I was wondering if i should go about using a K-1 for my girlfriend but she is still living in the U.S... Would she have to leave or could i still go about with a K-1 while she is still here

If someone can please help or give advice???? I am a U.S citizen and i have been dating this girl whose student visa expired. I was tryin to find out the best way of getting her legalized. I dont want to send her back and she doesnt want to go back. She has family here, but not her parents. If worst comes to worst, i would go back with her to her country but when we get married how will i get her to come back to the states. Would it be better to get married her or overseas??? Any advice is welcomed. Thanx
