This is not correct. One qualifies based on "current income" which only comes from a tax return if the sponsor is self employed. Information from tax returns is about the past.
If this petitioner takes a job with JP Morgan Chase (paying say $50,000) BEFORE filing the I-864, then the current income would be $50,000 regardless of any past tax return information. On the other hand, if the I-864 is filed while the sponsor is unemployed with no income, they DO NOT QUALIFY, even if they earned $50,000 already this year and $100,000 last year.
All that said, the public charge decision is a judgment call. NOT qualifying assures failure but simply meeting the minimum requirement guarantees nothing.
So if my current income is not salaried but hourly will it count. Say I make $1000 per week but it is hourly, and only have a few weeks at the job?

It would be helpful if you give a bit more i formation about what visa, if you are the USC, LPR, petitioner, beneficiary etc... i am a bit confused as you talk about studying in France.
The petitioner must meet the income requirements for the year in which you are submitting the I864 income must be from a consistent secure employment or self employment. It is not essential to have met the requirements in previous years, evidence of having filed tax returns is necessary. Only income in US is counted, unless overseas earned income source will continue when you are in the US. If your current income is stable, secure ongoing and meets the requirements you should not need a joint sponsor.
That being said, lining up a joint sponsor, just in case, will not be wasted and can save you time if you get an RFE for this reason.
Thank you very much for the information. I am the petitioner apply for my wife in Mexico. I did a i-130 form. One question. So the next step, NOA2 I believe says they will mail the forms to my wife in Mexico, does that mean i should mail my i-184 and joint sponsors to here now or do i mail them separately. I want to save as much time as possible.

Hello,
My total income for the last 3 years were
2015-$20,831
2016-$34,625
2017-$22,844 ($10,192 FROM Unemployment)
Thus is just barely pass the poverty threshold in 2 of the 3 years. Still, in 2017 I returned to school to finish my bachelors degree in Finance. I only worked about 4 months of of the year to focus on school. I graduate this May. Currently I am making around $1,000 per week while attending school. Once I graduate I will work for JP Morgan and have a more stable job and overall job security.
Should, I get a joint sponsor just in case?

Hello,
A few questions upon service centers. I am a citizen in NJ, and applied for I-130 for my spouse in Mexico. My packet was accepted September 28,2017 and sent to the Texas Service center.
I was wondering why it was sent there instead of say Vermont?
I see the processing time are ridiculous long in Texas!! I am a bit worried.
When should I hear back?
I get married through the church July 14, 2018 and thus wished to have her visa by then if possible.. is that reasonable ? It is 9.5 months from when they accepted it
thanks
Adrian

Thank you very much. OK this is truthfully the last question. I am not 100% sure about form I-130, part 4 62a-62c.
The beneficiary will not apply for adjustment of status in the United States, but he or she will apply for an immigrant visa abroad at the U.S. Embassy or U.S. Consulate in:
Do i just choose the closest U.S. consulate to her? She lives right outside of Guadalajara Mexico.

Not at all.
Thank you very much, I will not send them. I have one last question. Am i allowed to be a translator for my wife on the I-130A FORM?

I'm sorry but this is no longer correct. If the foreign spouse lives abroad, passport photos are not required for the foreigner and neither is a signature on the I-130a.
The foreign spouse will need the correct size passport photos for the NVC, medical and interview stages.
Thank you so much. Yes I was getting conflicting information online. So should I just not even send the 1x2 photos at all?

What step are you on? The I-130?
US-style passport photos are needed of the foreign spouse for the I-130. Being abroad doesn't change this.
yes I am on the I-130. Well what should I do? I don't think i can get these resized

Hello My wife lives in Mexico. She gave me passport photos that are 1x2, which do not meet specifications. But i have read that I don't even need photos of her since she lives in another country. Is this true?
thanks
