  1. Hello everyone, :star:

I know some of you will start judging me right away but pls don't, i'm in need of help right now so i don't really want ppl telling me that i haven't made the wisest decisions in the past. I already know that and I would really appreciate it if I can get some answers

I came to the US approx. 6 years ago, i entered the country as a tourist and decided to overstay (i got 6 months to stay).

I don't want to type a huuuuge thing so i'm just going to say i went through a lot of stuff and decided to start working ilegally (using fake documents). <-- I know that was very stupid.

A few years ago i met my husband (we just got married last month) and now we're trying to adjust my status so i can become a resident.

I'm not currently working (i quit last year when my husband (back then boyfriend) and i decided to move in together and i had to move far away from where i was working at that moment).

Back when i was working, Even though I was doing it ilegally, I always did my taxes, every single year (I got an ITIN number form the IRS).

My husband and I are currently working on the whole package to send to immigration and I don't know what to do regarding the question about employment history on form G-325A.

I don't want to lie but I'm scared. And sadly we can't afford an immigration lawyer since their rates are extremely high; we decided to take care of the whole thing by ourselves and luckily i found this great site.

I asked a person that works with immigration lawyers (she's like an assistant or secretary) and she told me I shouldn't tell them I've been working ilegally because they could deport me and that it doesn't matter that I'm the wife of an US citizen.

She claims that's what the lawyers she works for always tell their clients.

I told her that i don't want to lie, what if they find out (they could check with the IRS and see I've been doing my taxes, right?) and I'm not able to adjust my status?

Basically I'd like to know if any of you have gone through this and what did you guys do? What's going to happen when i send my G-325A with my ilegal employment history? Should i also send my taxes transcripts? How do i attach them? or should i wait and see if they ask me to take them to the interview?

I'm really lost because I don't know if I should lie about working ilegally or just give them my employment history and expect to be forgiven for being the wife of a US citizen.

    Any pointers?

Thank you all for reading and for trying to help me!! I really appreciate it.

Almost forgot. It's always good to have a lawyer help you out. I did and it was worth the money...The IO was so impressed with the application package my lawyer put together, he did not ask for any other evidence including originals at the interview. Try and get a lawyer and do your research before you hire one if you decide to go that route. I only used the lawyer for the application (135 pages) and the lawyer told me that I didn't need to waste more money to have him attend the interview because he was very confident about the case..

Whatever you do..DO NOT LIE about working...They will find out...Most overstays be it B1 or F1 who work illegally and who marry a USC are forgiven. I know of many cases where it was forgiven. You also don't need to volunteer the fact the you used fake docs to get a job. The immigration people already know this already. Just state all the places you have worked since you got here. The most important thing is you entered the US legally on a B1 with inspection.. If you entered without inspection then you will most likely be in big trouble.....Don't worry just file joint I-130/485, I-864, I-765 and provide lots of evidence of a relationship with your husband and lots of evidence of joint assets...

    Good luck!

  3. Timeline: Atlanta, GA.

Married my sweetheart in 2002 outside of USA

July 2003 I entered USA as LPR. Wife could not follow to join.

March 2004 Filed I-130 for wife

Aug 2005 Wife enters as F1 student for Masters - Ivy league school cost me a fortune

July 2007 I-130 for wife approved but visa number far from being current

    Aug 2007 wife graduates

Aug 2007 - wife OPT granted for a year

July 2008 - File N400 for my Citizenship

Aug 2008 - wife OPT expires cannot find employer to commit as H1 sponsor - Lawyer advises her to stay in country

Nov 2008- Citizenship granted and visa number becomes current. Decide to file AOS for wife as a citizen

Dec 2008 - Lawyer files I-485/I-765 - sent to NBC.....Wait begins.. wife still with 180days of being out of status.

    Jan 2009 - Biometrics done

April 2009- I-765 approved - EAD arrives in the mail

April 2009 Interview letter arrives in the mail for May 13th

May 13th - Interview - took 10 minutes, IO asked for no evidence or questions about our marriage, basic questions based on I-485 i.e name, address all those yes/no questions. IO approved case and stated it was a pleasure to meet my wife and I.

May 14th 2009 - Cris email card production ordered.

SLEPT LIKE A BABY LAST NIGHT....LONG JOURNEY OVER!!!!!!!!!!!

PS. Our lawyer sent a comprehensive package that was about 130 pages long with all the evidence they would need. i.e joint taxes, joint bank accounts, joint amex accounts, joint car, house, life, medical insurance, joint house ownership, lots of photos tec... I think this is why IO did not ask us any questions about our relationship.

  4. Hi ATL, is there any way I could trouble you for an Atlanta Field Office review? They seem to be a bit hard to come by and my wife and I are October filers, which means we hope to have an interview in February or March. That's great that you had the interview and oath the same day. Is that normal at Atlanta? By the way, I should have said, CONGRATULATIONS!!!

I went to the interview today and passed. My appointment time was 12.25 PM today and I went to USCIS at 12.00 PM. The IO called me for interview at 12.20PM and the interview was over by 12.30PM.

Looked at my green card, driver's license (for ID proof). Did not ask for my passport.

Usual questions , asked how long I was out of the country in the past 5 years (total 30 days)

If I had any children, when was I married , paid TAXES , basically you have to answer every question in the application VERBALLY under OATH.

History and civics where easy only 7 random questions.

After answering all questions, he took my signatures and gave me N-652 (Naturalization Interview Results) form and he checked "You passed the tests of English and U.S history and government". He also checked "A) Congratulations! your application has been recommended for approval". He the told me he'll put me in for the 2pm oath ceremony. (Atlanta usually has Oath the same day but it may not be the case for everybody. I think it depends to the day, time you interview.

    Hope this helps

  8. Honesty is definately the best policy. As regards the interview, I think you'll be just fine. If they ask for your SS card just explain everything thats happened. If they also take away your EAD card and stamp your passport, thats okay too because it should say authorized to work on the stamp. I got my first job with my stamped passport as evidence before my green card arrived. On the job issue, if you know your SS number you should still be fine because that should not change on your new card and with the stamp on the passport you can still work because it will have an A# (Alien Number) which is all the proof you need for work authorization.

Good luck on your AOS interview!

  9. Hi,

You shouldn't have been in such a hurry to change your social to your married name. It really was not a bid deal at the stage you are at. The wait should be about 2-3 weeks before your verification of status happens. I suggest after 2 weeks you check back at the SS office. With your old social and EAD card you would have still been able to work... Infact if you waited for about 1-2 months before going you'd have got in a few days.

I got my EAD card yesterday, and went to Social Security office this morning to have my name changed to my married name. Well, they entered my new information from EAD card into their system, but said that their records are still not updated by the USCIS and that I have to wait. They didn't know for how long.

They kept my old Social Security Card, so even if I get a job offer, I am guessing that I would have to show them SS card.

After I came home, I called USCIS information line to ask how long it will take for this update. They said they didn't know, and there is nothing to do but wait. Wait? I waited for soooo long already to get EAD.

So I now have EAD card, but not Social Security card. This is so frustrating!! I could scream! I am allowed to work, but who will employ me without SS card?

Anyone has any advice on what to do? Thanks

  10. Hi,

I became a LPR in 2003 got married out of country and filed an I-130 for my wife in march 2004. Since then I've been waiting until today when i just received an email saying the case has been moved from the Texas service center to the California center. What does this mean? It is this a good sign that the process will move faster? Does any one have a similar experience?

My wife is now in the US on a student visa doing her Masters and I'm hoping her case will be done before she finishes.

I also looked at the CSC processing dates and I-130 for LPR show dates of Jan 2005? I'm a bit confused?

Could anyone on the forum shed some light on this situation!
