  1. yes i have a bench warrant outstanding i don't think that would work because i tried to visit mexico last year and was denied entry they didnt give me a reason but i know it was due to the outstanding warrant in california, if i do enter through canada i will enter as a alien and i don't want to go through this process ill rather stay home unless i can get a visa i don't want to enter through jail 

  2. yes i deeply regret this, he has attending several times the bench warrant was put on hold for 6 months to allow processing times but he had to uplift it as he couldn't hold it for longer but the visa's didn't get approved anyway 

  3. no change yet my lawyer has said its pending until i arrive and there is nothing he can do I'm thinking of applying for a waiver of inadmissibility as i meet the requirements and hopefully the cbp can review it and get it approved

    he has tried but it can't get dismissed without me being there only as a misdemeanour and I'm not accepting that i want to fight the case and get it dismissed so i can travel to the us in future as my partner lives over there and i want to migrate

Hi there I have a pending Court Date in the us for a crime i didn't do, i left the us after the first hearing so i didn't over stay my esta upon entry coming back i as denied entry to the usa since then i have been to the us embassy to apply for a b2 visa but got denied twice even tho my attorney gave me a letter stating the court demanded me back and i need to attend the hearing upon the meeting i also showed my bail bond letters. the consular advised that my attorney can attend and i don't need to be there, which he can if i accept a misdemeanour but I'm not going to do that as i want to fight the case and my attorney has said in order to get it dismissed i have to attend so I'm stuck now as my esta was taken away and visa denied twice it has now been 12 months since i applied and 16 month since the alleged crime took place now I'm stuck as my bail bond has been forfeited and I've been told with a pending case i can't travel to the us until its cleared although my attorney says as soon as the visa is approved he will tell the court and the bench warrant will be uplifted so i can come back help ? i was told to apply for a waiver of inadmissibility but at the time of the appointment they stated as a result of your inelegibilities you cannot travel to the united states on the visa waiver program at any time due to 212a although the case is still pending i haven't been convicted of the crime my lawyer has never seen anything like this before although he advised me not to leave as i would have trouble coming back in

  6. yes i was allowed to leave the country i wasn't considered a flight risk. my esta was due to run out so my plan was to go home and come back, upon re entry i was then denied because apparently i overstayed by a day on a previous trip due to me coming in on east coast time and leaving on west coast time which i thought was pathetic although i had entered multiple times without any problems prior to this arrest. However i am now in this dilemma of what to do my lawyer is telling me he needs me there to get the case thrown out so I'm trying to see which options i have my bail was also 20000 usd and i don't want the signee to have to pay that which is why I'm trying to return

    yes the bench warrant was put on hold but the judge had to uplift it he couldn't keep it going any longer it was on hold for 7 months too allow visa processing time now the warrant has been issued i need to get the visa and when it gets approved he will let the judge know I'm coming so he can uplift the warrant the court knows i had visa problems and was denied entry i shouldn't have left but staying would have meant my esta would have been overstayed and yes my lawyer is up to date with everything he has just never seen nothing like this before he is a criminal lawyer and doesn't deal with immigration law

I've been travelling to the states in and out for the past 5 years on esta, i got arrest on false allegations and was bailed out and returned home pending a court date upon entry i was denied and my esta was taken away i have a up and coming court date too attend but i was denied a visa do to cimt although i have not been convicted of cimt in the usa its pending allegations i have been arrested in the uk and have my police certificates my only worries is that if i do not attend court i will not be allowed too go back to the states again the case is so light that the judge was willing to drop it to a misdemeanour although i did try to gain entry back into the us to attend court but was denied now a warrant has been issued for my arrest so I'm confused into what to do
