  1. Dont get confused. I will make it more clear to you.

    Do your paperwork and send the application to USCIS. This is Stage 1

    When the petition gets approved, complete the paperwork with NVC. This is stage 2.

    Once NVC finishes its thing, they send it to your parents home country where they apply for the immigrant visa. This is stage 3.

    This entire process takes approximately 1 year. Best of luck!!!

    OP WANTS TO KNOW IF THEY CAN VISIT DURING THE PROCESS.

    S/he was asking if they should do the visit first and file later, or if they can file now and visit during.

    Yes OP, your parents can visit with a pending petition.

  2. Once again, I am not planning to use a tourist visa for anything illegal so you guys need to stop saying that. Please, read at my post and if any questions...ask me.

    Main question I have is to know when to start working on paperwork. They are coming to visit in December and dont want any problems before or during their visit.

    If I have to start paperwork ONCE THEY LEAVE THE USA...then I will....thats only thing I need to know...

  3. i am confused JFH...what are you saying?? I should not do it ...I dont want to apply for them to stay here in the US when they come...I want to apply for them so everything is done in Peru and then whenever they get visas (I guess after 1 year or more) then they will come again but with a different type of visa.

    Do you understand what I am trying to do...Once again I am sorry if I am confusing you....and thanks again for all support!

  4. OK. My parents have their tourist visa until 2020. They just say “yes” for me to send paperwork so they can come to live me with me in NY. This Christmas was planned about a month ago so I guess my fear is to send paperwork NOW and having some kind of problem to enter USA when they come in December.

    I spoke with a USCIS officer yesterday and he explained to me that I can file when they are here but that would mean for they to stay until process is done (which I don’t want to do) and I know it can take up to a year and that’s why I was thinking if I file now, things might be going somewhere by next year. I want them to do everything they have to do in our home country (paperwork, exams, etc).

    I hope I explain myself better now.

    Last time I used this site was when was in the process of getting my K1. Now I am a citizen and about to start working on my parents paperwork to come and live with me in NY.

    Question#1: They are coming to spend christmas with us and will stay until Feb 20th (or so). Should I send paperwork now or should I wait till March 2017.

    Question#2: What do I send? Only paperwork that says on website for uscis,gov ...which means I-130 plus fee and documentation needed such:

    mother lives outside the United States,
    • Form I-130
    • A copy of your birth certificate showing your name and your mother’s name
    • A copy of your Certificate of Naturalization or U.S. passport if you were not born in the United States
    father lives outside the United States,
    • Form I-130
    • A copy of your birth certificate showing your name and the names of both parents
    • A copy of your Certificate of Naturalization or Citizenship or U.S. passport if you were not born in the United States
    • A copy of your parents’ civil marriage certificate

  6. I agree with you. I did not understand it at the beginning, but what can I say. He decided to go that way and now I have to keep doing what I want to do. I am a college student and I do not want to give it up . It will be like I am leaving everything that I worked so hard to build just because of him...and that is not fair :protest: :protest:

    That is why I decided to keep with this process. To prove to my self that I can do it...and I can finish what I started. May be once I get it (if I do) I might go back to my country, but at least I will have the chance to come back to visit or to do something in the future. I have very important people who were there for me when I needed someone to cry with :blush:

    It is hard but I guess that is how life is..."everything happens for a reason" and under that same quote if I get approved it will be good and if I do not, I will just go back home...that will be it!!!

  7. Hello...I am sorry to hear that...and I have to say that the same thing happen to me. he cheated and we got divorce after one year. In my case...I was the one who file for divorce not him. I am about to send my papers on the 17th...got everything together: car loan, bank account, insurance, other documents to both our names...letters from his dad, HIM and other friends who has known us for many years....single and married...so I guess even though I filed , I am covered. We will see...any extra advise you might think of????

    My divorce is final..after 1 month and a half..that was quick!!!. Now I am just waiting for my affidavit letter from friends to prove that I got married based on love and not interest. I even got a letter from my ex...he is sorry because of what he did (cheated on me)...Let's see how it goes. I am filling on March 17th...hope all works fine...I will let you guys now.

  9. Thank you all fr your answers and wishes. I had the feeling that choosing that choice was all I needed but I just want to be sure :blush: . Hopefully, all is done soon and I don't have to worry any more. Also, I am getting together prove from the time we got married until we separated. I have letters from his family members staying that they all believed that "I got married because I was in love"...it is hard doing this by myself...I never thought it would happen but I guess that is life.

    I will let you guys know once I have to file...please keep your fingers cross so my divorce is finalized within the next few weeks... :thumbs:

    It has been a long time since I post any questions or comments...I found my self in the position to look for help again...and I hope I can find it. Unfortunately, after 1 year and 3 months of being married,my soon to be ex-husband and me decided to get a divorce :crying: ...I already cried and suffered and now as this new year began, and after a lot of talking with friends and family; I decided to apply for the "readjustment of status" by myself.

    So now I am getting all my papers together while I wait for my divorce to be finalized...and that should be happening within the nest 5 weeks or so. Therefore, I want to know about the "waiver" I need to file. I don't have clear if it is a separate document or the same 751 just with a different choice (the one that says "divorce" ).

    I am kind of confused and I am looking to clear that up.

  11. THANKS EVERYBODY FOR YOUR ANSWERS. In our case it is a little bit different because we both we aupairs in the US before so we already have ssn. I believe that her fiance got her a job already. And if she gets the stamp, she will be able to work until she gets marry. That is how it happen to me. I work in one my old jobs for about 2 months and a half before I got married.

    However, the big question was if the stamp is giving somewhere else...because right now coming from Peru to here through JFK is wayyyyyyyyyyyyy to expensive. The cheapest way is Boston.

    I will check the reviews.

    Today, I am not posting this note regarding a personal issue, however, it is very important to me. I have a very good friend that just got her fiance visa and she is coming to NH by middle june. Unfortunately, she was asking me if she can get her work authorization in any other airport besides JFK...but I don't know. We are trying to find out that so she doesn't have to come to NY and then go to NH...I think may be somebody can help me to help my friend. They have been through a lot and I am just trying to make things a little bit easier.

  15. Hi everyone...now that your are talking about jobs :blush: I just got here yesterday and got my work permit at JFK until March 26,I am getting marry on march 23...if u r asking why so late it is because I want to have a nice wedding :luv:

    But...something really amazing happened today,I went to my ex-job(I live in NY for 19 motnhs before) to ask for my ex-position back as a cashier,but guess what...he ask me if I can work as a "supervisor"...I couldnt believe...now I am afraid to let him know that I can only work until march 26...does anyone know if there is something i can do to keep working? I have been reading that I have to quit as soon as the 90 days are over and then file again for another work permit. Is there anything i can do?
