Does anyone know if a member stops paying dues, does their membership automatically lapse? I have been reading all sorts of things regarding how to approach this if the question comes up during the interview.
Some people say once a member, always a member, unless you request to be withdrawn. Others say the CCP automatically boots you after 6 months lapse in membership dues.
If someone has not paid dues for over 1 year and the CO asks if they are a member of the CCP, can they legitimately answer, "No."
I know if the CO asks a follow up or if there is paperwork, that states, "Were you ever a member of the CCP," then you have to say yes to that one.
The overcome on this particular issue is troubling. If your SO is forced to deal with an overcome they have to find someone in China to not only translate a list of reasons, but also have it notarized. You need to get statements from your employer and get them translated.
I just want to make sure we are 100% honest, but if they ask a yes or no and saying 'No,' is honest, then it seems like the right way to go.
Also, I'm thinking coming prepared with the documents, translations, and notarized overcome documents may also be smart, just in case the have you ever been a member question comes up.
Any advice and tips for this issue?
"Have you ever been...?" is one of the questions. So, be prepared to deal with the answer.
Absolutely!!!! Take the kitchen sink! You will need it at some point if the question comes up.

I am in the same boat. NOA1 received July 26,2007 and no NOA2 as of yet. My Congressman did get a reply from the USCIS but it was the usual boilerplate language saying that background checks are still going on and it could take several years.

If you are using webcams when you chat then you take screen shots. Having photos of the two of you while you chat is good evidence that it is indeed you two that are chatting.

You got a form letter response telling you they don't answer inquiries directly and telling you how to make an inquiry. I explained to you in another thread just how little "honoring a date" means. Basically it means nothing. If you are asking how long it will take to adjudicate your case, the only answer you're going to get will amount to "Nobody knows. It will take as long as it takes." There are no gaurantees except you can't get them to actually answer any official inquiry until after they've had the case six months. If they have it that long, there's a problem.
I can certainly attest to that.

Actually since Sept. 2006 if you file both I-130 AND I-129 (K3) the USCIS never forwards your I-130 to NVC.
The statement from USCIS was something like they wanted to save manpower, and processing both was a waste because the K3 nearly always finished first.
So, if you go K3, you have NO chance of getting the I-130 processed.
Unless the K3 is denied.

I think it's taking 'so long' because of the sheer number of applications in July. I doubt fees have anything to do with it.
Okay.Then why are people who submitted their paperwork after mine are approved already ? They claim they do the petitions in order,right ?
You can look at my time line and you will see no touches at all after the NOA1. They do not process then in the order they were received.

When the petition is sent to GZ then you will get a letter in the mail stating so. One month is not a cause for alarm at this point.

Most recent update: I got my approval notice in my email an hour ago. WE ARE APPROVED! I am so very happy I couldn't contain myself. I feel like my heart is going to burst.

Make no mistake. The USCIS does NOT process the applications in the order they were received!

Typical USCIS screwups. On my previous K1 petition I received emails from CRIS over a year after my case was finished.

You can also write to your congressman as I am doing.

The USCIS moves at their own pace. There is absolutely nothing anyone can do to make them move any faster. Try to relax and good luck

i have a friend who's parents are in california and filed there daughter's visa way back in 2006 and yet there is no results on USCIS... any suggestions for my friend?
The parents need to contact their congressman and senators. They can help find the petition.

Case completed at NVC 17-Dec-07. Awaiting interview date or further instructions.
I would recommend that you do not wait to receive instructions in the post, once the automated system says that an instruction has been generated, you can put together all its requirements and send it to NVC. The only exception to this rule is the IV Bill.
Read up on Jame's Shortcut V2.0 aka JSC V2.0. Hope this helps.

The IV Bill is the immigration visa fee which is required from petitioner/beneficiary. You can not make this payment without the NVC generated invoice.

You have a lot of patience Sunshine. Actually I have drawn a "line in the sand" for January 15th. If I don't hear anything by then I will start to make plans to move to China. I actually started this process in April of 2005. I guess I have waited long enough for the gvt. to decide that my wife and I can be together. So this is my version of BEING POSITIVE!! My wife and I have waited long enough. I have to take control of my life away from our gvt.
Sorry for the rant but it's been a long wait.
Actually, I really am trying really hard not to succumb to the temptation to lash out, cry, and do something stupid. My husband and I are not really patient people but we're here and we're trying. If you notice from my timeline, we didn't file the petition until after 1 year of being married. Our initial plan was to find alternative living arrangements - a neutral country where we can both find work and start our married life - but that plan didn't pan out. His frequent trips to the Philippines has become very expensive and detrimental to his career so we thought, you know, we have reached the dead end and will need to file for the visa. A few months into this and the gathering of the documents alone, drove us nuts to the point of us always fighting and so we thought, we need a "shock absorber" - we hired a lawyer.
Now whenever we need to vent, fire up at something (someone), then there's the lawyer - at least me and my husband don't fight about this "great" visa process anymore out of frustration (sexual and everything else).
There's always that thought in our heads that maybe he can just move to the Philippines, unfortunately, his profession will not allow him to move here and get the same pay here as he is getting there. It's just not an option for us. It's financial ruin.
I feel for you. And I just have to say, that you're very lucky that you have the option to move out of the US and join your wife. I have to agree that that in itself is BEING POSITIVE. I wish my husband and I can also do the same. For now, all we can really do is try not to count the months that we haven't been together and instead count the months lesser that we will be apart - that way, it's easier to bear.

I can see that you 2 have know each other for a long time. How well I know this adds to the difficulty of waiting. Indeed count the lesser months that you will be apart!!!

The fact is that you need either a SSN or a ITIN for the foreign spouse. I know I did this last year and will do it again this year. It is the law according to the IRS. Yes Sunshine you two can file married jointly no problem as long as you have an ITIN which is obtainable with the form W7.

I just wanted to say thank you for this list. This lets me know that I am not alone. I thought the USCIS was supposed to process them in the order received but I can clearly see that is not the case. I am hopeing for good news for yourself and all that have been waiting so long.

I gave myself until January 31st to be "patiently waiting", after that I will allow myself to go berserk!
