I-130 was approved back in 2017. I used that  when submitting i485, but was rejected because it has been more than 2 years since i130 was approved.

so i need to file i130 and i485 concurrently.

Probably that’s why they denied your adjustment of status. Just do concurrent filling this time , sent in i-130 and I-485 together with the rest of the forms. Just make sure you have all the documentation right so it won’t delay the process. I wish you plenty of luck.

  2. SSA.gov . You can get the social security statements required for i-864w. Anyways if you havent worked for 10 or more years in the U.S , don’t file i-864w, because it’s gonna get send back , they will send a REQUEST FOR EVIDENCE instead of telling you that you don’t qualify for it so file i-864 . That’s what happened to me , just giving you heads up. You can file only 1 of the two forms, depending on which one you qualify . If you dont meet the requirements for EXEMPTION i-864w , don’t sent it , you are gonna delay the process .

  4. Hello . When you file form i-130 , you dont need to send form i864. Unless you plan (i-485 adjusting the status)  at the  same time. But for form i-864 , if you didnt have any income for 2017, but you are working now , you gotta send in a letter from the employer . Stating the date you started working there , the position , full time or part time and how much you earn . You also need to attach pay stubs for the past 6 months . I attached pay stubs for the past 8 months lol , Thats how i did it . And got it approved . Lemme know if you have anymore questions

  5. Yes i have been working for about 9 years .  I called the SSA and i also went in person to SSA , i was told i have 36 credits and my wife 20 credits . Anyways i do believe there’s a mistake somewhere. I did what the instructions on the form ask . I sent the ssa statement for me and my wife . I tried earlier to attach a picture of the RFE , i couldn’t . Thank you for your time and help .

  6. If anyone is familiar with form 864w , i would really appriciate some help . I have earned most of my work credits before marriage . I have been married for 2 years. I have 36 credits and my wife has 20. But i can only use the credits during marriage . Filed form 864w with aos . Recieved an RFE stating that i do not meet the 40 credits . I included the ssa statements for my wife and i . What did i do wrong ?

  7. They process the i-130 by timeline . You can check the timeline at uscis and it should tell you on which month they are working on . Sometimes not accurate about the timeline posted on website . Mine took about 7 months and i live in US. A friend of mine was in the same situation as yours , it took quiet some time . Best you can do it’s having all the other forms ready and all the requiered documents and proofs so once the i-130 is approved , you can send the other paperwork right away . Good luck .

  8. Hello ,

i’m having the same issue with form i-864W. I have 36 credits and my wife about 20. My wife is a US citizen. From what the instructions appear we can combine the credits earned during our marriage. Sent the SSA STATEMENTS FOR MY WIFE AND I as proof , just how the instruction states . I don’t know if they need any other proof beside the ssa statement.  I just recieved an RFE stating that i need to file form i-864 because i don’t have 40 credits. Weird . Now i have to file i-864. Help would really be appriciated .
