  1. Did the lawyer send any paperwork to the embassy? My brother is age out by only 1 month and some days. He supposed to have an interview on January 5 2017. He got delayed due to TB/TB treatment for 6 months. Still waiting for sputum result/remedical (October 23, 2017 + 1 week release). Plan to have his interview on Nov 9 or ealier if available. 

     

    Birthday: September 19, 1996

    Priority date: March 2, 2015

    Paid DS-260: February 8, 2016

     

  2. Why does it matter how the mom got her greencard? My brother is in the same situation. He aged out September 19, 2017 due to positive TB/treatment. We are waiting for sputum result/remedical (Oct 23, 2017) + 1 week release. I petitioned my mom (she’s a green card holder now) and I am US citizen. He have interview on Nov 9 at this time but if we can get earlier interview we will take it.

    I read a few threads regarding age out child that got their visa. But I still want to hear from people that got their experience or really know whats going on.

     

    My mother (green card holder) petitioned my younger brother February 2015 when he was 19.

    His visa got approved when he was 20. Went for medical BUT St. Lukes found that he have TB (6 months treatment). He went for treatment March 2016 through September 2017. My brother’s birthday was September 19, 1996. We are now just waiting for sputum result and remedical which is (October 23, 2017) + another week for release. If everything is well with his medical he can go to the interview. At this time he have set for Nov 9 interview.

     

    My questions are:

    1. As my Mother being a greencard holder is my brother protected by CSPA?

    2. Does he have a chance to get a visa even aging out due to (Full year compliant) His priority date was March 2016

    3. Do we need to file another forms?
