Multiple filer waiver covers the petitioner not the beneficiary. I don't think. If she has an active I-129F, then her former petitioner has to withdraw that. Not very sure if withdrawal by petitioner is still required if the visa was already approved at the embassy level. Let's wait for others to respond to you :)

I was the original petitioner for my ex, this will be my 2nd I-129f filed, the first was March 2013 but approved in Aug 2015

You might wanna specify which waiver you're looking to file so the rest can give you an appropriate answer.

Multiple filer because her visa was approved close to 2 years ago and dont want a RFE so taking no chances

  3. If my previous marriage to a k1 holder has ended, we are divorced, she is back in the Philippines since mid January, and hers was the only application I had ever done, would I have to file a waiver to file the next i-129f? Because would the 2nd application count as 2 in the 2 or more? Her Visa was issued in Aug 2015 so I am about to reach 2 years on that.

This first application was sent on Feb 2013, is this the date or the date her Visa was approved that needs 2 years or more from?

  4. Hi Everyone,

After the end of my last marriage I have moved on. Many here helped me through the entire process before, and I look forward to this new journey with my love. I look forward to the continued support and hope to be able to help as well.

    James
