  1. As long as you guys got married before the 90 days expired you will be alright.

    Good luck,

    Peter Miami

Thanks Peter for your quick response.

Actually the situation is a little bit different. I am from Canada and came down here the last time for a surgery I had to have. Stayed with my wife(gf at the time) to recuperate and ended up staying longer lol ***though always within the 180 days allowed for me to be down there*** AND ended up getting married with her and so here I am.

And just in case someone would say that they could be thinking I was planning to marry her... sorry but would have been really hard to do being that she was still married(seperated but not divorced yet) til way later in my stay.

it is just we did so much for ourselves and went through a lot together already that it would kill me for them to toss me away for something as simple as us having filled a while after the marriage.

    Thanks for ur input!

what are the circumstances of your marriage? Did you have a K1? If you did, were you married before the K1 expired? If you did not have a K1, are you just here as a visitor, hoping to adjust status? If so, this may or may not cause you a problem, if you've started counting overstay time or not.

More information is needed for us to answer you. Your profile and timeline aren't filled in.

Hi Reba thanks for your response, yeah sorry for the little informations my minds running to fast for me to catch up sometimes and I have yet to fill my timeline, my appologies.

Like I answered to Peter, I came here for surgery from canada and didnt need a visa as I can be allowed to stay as "visitor" for 180... stayed with her for recovery and ended up staying longer and married her before 180 days expired. Actually marriage was a saturday and fell exactly on 180 days... so i didnt overstay...

I did everything legally... got my driver licence after my wedding... and now waiting to have the money to fill everything and stuff...

Very true, we waited almost a year before we filed AOS.

The main things to consider are that imigrant will not be able to get their divers license in most states and the medical is only good for one year.

John & Annie, thanks, makes me happy to see I am not alone that has to wait a whlel before filling and hopefully wil get where you are sometime soon.

What do you mean, medical expired in a year? for the k1? well I wasn't a K-1 so I need a full medical thing which of course is more money we dont have... sigh...

  2. Hi,

We still don't have news to know if the loan we applied for was accepted or not... and being behind in bills some right now, there ain't gonna be any money left to fill anything at this point. We got married at the end of May 06 and we are now beginning of October and looks like things wouldn't be fill til later this month or even late november........

Could it cause us trouble with them the fact it tooks a long while to fill???? Or it is not usually an issue with them.... it really worries me but there is nothing I can do about it right now... sigh...

If you guys can let me know what you think, it will be appreciated !

  3. LOL would definitly make her happy !!! LOL and me too actually... although I can find plenty of things to keep myself busy all day long, I wish I had a steady schedule and an income to support my family ! Right now, the financial weight is all on HER shoulder because I can't work and I don't like that. It's a lot of pressure... and plus, I want a job lol...

As for my status, I didn't entered with a K-1 visa. I am from Canada and entered as a visitor. So I need to go through the whole medical examination. I called one dr that can do it. She is located in a city on the way to go visit my wife parents... so that would be perfect supposing we could get an appointment the friday. Then on the way back the following monday we could see her for the follow up on skin test and whatsoever.

So ya, we might have found a solution for the financial part of it... if it works, we will send it everything except the I-693 asap, and I will include a note stating with who, when and where I have an appointment with a civil surgeon and that the form will follow as soon as it is filed with her(the dr.). I guess that is the best I can come up with right this second.

Is it true that some get their green card within a matter of just a few months and others have to wait way longer than that?

    Thanks guys for the inputs:)

  4. thanks for the inputs.

actually the question is more how bad my wife wants ME to work lol since i am the one who is an "alien " lol...

and considering our finances, i would rather work sooner than later lol...

also, do any of you have an idea about the medical examination... i mean if i send everything in but that because of problems getting it done soon, can i send it in right away when i get it done, or i need to wait for a RFE from them to send it in?

  5. Alright, some other questions popping in my head, tried to find out on my own but my mind is like pudding right now... so if some charitable soul feel like helping me out on those ones, it would be appreciated.

We have all the forms ready to be send real soon, except for I-693... its a location problem as there is no designated civil surgeon in our area... and must travel over 2 hours min to see one... and go back 2-3 days later or whatever... so dunno when i will be able to do that, but was wondering...

    - what if I send every other forms right away... Do I have to wait to receive a RFE about the I-693 to send it in or i can send it in as soon as I got it completed...???

    - also, been told by some that it is not always worth it to send the AOS & EAD because of the lenght of time before an interview is short at some processing center... been told to check out the timeline stuff but not sure if i figured it out... im from maryland... from my understanding, i would send my package to chicago... then, how do I know if i should or shouldnt send a EAD with it or not?

im sorry if i sound ignorant to some of you... just all those rules and guidelines and info is giving me headaches...

    thank you

  6. Our situation seems a little similar to yours in the aspect that we got married on May 27th 2006 and we are now in Sept... trust me I am digging for solution to be able to send the whole thing together... still haven't figured it out though... almost 1000$ is a lot and with the money we have in the account right now it wouuld leave us with not even enoguh to pay mortgage or car payment or utility or even grocerie right this moment... sigh.. just don't know... but i just want it to be over with so will have to find a solution.

    thanks for your input.

hope process going well for ya!

  7. Alright, here is the situation. I am from Canada and came here as a tourist visiting my gf and for medical procedure. I ended up staying the whole extend of my number of consecutive days allowed and we got married, so I didn't go back to Canada.

It has been a while I am trying to make sense of the whole procedure thing and so I am seeking for your help. Sorry for the long questions...just want to make sure to do things the right way...

    - Can my spouse(she is the us citizen) file form 1-130 before we send the whole I-485 ? or it absolutly has to be sent together?

    - Can the form I-693(medical) be sent seperatly then I-485, at a later time, or even brought at the interview? or absolutly has to be mailed in at the same time as I-485?

    - Do I need "advance parole" to go see my family while waiting for my aos to be processed? considering I dont have a k-3 visa ? If so, does it has to be sent at the same time as I-485? or it can be later? Does anyone knows how long it takes to get advance parole once the form is sent?

    - Do I have to send a I-765 to be allowed to work while waiting for aos to be approved? if so, can it be sent at a later time or has to be mailed with I-485??? If I have to file that, how long does it take to get my "work permit"?

    - Is there a definite time to wait before getting an interview or it really varies from case to case?

Thank you to anyone who can help me out with those questions, it is greatly appreciated!

    Have a nice day!
