    I am note sure how would i explain to this. But  This is her 3rd entry in US while B2 was obtained back in 2015 and never out of status.

  2. Hi all, 

    I have filed i130(pd march17 2017)for my wife who is on B2 status. I am LPR.

    I see some march 2017 filers getting approval in facebook groups.

    My wife has a booked flight back home before B2 expires in 1 and half month.

    My question will she be able to adjust status if i130 gets approved before her departure?

    will the documens be sent to consulate to her home country for filing immigrant visa or immigration office mentioned in i130/i130A. One more is this done by USCIS or NVC?

    Any suggestions or experiences?

    We got the approval letter today, our priority date was March 7 2017.

     

    I was concerned about the next steps. The letter says "the petition indicates that the husband or wife is in the United States and wishes to apply for adjustment of status".

     

    However, since my spouses F1 Visa expired he had to leave the US in September 2017. 

     

    The letter also says "if the beneficiary decides to apply for an immigrant Visa outside the United States based on this petition once the priority date is current and the Visa is available, the petitioner should file I824 to request to send the petition to the NVC".

     

    Did we do something in our I130 filing. It seems like our case will not move to NVC automatically. What is the earliest we could file from I824?

    Wow Happy for you. Mine PD is March 17,2017. i am not sure should i expect my approval any time soon. its been 3 weeks since your approval. just 10 days difference. Finger crossed.
