Does it have your parents date of marriage in your BC?I guess there is something needed for you to do. I'm just kind of confused, We might need other member's advice this time.

Yes, but they are not married. My parents put fake date of marriage on my BC because they just want to. I am not worried about it though. She can get CENOMAR to prove she is not married at all. My Mom talked to an attorney about it and he said they can put annotation on it that the marriage is not true but I have to pay 40 grand pesos! My mother didn't use my father's last name at all but I used my father's last name and it also on my BC.

You can actually have your mom file for a petition to correct the clerical error in your BC while waiting for the updates from USCIS. I am not sure how long it would take. Btw, have you also sent a copy of your parent's MC and your MC( if you're married, and changed your name)?

What was the affidavit about? Does it say something about the error on your BC? USCIS will most likely notice the name difference on your BC and your mom's and will probably RFE you to provide a documentation that Marlin and Marlina are of the same person. Since your mom never used the name Marlin(stated in your BC), the only way I think to do is you will need to have your BC corrected. Your mom can file a petition to correct the clerical error of your BC that way you will be able to provide USCIS with the "Certificate of Finality" from NSO and this is the official document they will need.

The Affidavit I submitted is Affidavit of Same Identity. Because she had a passport and worked abroad using Marlina Garcia Amor. When she came back in the Philipplines and renewed her passport she found out she don't have a BC, it was year 2003 when she filed for Late Registration of BC and she also found out that her "real" middle name is Santos not Garcia. Now, she have her current passport name Marlina Santos Amor. That is why I sent an Affidavit of Same Identity along with the copies of her previous passport and current passport.

My mother is not married (legally) although in my BC she is married with my bioglogical father. The reason that I have not notice my mother's name was mispelled because her signature is below her name and she signed her full name and last name. My information in my BC is not on the right boxes (misaligned) and I was born on 1980's but my NSO Birth Certificate is like photocopied from the (original) City Registry Hall record. If you are going to see my BC in personal you have to read the info's one by one.

I'm thinking about that my mom to file a petition to correct the clerical error while waiting for the updates but she told me to wait what the USCIS will say about it.

It depends on how much is the declared amount of the package. Also, it depends on who is the (fedex crew) holding the package. Some charge fees and some don't.

I just sent the application to petition my mom this week and after I sent it I checked the 2nd copies I have and original of course and I notice that my mother's first name was mispelled. Her name is Marlina but on my BC it spelled Marlin. I never notice the clerical error on my BC until after I sent this I-130 package. She is using Marlina in all her documents. One thing, she has been out of Philippines for 15 years using (first name)Marlina (middle name)Garcia (last name)Amor. When she came home for good and renewed her passport she found out she doesn't have BC, on year 2003 she filed for Late Registered BC and now she is using (first name) Marlina (middle name) Santos (last name) Amor.

I had the same issue when I filled my petition for my parents. Mine and my father's last name in my NSO bc was mispelled due to clerical error. And I got an RFE coz of that.
They asked for a proof( photo I.D) that both last names are same person. Since I never used the mispelled last name on my BC, I sent the "Certificate of Finality" from NSO that was

issued when my dad filed a petition to correct the clerical errors in 2005. Note: USCIS doesn't accept AFFIDAVITS, they will need an Official document as a proof. But if your mom uses the name Sharley, she may need to provide a current photo Identification of hers(I.E: passport) Showing that Shirley and Sharley are the same person. You can send the proof with the I-130 packet. And as for the list of documents, the above information you mentioned are correct. You will also need to submit a copy of your mom's NSO BC, your parent's NSO Marriage Certficate and your Marriage Certificate if you are married to show your change of name. HTH!

I have submitted my Mother's Late Registered BC, Affidavits and passport copies of Marlina Garcia Amor and Marlina Santos Amor on my I-130 package. Since you mention that USCIS doesn't accept Affidavits. I kind of discourage because of this clerical error and affidavits. Oh well, what I can do for now is wait for RFE. I guess I have to correct the clerical error on my BC but I will wait until I receive a letter from USCIS.

Hey guys, my Mom had her interview yesterday and sadly she got denied again! These are the questions she was asked :

Are you a single Mom ? Yes

How many children you have? Three

How many children you have staying/living here in the Philippines? Two

How many grandchildren you have here in the Philippines? Three

Why you want to visit the USA? Spend time with my daugther, meet my son-in-law, meet my grand-daugther and witness the birth of my grandson.

How long you plan to stay? Two weeks

Is your daugther work? No, she is a SAHM.

Is she a US Citizen now? Not yet.

Is your daugther planning to petition you when she become a US Citizen? Yes

Who is going to pay for you plane when you come to the USA? My daugther.

After these questions and answer portion the IO finally said; " I'm sorry Ma'am we can't give you a visa right now and since your daugther is planning to petition you, we encourage you to wait for that. " and she handed her the blue form which is 214(b).

Congrats to both of you guys! I am pregnant too! Due on July and this is my second pregnancy. I am also planning to let my Mom visit for the delivery of our baby and spend some time with us and meet my husband. I arranged my Mom's application and interview date for her tourist application and she will have her interview next week! I am praying she will be granted for a tourist visa. This is her second tourist application though, the first one got denied because of the length of stay we planned last year (2months stay). We just being honest since that was our plan that time. Although I had some friends told me when the IO ask my Mom about the length of stay, she should answer only 2 weeks or 3 weeks. I don't know if it's the main reason why she got denied but my Mom told me that after the IO asked that question his mood changed and he said 2 months is quite too long and sorry we can't give you a visa right now. ( That was June 2011 )

I'll let you know guys next week how her tourist interview goes. Have a safe and healthy pregnancy!!!

Todd & Veronica,

That's what we heard too when we were planning about " petition ". We would like to tried that time the K-1 but our relationship was only 2 months. I heard that we should have atleast 2 years relationship and we don't want to wait that long. So my husband hired a lawyer because he don't know the immigration thing. He lived in NC but he hired an immigration lawyer in CA. The lawyer advised us to get married and file a K-3 since our relationship is kinda you know whirlwind romance. We met last week of Nov. 2005 in an online dating site and we got married April 2006.

About the Interview in HK Consulate. I had fun, honestly! It was great! The staff and Immigration Officer are polite and friendly. I was there for almost two hours but I was interviewed for only ten minutes or less. There are two persons interviewed me, the first was a Chinese woman and she asked me if I brought the reqirements and I gave all what I brought for the interview: pictures, emails messages and chat messages that I printed out, phone bill statements, money remittance receipts, my husband's air ticket when he came in HK, NSO Birth Certificates, HK-Marriage Cert., CENOMAR, NBI clearance, HK-Police Clearance Receipt, and what's on the document checklist.

Here are the questions that I remember they asked me:

What is your husband's name?

When is his birthday?

Where is your husband live?

When you and your husband's met?

How you and your husband's met?

When did you and your husband get married?

The Chinese woman also asked me about some of the pictures, I think she is a bit fascinated of our pictures because I heard her talking about it when I was waiting to be call. She thought maybe I don't know cantonese language but I knew a little bit cause my employer don't speak in english so I have to speak in cantonese. I put all our pictures on a hardbound photo album and it was kinda hard to insert in the window counter but I and the Chinese woman managed to slide it in. We were laughing because we thought the photo album will get stuck in there.

My suggestion is use a softbound photo album.

Anyways, the second person was the American IO, she interviewed me for i think 5 minutes and asked same question then I swore in and she congratulated me and exclaimed (in a lower voice) Welcome to America!

Then the Chinese woman told me to go on the ground floor and go to the courier window and pay the shipping fee to send back my passport with visa on it.

This is one of my happiest day and I Thanked God that everything was smooth and fast on our immigration K-3 journey.

Hello Todd & Veronica,

I have a friend that same as you guys situation. They dated for almost two years and visited his fiancee twice before applying K-1. Since you are planning to visit her again and give a ring, I think everything is gonna be fine to petition her (K-1).

I processed my K-3 visa in HK Consulate. I also worked there as domestic helper. My husband and I met on Christianmingle.com and had documented 5 months relationship through emails, phone calls,.etc. He came to HK for a 9 days vacation and after 3 days we got married. My K-3 petition took 4 months,actually it should be sooner if we are not busy on our jobs.

I will be praying for you guys!

If someone had stayed in Austrailia for 4 yrs is the Police Clearance required? Even though that's way back in the 1990's.

I didnt stayed or lived in Australia but yes you will need to get police clearance even its been a long years.It's one of the requirements.

Is she from Thailand? she need to report in thailand embassy that her passport was lost. so she can get a new passport. i guess she can get a SSN and state id. but maybe the first things she should do is to report lost passport and get a new passport.
