Can anyone tell me what changes I can expect on the USICS online case status website when the interview letter has been generated? Is it just another RFE as for the biometrics or does it say "interview scheduled"?

Your online case status will change to RFE (Request for evidence) when a notice for fingerprinting has been generated. So, you will know for sure that it has been scheduled.

I am probably just being paranoid, but seeing that most of the fellas that submited their case around the same date I did already received their fingeprint letter/appointment... my question is: will they update the case online when they send the letter? or is there a risk that thing can get lost in the mail and I won't know abou it. You cannot abandon the I-130 application! Your K3 is linked to it. Abandoning the I 130 also means abandoning the K3.

The first step for both K3 and CR1 is the I-130. If you want to move to the US faster and wait for CR1 processing while here in the US, then you apply for K3 using the I-129. You must also continue with the CR1 process meanwhile!

So we can decide by the date when the GC was issued.

Get the facts straight! CR1 is already a green card! It is valid for 2 years and needs to be renewed 90 days prior to it's expiry. The next card that you get is also a green card which is valid for 10 years and needs to be renewed 90 days before it expires (but of course you will want to become a citizen before that).

K1 is a non-immigrant visa valid for fiances who come to the US to get married within 90 days of entry. After marriage they can immediately apply for green card which will also be a CR1. It needs renewal after 2 years (90 days prior to expiry). K3 is for couples already married who enter the US as non-immigrants while their immigrant petitions are pending. They get there CR1 when the immigrant visa has been processed and go through the same renewal and citizenship process as the others.

Any permanent resident (IR1 or CR1) who is married to a US citizen and got the green card through the citizen spouse can apply for citizenship at the end of 3 years stay within the US (CR1 will be a IR1 by then!).

Hi. I was wondering if I have to get our marriage registered in the US. I am already married to a US citizen and am living in the US on CR1. We got officially married in a foreign country. Do I have to register the marriage again in the US? Is the foreign marriage certificate valid in the US?

Hi.

It doesn't matter that the addresses on your marriage certificate are local ones. The only thing that you want to make sure is that the names are spelt exactly as they are on the passports. I had the same problem and the consulate didn't have any issues with that. I also used the same marriage certificate for all the other purposes here in the US and still haven't had any issues!

Another piece of advice.............. If your husband is a US citizen, why are you going the K3 route? Why don't you apply straight for CR1 using the I-130? In my experience the K3 and CR1 takes pretty much the same time to get approved. Even if the K3 takes a few weeks less, it is a hassle to again apply for AOS, EAD etc etc. Also, all of these will end up costing you plenty of money, which is a total waste in my opinion. The CR1 is fairly quick and you will not have the trouble of going through all the rest of the procedures.....................just my 2 cents............. Good Luck! Anybody have any idea why the folks in Washington do not want to enact or enforce laws that secure the border? The President seems to think that securing the border is somehow linked to making changes with the immigration system! (I don't believe that the immigration laws presently in force are adequate either. There must be ways to bring down the numbers constructively to relieve the pressure on the system. But that is altogether a different issue)

My 2 cents - The big corporations that pull the strings in Washington would lose out big time on cheap labor if the border is plugged............ and most political bigwigs in Washington stand to lose re-election and campaign funds from these companies if they support anything close to a secure border!

Don't you think granting LPR status based on labor trends (especially when it involves low skilled workers) is a short term measure? Isn't it better to train people with the necessary skills right here in the US? This approach will further neglect what needs to be done at the grassroots level - which is bolster the US education system and give incentives to people ready to take up careers in those fields with severe employee shortages. Importing cheap labor from abroad only puts further stress on the entire system. Also, keep in mind that once these immigrants become citizens they are no more cheap labor! Again reverting back to my old argument - it is not a permanent solution. (As to why the folks in Washington are persistent - Big corporations pull the strings (even purse strings!) - I assume they want to maximize profits in the short term and don’t care what happens to the country in the long term)

Regarding highly skilled workers my belief is that to truly attract the best talent in the world you have to provide them with enough security not only for themselves, but for their entire family. Highly skilled workers command competing salaries in most parts of the world now. The one reason why they have been drawn to the US is because they believed that they could build a good life not only for themselves but for their entire family. Complete repeal of the family based immigration system will only result in turning away brilliant people.

Enforcement of the law (aka securing the borders, strict employee verification and employer penalties) and judicious lowering of immigrant numbers will bring the growth in immigrant population down which the Government seems reluctant to do.

That's exactly my point! You don't attract talent by a system which isolates people from their families. Reagrding the Amnesty plea................ my take is - if the laws had been properly implemented in the first place, we wouldn't have to deal with this problem now! I guess realignment of visa numbers would adequately guard against explosive increase in immigrant numbers. Curtailing privilages for certain citizens may not be a good idea afterall. Point taken...................ET-US2004!

I was wondering if the people intending to migrate on merit basis (based on the new bill) would do so considering that they will have to be seperated from their family for the rest of their lives?

One of the reasons that most brilliant immigrants came to the US was that eventually they could aspire to live close to their family while building a successful career. Family based immigration has been the cornerstone of the values that the American society has been built on. Also, the immigrant's family members get educated and take up work that are intended to be filled up by immigrants on the guest worker or merit based immigration programs. Educating and employing people here in the US and providing them with skills required for the jobs which have no takers rather than bringing in people educated outside the US with little or no connection with family and society would be a better solution over time. Most social scientists would agree that family based communities have far lesser crime rates and are far better economically than communities with members disconnected to each other. Limits on 'chain migration' may be enforced by law either by readjusting the numbers or by working out methods by which beneficiaries of family based immigration are excluded from sponsoring other family members.

Most people (including me) are worried about the rising population in the US and the stress that it puts on the services sector, health care, welfare programs, schools and social benefit programs. A strong border and stringent rules on overstaying visitors may solve the problem of increasing illegal immigrant populations. The laws for the same are already there, but there is no will to enforce these laws. Strict enforcement of the law with severe penalties for employers who employ illegal aliens may also add as a deterent to illegal immigration.

A purely merit based immigration system will provide no incentive to intending immigrants who will eventually think only about going back to their native country. This will be a huge drain to the American economy as money and investments that would be spent here in the US will flow out now. Immigrants will want to invest in a country that they are more closely attached while their presence in the US would only be for the earning potential that it provides, thereby bleeding the economy.

Your spouse will not require another I-864EZ when she goes for the interview in India. You may send her a copy of the I-864EZ which you sent to NVC in case you have made one. She just needs to say that you had already submitted the I-864EZ to the NVC during the interview if they ask for it. Same goes for all the other supporting documents including the W2, employers letter etc.

Yes the I-864EZ takes a little longer to process at the moment because it is a new form and protocols for its processing are just being established at NVC. But it doesn't take too long and you need not worry about it.

Let us know when you are through with the processing of your case at NVC. Which consulate will your spouse be going for the interview to? I am waiting an interview date from Chennai after my case was completed on the 11 of Oct.
