    Couple things (I had a similar situation - I am a USC and now-spouse is a Canadian citizen).  We went with IR1 approach and filed the I-130 a few days after doing a court marriage in the U.S. We did not do it in Ontario because it takes like 2 months to get the certified marriage certificate back which would have delayed our filing of the I-130 and starting the IR1 process.  In my county in the U.S., we got the marriage certificate on the spot.  She came here and we did a court marriage (they didn't ask the purpose of her visit).  Then she went back and I filed the I-130.

    OK does she continue to visit you as you are waiting for your interview? The other issue is visiting for another year vs staying in the us and filing.

    What youre saying then is the best thing to do is go get married and just go back to work the next week or whatevr and then file and just deal with the border everytime saying im going to visit my wife?

    1.  With the CR-1 visa, there is no Adjustment of Status..a Green Card is the end result.

    2.  You can not legally come to the US with the intent of getting married and staying.  It is immigration fraud, and it can bring very serious consequences.

    I understand your number 2. so if i do enter get married and go back to canada i have done nothign wrong..

     

    and second how look do you usually have to be in the us with a change in heart or mind to get married, out of the blue so to speak

    I think that is the way to go,.. the lawyer advised us to do a two step process, like getting married and coming back and then filing a ds260 of some sort.. and then another form. if i come back to canada do i need to still do an adjustment of status. also if i get married and just stay what kind of legality am i getting into.

    Buffalo probably has a site for the clerks office with more info.

    If you're able to visit regularly I'd say go CR1, that way adjustment of status is all taken care of when entering.

    My wife and I are now just waiting for our interview in Montreal and then we'll finally be able to just live under one roof.  I can't wait.

    Thats what I am totally afraid of .. I thought if i hold a job here and they know that i am coming back and have no indication of moving there then they would be ok with that. but then again she cant come to canada as often because she has two kids.

    I believe I have posted on here in the past, I am curious what is the best way for my gf and I to get married. She is in Buffalo Ny and I am in Ontario. I visit very frequently as I work in Fort Erie right on the border. I thought about going to get married, and then just coming back to work the next monday. Maybe a take a week off and then come back to work. I do not think it is illegal to go get married and come back it is only illegal to get married and stay if I cross for the intentions of visiting.

     

    If I do decide to stay for a month or so, what would be a good time to go and get married, after how many days.

     

    We want to get this done in about 2 months time

Some city halls/courts require you to schedule an appointment for the ceremony while others operate on a first come first serve basis (my husband and I got married in such a court, we basically just waited for our turn), you'll have to look around and see what suits you best.

    Yeah, just apply for a marriage license (either in person on online) and then wait a full 24h from the moment you get the license until you can have a marriage ceremony. So basically if you pick up your marriage license at noon you can get married the next day anytime after noon. (if you can get an appointment that fast)

    So just do it online simple and easy? and that license is good for 2 months i believe in ny, then i have to call city hall and make an appointment to get married?

  10. I have a few questions, I am looking to get married to my gf who is a US citizen, I am canadian, we only live about 1 hour and a half apart right now. What is the best way to going about getting married in NY State.

     

    I would like to continue to work in canada while my visas are in the process. How do I go over and get married, without it being fraudulent? Im guessing coming back to canada makes it alright?

     

    Also new york state has a 24 hour waiting period so I guess we have to go down apply and then pick up the marriage certificate and then get married?

     

    Please help if you do have any advice
