Chances are they might ask at the interview whether the income situation stated on the I-864 is current, it might very well not be mentioned though and could not be an issue either. I'd have some co-sponsor papers lined up if I were you... just in case they ask about what you're doing for living etc. because if they find out about you not having a jo, they'll definitely want to see a co-sponsor.

thank you so much for your reply. Ive asked my sister and her husband to be our sponsors. they were our sponsors for our k1 visa and they didnt have a problem with it. have you had your interview?

  2. aaaah we finally for our interview date and im excited but i am also a little nervous.

I (petitioner) lost my job on 11/3 and have been receiving disability checks ( i  had an injury at work and they laid me off). My husband got a job in november he's getting paid cash. Does this affect our eligibility for green card for him? I was the sponsor, all the income came from me before he got this job and we got our application approved based on my income documents so now that i dont have a job im nervous that they will deny him. Help..anyone have this same experience?

Just called USCIS to speak to a Tier 2 officer because my case has been pending for longer than 180 days. Unfortunately that wasn't of much help. All she was able to tell me is that my case is still at the MSC, not even that it's in line for an interview waiver or anything. She said besides the day they received my biometrics they don't have any other updates for me.

She did submit a service request on my behalf as well as a second service request to see if my case can be sent to Albany instead of NYC in case I need an interview. She said it's unlikely but she at least tried to get some info for me which is something I guess. I have to say I'm a little disappointed, I was hoping for some more information but unfortunately my call didn't do much besides submit the service requests.

aw  man so sorry she wasnt much help. I hope you hear something soon! good luck !

Not true at all. You can use it for any reason, as long as it's somewhat reasonable like going to visit family, going on a vacation / honeymoon etc. Though I wouldn't suggest visiting "black list" country, but Mexico definitely isn't one of them.

Even that doesn't have to be true. Yeah you may get asked a few more questions than the regular green card holder, but it's more of a formality rather than something tough you have to go through.

As for the interview wait time: 5-6 months for an interview waiver is fast. LA is one of the faster offices, but that still doesn't mean that you'll get done super quickly. You've just recently passed the 4 month mark I see, you still have a bit to go before any calls will be answered with anything else but "Your case is within normal processing times.". The earliest is 6 months after your received date, that's when you can put in a service request and even then most of the time it gets answered with the usual "Your case is within normal processing times." or "There has been unexpected delays with processing applications..." and so on.

Thanks so much !!! i was waiting for the interview letter before buying cruise tickets but i see even if i get the letter now the interview wont be until after the scheduled trip (9/10) thanks again and good luck!

I traveled on AP twice (Germany and Mexico) I had no problems . They'll send you to second review but it was smooth both times I traveled. Just make sure you take all your documents with you like marriage certificate etc in case they ask for it.

this is awesome news - thank you!

No I haven't called.  I figured it's not been 4 months yet for me.  I hear the wait time for interview waiver is like 5-6 months.  I'm ok with it since I have my work permit, but ultimately, when it approaches 5 months...I may call at that time.

Oh wow that long.. my concern was that we want to go on a family cruise to  mexico but i was under the impression that the advanced parole was only for emergencies. Have you traveled while on AP?

I'm also from LA.  I filed my AOS on March 13th, but they didn't cash my check until a month later...then I got a RFE which resets everything so my official date is April 28 2017 when they received my RFE.  I did receive my EAD and AP already.  So for me, it's been 108 days waiting for either an interview or an interview waiver.

    Hi,

we also received the ead combo card (7/25) but im wondering how long to wait for the interview before calling about it. I feel like the interview should have already been scheduled its been over 130 days for us. Have you called? good luck ! best wishes :) we are in san fernando area also btw

Hey everyone! Congrats to all of those who've gotten their GCs and EAD approvals!

Just wondering if anyone is in the same boat as me...

    - 114 days since filing (March 27)
    - Our marriage interview has been scheduled for August 10

But we still haven't heard anything about the EAD :(

    How's everyone else doing?

Im on 112 days since filing and nothing yet not even an interview date. Congrats on getting that!

@Kalciaa i get your point, but can you understand mine? i searched everywhere on the USCIS websites (that i could find) and I could not find it written anywhere about the reset but the two things that make it confusing again is the fact that people actually have reported getting these notices like the one above and they don't match the actual wordings on the website and also an RFIE would mean they found something missing from the initially required documentation, right? so basically, if they stop the clock then itself, that kind of means that the clock stays at zero as your application is not complete till you send in the evidence right?... BTW according to the website there is still a 90 days rule and there was never one for AOS its always been only for EAD/AP just saying that coz u mentioned the 11 month waiting period(i know u know this just wanted to mention it)...

and @ndwedding I'm sorry about your situation, did you try to get in touch with your congressman? coz my congressman has a website on which he has a specific link for helping with government/federal paperwork not being done on time...

I havent thought about it, so you think its not within processing time if they are saying only 60 days in? technically im  102 days in. I'll talk to my husband to see if he wants to do this. thank you!

so this is where the confusing part comes in... now after having read that what i understand is that your EAD/AP processing just gets delayed the number of days from the day they sent out the RFIE to the day they received your response, right? The AOS application btw gets set back to day zero? would love clarification on that if anyone can provide...

This is definitely confusing because i have the response email for the SR i submitted and it says in plain english. 'our systems show that we received your response for your RFE on your form I-485 on May 15th. Your form i-765 will be processed within 90 days of the receipt of the requested evidence'

this means im reset back to 0. :crying:

I am at 114 days today without either RFE or RFIE.

This is such a frustrating experience - especially when you want to keep moving forward with your life!

I'm going to contact/mail/post out a letter to my local congressman to try and speed up the process. I sent in a service request mid-June online and that was 'within normal processing times'.

Let's just hope our cards are mailed out really soon so that we can begin our lives fully here in the U.S.!

yes! agreed! this really tests our patience. I cant wait for this to be over.

Very similar situation for us too!! I wish they were more consistent with if RFE/RFIE effect other applications or not as it's frustrating to see other people that had one get approved without it effecting them. But is great for them just wish I was one of the lucky ones! We will get through this!

I really hope we hear something soon. Good Luck !!! :D

  12. My husband and i submitted an SR for ead on 6/22, at exact 94 days (7/1) we got a response that says that the EAD is within the processing time (90days) because they received and rfe response on 5/15. So i guess we should be counting our 90 days from that date. This pushes us back :( we are at 44 days now. this is so frustrating! i did notice that some people do have rfe and still got their ead before us.. we also haven't gotten interview date. :crying:

Exactly 90 days Last June 23 my husband EAD card is being produced when i checked it online today. (K1 ). THank God. From the time it says card  being produced how long can he receive it by mail?

Hi, you have a similar timeline than me. When did you get your interview date? We havent received anything and our status changed to 'ready to sched for interview' on 6/13

It isn't clear to me whether than means there is a backlog of 5mo.

The 'processing cases of' date is meant to tell us whether our individual cases are within the expected  processing time. If your PD (received date, or if RFE/RFIE the response received date) is newer than this date the case is in 'normal processing time' otherwise, you're out of of it and are eligible to escalate with USCIS.  One exception is i-765 EAD, which is is targeted for completion before 60 or 90 days of PD depending on the case category. Many of us are outside of this window but I'm sure they're working hard to help.

From this forum and others it would appear many get adjudicated well before this date, in some cases a few months earlier. Unfortunately the measure less like a speedo and more like the light that comes on when you're near empty.

I think the update is positive as it shows NBC i-765 (ead) processing cases of date has moved up significantly.

thank you for this information, makes sense!

The time between the ready for interview status update can vary greatly between field offices. There is no set time frame when they give out interview appointments. People in NYC can wait up to a year while people in LA usually get theirs relatively quickly.

Thanks for the info, are the field office processing chart pretty accurate do u think? Aug 2016 /6 months away seems like a long time.

  16. Hi, im new to the site! today our status changed online and now says our aos is interview is ready to schedule i was so excited and called uscis to get an idea of what office would be scheduling the interview and they gave me a san fernando valley! awesome! except she tells me that office is working on 8/23/2016 applications!! i now feel so discouraged... is this just a time frame they give you so youre not calling every month or is this really how long it will take for us to get an interview?? answers are welcomed!
