. Hence I thought would be best to ask you all as many of you might have thought about availing this option or would already have done so.

     

    why does I 130 at Nebraska takes so long , isn't there any hope that they will start processing faster. I don't want to stay away from my husband for so long 😖

  12. Hi 

     

    I have got my I 130 petition filed in september 2017. Its with Nebraska service centre right now , looking at the processing time lines I sort of got hopeless as it's taking way too long or maybe I was too hopeful in the beginning. Could someone please advise if and for how long travel to is to visit my spouse will be possible, I am currently holding a B1B2 visa. 

     

    I am guessing that people like myself would have tried these options , would appreciate if you share your experiences and also if this is a viable option to go for
