If you eventually move back to the US, they will likely put your case under additional scrutiny. You're already pretty far through the process - I'd wait it out. It's going to take you time anyways to apply for a visa to move to Spain. If you withdraw or do nothing, it will eventually show up as a rejected/declined petition.
Thanks for this! We live in Spain currently (just FYI you can just move as the spouse of an EU citizen, no need to apply in advance for a visa - although for Brits this will change with brexit), that aside we have the approved UK spouse visa for my husband already - it seriously took a month, huge contrast!! Anyway, there were reasons other than timing that mean we’d rather move there than the US - i’m really just looking for the best way to deal with my application now.
Extra scrutiny is ok, I guess we’ll just allow an even longer time frame if we ever decide to move there. Any idea on how this would affect traveling to the US for holiday? Will I need to apply for a new esta and state a visa denial?

We submitted an i130 about 6 months ago but didn’t anticipate the process taking taking so long and have decided to move to the UK instead. What happens now.. should I withdraw the application and will that have any consequences in the future if we decide to apply again? Or what would happen if we just did nothing after the first part is approved? Would it just sit there at the NVC stage indefinitely or would the application end up showing as denied? Thanks!

I just discovered this week that we will need police clearance certificates for the visa interview... so I thought i'd get a jump start and apply now but will they still be valid?
So, for example, we lived in Germany for 2 years (but don't live there now). If i get the certificate this month, for how long will be valid? We only submitted the i130 in June.
Thanks!

Hi there and welcome. There isn't any rhyme or reason as to why the applications go where they go.
The dates on the processing time site is where they were the last time they posted (for example they posted Nov 15 a few days ago but that was as of the end of May). If you look at timelines here, people in Sept/Oct are still getting approved as are people in late November. It ranges all over the place but mostly within about 15-30 days either direction of the posted date so far.
As for January, a standard I-130 application is taking 7-8 months to approve at the USCIS and then there is still NVC and embassy interview. If you're doing a standard application, best bet is probably May-June of next year. We are all hoping they move some workload around or things speed up after November/December (They had a huge influx due to price changes and Trump's presidency), but who knows.
Sorry for all the bad news but welcome to the island of misfit toys!
Yeah, unfortunately that was the bit we missed! I thought we just needed the i130 approved (and i'd read online that it took 5 months) - didn't know about all the other bits!! Sort of wish we'd stayed in the US after we got married now. Oh well.
Fingers crossed for the speed up...! I think it's a standard application, what do you mean by that? Thanks so much for your response!

Hi! New here - i130 received on June 23rd, we got receipt number and know it was sent to Nebraska service centre from an email we got from someone working at the lockbox (not gotten anything in the mail). Wondering what the logic is behind where they send the applications since we're abroad - sounds like we were unlucky with ours!
Do they work strictly from the dates on the processing time website in receipt order or do people ever get processed quicker, and if so for what reason?
We had no clue it was going to take so long, had planned to move to the US in early Jan next year but now looking like we may be stuck here a little longer!

Oh that’s brilliant you have a full year, should give us plenty of time to decide whether or not to stay in the UK - thank you! Any idea if I can travel easily to the US in that time? I’m a stay at home mum so I won’t have a job to prove I’m planning to leave again (although my husband, he’s the US citizen, will).
