Hello everyone! I am an American citizen and my husband is a Chinese immigrant holding a CR-1 greencard that expires near the end of 2018. We have a 1 year old daughter and are very much in love.
I recently found out I was pregnant. We are happy, but financial issues and the cost-of-living in our area has made it seem like a good idea for ME to return to China and living with my in-laws, while HE stays here in Virginia for work. This arrangement would probably last for 1.5 years. After this time he will qualify for a pay increase and I'll be able to continue working.
I am worried about how this will affect us filing jointly to remove conditions on his greencard (form I-751). We will live apart but love eachother immensely, are looking forward to having 2 children, and have valid reasons to live apart. Can a committed couple successfully remove conditions while living apart? Thanks!
