Hi everyone!  So my husband has finally received an interview for beginning of March!  It's exciting!  However, it is listed that we bring completed form I-864 Affidavit of support and supporting documents.  Unless, you have already submitted.  When I applied for him for fiancee visa, I had to fill out an affidavit of support, but I believe the form was a different one.  Would this count?

Good morning all.  Today my husband, from Canada, checked online with USCIS and it said that his application for form I45 was denied and we will get a paper in the mail stating the reasons why and what we can do now.  I am so upset over all this and am anxiously awaiting for the letter to arrive.  Before it arrives, has this happened to anyone and what can we do in the mean time?  If you were denied, what were your main reasons for being denied?  If you don't mind sharing...  Do we have to go to a lawyer now?  I know we need the letter to see exactly why he was denied.  Thanks in advance!

    Yes I agree!  I called on this but  all they could say was that they couldn't say.  I pressed further and the lady told me I could make an appointment to speak with a local officer.  But ironically enough, the website she provided was no longer available.  I did find it on the USCIS webpage, but it said there were no more appointments, check back tomorrow.  They said this was the last RFE and then they would make a decision.  I really hope things don't get screwed up.

  4. They need more information to process my fiances adjustment of status.  I am confused on some of the things they are asking for.  If anyone could please help clarify that would be great.   I can not afford a lawyer and USCIS was no help when I called.

     

            1.  They are saying my income did not meet the 125% of the poverty guideline for my household size.  Assets must equal the stated difference between the petitioners household income and 125% of poverty guidelines.

                               - What does this mean?  I don't understand it.  I am a teacher for profession so I don't make a lot and meet these requirements?  Should I have my Mom be a sponsor (She is retired)?

     

            2. Household size.  They said it was incorrectly filled or not filled.  I live with my Mom currently, but she doesn't support us nor do we support her, so would I include her and it would it be 2?  Do I include my husband the beneficiary as well, so 3?

     

            3. Apparently my birth certificate didn't cut it, the evidence was insufficient.  They want secondary evidence and underlined church or school records "listing my parents names' and my date of birth," in addition to other things such as hospital records of your birth, or other official records indicating a country and record of birth.  Could it be that my copy of the birth certificate was old and I need to send away for a new one?  Where can I go about finding church or school records with my parents names and my date of birth on them?  We have nothing saved like this at home.

     

    Thanks in advance!  We are stressed and confused and according to this letter only have this one shot to prove what they need before they make a decision.

We also debated but ultimately ended up doing it ourselves to save money.   I went to a consultation with an immigration lawyer.  It was going to run me around $1200 or more.  Just follow the instructions and you should be fine.  My husband is now here and we were married in Dec.  We are on the adjustment of status part now.  Which we also debated getting a lawyer for but ultimately decided to go on our own at the current moment.

    You will need to fill in your i485 aos i864 affidavit and i131 if you want a travel doc  also 1765 authorization for work permit all together at once and attach a cheque for 1225.00

    Yes that helps tremendously!  Quick question, would he have an Alien registration number or I-94 number yet?  We are trying to fill out the form for work and it asked that but we were not sure if we had one?  Also, what do you mean for "if you want a travel doc?"  Thanks again!

  7. lHello all.  Two weeks ago my husband and I got married on a K1 fiancee visa.  He is from Canada.  We are looking over the forms needed for AOS and work VISA.  We are so confused with everything regrading the AOS.  It says on the USCIS website: "Most people who apply for a Green Card will need to complete at least two forms—an immigrant petition and a Green Card application."  Then it has a form I-130 petition for Alien relative. 

     

    1. Am I supposed to fill out this form for him (I-130)?  I feel like I already did this when I petitioned for him for the K1 VISA
    2. Next, "Check VISA availability (If Applicable)" I looked at the links they provided for this but it still seemed like Chinese for me.  Will we have to wait until a specific time or date to file for this Category?
    3. I went on the step by step AOS thread here but it was from 2005.  Are all those forms current now?  According to the USCIS it looks like we will only need to file form I-485 and possibly I-130?  And send in Money?

    If he needed anything additional they would of handed him a yellow slip of paper stating what was needed .     Thanks!  It arrived for him in the mail yesterday.  So now he can come here for good :D

So today my fiancee had his interview with the Canadian consulate.  Yay!!  He brought his interview letter, among other things, which stated that he needed to have a copy of my tax return but he didn't have that.  It was not on the packet 3 list and we overlooked it, not thinking it was needed.  But in any case, the officer never asked for it, and he was in there for a total of about 5 min.  Is this good or bad?  The officer did tell him at the end that everything looked good and you should hear back within 1-2 weeks of not sooner.  If you have gone for an interview, how long was your interview?  And did they say that to you at the end that it looked good and you ended up passing?

    I brought my old passports but they never looked at them. Again, I'm sure everyone's experience is different. Since his old one was shredded, he should just be honest with the embassy if they do ask for it. I doubt it would have a huge impact on his visa application :)

     

    Got my passport back with the spanking new visa in 4 working days, 6 days because it went over the weekend.

    Thanks.   Did they let you know there if you were approved?  Or did you have to wait until it arrived to find out?

  11.  quick question for those who have completed a fiancee visa interview.   Did you need your old passport, and how long after did it take to get approved and get your passport back?   My fiancee will go the 3rd of Nov. And they asked in the letter to bring his old passport showing he's visited in the USA.  However, when he renewed to get a new passport, he clicked the box to have the old one shed.   This was way before he knew that he would need it, before we even began this process.

So my fiancee submitted his packet three checklist and all today and has already received an email stating it was approved and he can schedule an interview and schedule a medical exam.  Yay!!  Aside from that, can anyone remember the fee to pay?  He forwarded me the email from them and we are confused on what to pay or if we need to have payment for anything.  The following was sent:

     

    • I-130 immigrant petitions filled in CA: $420
    • IV fee for each family member added to petition: $325
    • For family based applications Employment based: $345
    • SIV cases: $205
    • DV cases: $330
    • K (Fiancee Visas) cash only: $265.

     

    I already paid for the I-129F (fiancee visa).  But I am assuming he would need to pay the $265?  It is for just him, no kids or family members.  Thanks guys.  We are so excited to almost be done with the last step in this process.  Then I guess start the new process.

    For domicile, even a state ID with address is good. Bank statement would be good. We printed out my fiance's proof of auto insurance which had the address on it. Rental agreement or Mortgage is grade A when it comes to domicile obviously.

    Here's the thing though.... and the interview in Montreal, they didn't ask for any of that domicile stuff whatsoever, so it may be a case-by-case.

    A completed and signed DS3025 (should be given to the beneficiary after the medical and is a major source of headaches to obtain later. Birth certificate. (not sure how Canada does it, but for me it was a trip to the county clerks office.

     

    Try to obtain English versions when available (most forms can be obtained in an international version in the unlikely event that the forms are only in French).

     

    Also I would advise to start cleaning out the house. The final day comes a lot faster than you think and clearing your house out 8 hours before your flight is no fun (Trust me on that one :) )

    To create less headache for you, I need to ask you this, does your income alone meet the poverty guideline??

    I'm not sure...  what are the poverty guidelines?  I'm a teacher so I don't make a lot.  Roughly about 37,000 a year.

     

    As for CD, yes cash deposit I think.   Lol. I'm not good with all this banking #######.  It's something my parents got for me as I was growing up.  It's not listed as a checking or savings account but is listed under my accounts online with my bank.   It's labeled CD and then has the total.  I'm guessing it wouldn't hurt to add that in?  Thanks for the help, we greatly appreciate it!

  16. My fiancee received his packet 3, yay!!!!  I am filling out form I-124 to get to him ASAP.  Quick questions: 

     

    1. Where it says dependents information, am I suppose to put my fiancee down?  Or is that just if I already am sponsoring someone/  someone is dependent on me?  
    2. Also real estate information, do I put the house that mom purchased but put in my sisters and I name?  
    3. Last pages for interpreters and prepares, I didn't use any.  Can I just not print that page or do I need to type N/A and print them anyway?  
    4. Statement from an officer of the bank or other financial institutions with deposits, how do I go about getting this?  
    5. Last question, do I just print out a copy of all this and mail it to my fiancee with everything needed?  Or do I also have to submit this form and evidence to USCIS as well?

    Thanks everyone!  I am so excited to almost be done with everything so we can get married!!!

    So my fiancee finally received his packet 3 in the mail :)  Yay!  Quick question, court records and military records, i'm assuming that's only if you have any or were in the military?  It's not something extra you have to send for if it doesn't apply?  And for my evidence of domicile, I can print out a credit card or bank statement that has my address on it?  Is it better to send a few?  Thanks!

    Police check / record check can take a great deal of time. Do this BEFORE you get the Packet 3 (shortly after NOA2 is good). My criminal check, for example, took 7 weeks to complete. I have heard that going to a rural RCMP office yields much faster results for these checks though! Ask around before committing to 4+ weeks for delivery!

     

    Your fiance will be doing their interview in Montreal. I highly recommend AirBnB for travel as it's very affordable, there are plenty of options around the consulate, and it's very difficult to find a flight into Montreal that can accommodate the early appointment times. You'll definitely be staying at least one night ahead of the interview to comfortably make it on time.

     

    I will attach a screenshot of the Packet 4 email checklist. This shows you everything you need to bring to the interview at MTL (minus the DS-160 confirmation page that you also have to bring as well as relationship supporting pictures, documents, etc)

    So my fiancee got his police check only it took a few days in the mail to get to him.  He put it in for it online, there was three levels to choose from.  He took the middle one as the top one said for teachers or something, and he read something about visas for the second option.  It was via the Ottawa police.  Does that sound about right to you?

    4. No, the DS-160 is the actual non-immigrant visa application. You're not applying for a US visa, only your fiancee is. :)
    5. The USC petitioner will fill out the I-134, sign it, and send it (plus supporting documentation) to the beneficiary. A wet signature may be required, so a copy won't cut it. The beneficiary will present the I-134 at the interview.

  20. First, I would like to say thanks to everyone for contributing to the answers on here!  They have helped quite a bit!  I have a few more questions if anyone who has done this remembers...

     

    1) Stupid question probably, but I know they are particular.  lol  If my fiancee's civil document is in both French and then English, does he still need to have it translated, or only if the document is completely in French?  

    2) His birth certificate is mostly English except for the month that says "Juin", the french version.  Would that count or should he have it translated?

    3) It says online as the last step to "Pay the visa application processing fee."  However, I have yet to find this fee in my searches.  Does anyone remember how much it was roughly?

    4) DS160 form:  Do I need to fill one out as well?  Or just my fiancee in Canada?

    5) Signed Affidavit of Support (I-134) with all supporting financial documents:  This would be me filling this out for my Fiancee correct?  And then he will bring the copy I mail to him to the interview?
