The anniversary is not from when you started living here (when you arrived via the K-1). The anniversary is from when you received your green card. So you can apply for citizenship 5 years from when you received your green card. Your current boyfriend/fiancee/future husband has no effect on this anniversary.

You mean 5 years since I received my first green card?

  2. Hi All,

I'm a single child, and my mom is a single mother. I recently got my permanent residency approved, and received my 10 year green card a few months back. I want to bring my mom to live here in the US with me, she's completely alone in Brazil (our home country), and I miss her so dearly, I want to bring her so I can take care of her.

    1. With my permanent resident status, can I bring her?

    2. I moved to the US with a K-1 visa, but got divorced before I got my I-751 filed. Can I apply for my citizenship in 2019 (after living here for 3 years) or do I need to wait until my 5 year anniversary? I came to the US for marriage, but I'm no longer married to the same guy - Im engaged to another american citizen now.

    3. I'm eligible for Italian citizenship. If I'm an Italian citizen, does the process get somewhat expedited to bring her?

    4. Could I bring her as a student so  she can spend some time here? My fiance owns a business, could we sponsor her so she can come as an employee and work with him like his secretary?

    5. For parents, is it true the processing time is about 8 years?

  3. Hi,

I filed for my I-751 removal of conditions (divorced prior to filing for removal of conditions) in late 2017, and almost 1.5 year later, I checked the USCIS website and it says that "My New Card Is Being Produced - On February 1, 2019, we ordered your new card for Receipt Number XXXXXXXXXXXXX, and will mail it to the address you gave us". I didn't get any text messages, letters, or emails saying that my petition got approved. What exactly does this mean? Please excuse my ignorance.

  4. Hi,

I have a question regarding processing time. I submitted my papers for my I-751 in November 2017, and the USCIS website tells me they received the petition in my local office (Vermont) in April 2018.

Now, when I see the processing times on VisaJourney, it says that the petition from September 2017 are being processed. My question is: what date does the VisaJourney processing time would take into account in my situation? November 2017 or April 2018?

    Thank you!

  5. Hi all,

in november 2017 I submit my package to USCIS to remove the conditions of my permanent residency. So far, all I got was a letter in the mail saying that the check I sent has been cashed and they received my application, and a letter to get my biometrics done, in the beginning of March (which I did). Since then, I haven’t heard anything. Is this normal, or maybe I’m missing a piece of mail that should’ve been sent at this point? Or now the next communication will be to approve it or deny it? Thank you.

  6. Hello,

I sent my I-751 ROC because of divorce in November 2017, in early December 2017 I receive a letter in the mail saying that the USCIS has received my $680.00 check and that I have an extension of my visa while the process is pending. Since then, I haven't heard anything. Is this the standard processing time? What happens next? I thought by now I'd have received some sort of other communication from USCIS pertaining to my case. Please forgive my ignorance.

    Thank you!

  7. Hi y'all,

I came to the US on a K-1 visa and have my CPR card. I am getting divorced from my USC spouse after 1,5 year of marriage and it's been tough for me.

When my soon-to-be ex-husband left me, my mother was visiting the US, and she's been here for almost 6 months now. She's been the cornerstone in my path to emotional recovery from such heartbreak.

Her I-94 expires in Nov 13th, and her flight back home is scheduled for next week.

Do we have enough time to file now for an extension or her visa?

If the petition gets declined, will she face a ban?

I would so much appreciate her presence here in this tough time. Thank you!

Dont include an affidavit from him if hes being difficult. If you include it they have the right to talk to him to verify it and who knows what kind of garbage he will say if/when questioned. With no affidavit from him they can not speak to him.

Thank you and good point, Damara. I'll leave it out. Other than that, do you think my petition sounds complete enough? Do you have any more documents you can suggest that I send over that I didn't mention?

  9. Hi,

    My timeline: Met 07/2015; K1 granted 03/2016; Came to US 04/2016; Married 04/2016; CPR 07/2016; US Citizen Spouse left the house 09/2017; I filed for divorce 09/2017; CPR exp date 07/2018;

I'm considering starting collecting my ROC waiver papers now, and attach the divorce decree once I have it and submit it to USCIS:

1 - Divorce Decree  - don't have it yet, but will obviously attach it once in hands

2 - Joint Car Insurance - the car was financed by him prior to the marriage

    3 - Joint Home Lease from 2016 & 2017

4 - Joint Tax Return 2017 - we got married after he filed for his tax returns in 2016

5 - Joint Bank Account Statements (from 2016 until its closure, a couple of weeks ago)

6 - Electricity & Cable Bill (only under his name but showing the same address)

7 - 100 pictures of us with family/friends and in trips together with small descriptions to each, including pictures of our "elopement" wedding in 04/2016 and of the huge wedding party we threw 1,5 month ago (yes, 1 and a half month ago!) and even a link to the actual video of the wedding

8 - Copy of his Credit Card statement and a copy of my credit card linked to his (I was added as his authorized user)

9 - Copy of love emails we used to send each other when we were apart still dating

10 - Copy of Love Cards we would give each other every anniversary/special occasions

11 - Cover letter I wrote telling the story of our relationship from the day we met til now

12 - Affidavits from the Landlord, from 2 common friends attesting the veracity of our marriage. Possibly an affidavit from my US Citizen spouse too, but I'm not sure he'll give it to me - apparently he's really trying to make me suffer.

13 - Copy of a few wedding cards we received from friends at our big celebration 1,5 month ago, as well as copy of a couple of holiday gifts addressed to both of us sent by friends.

14 - Copy of Marriage Certificate

15 - Copy of Mine and his birth certificate

    16 - Copy of my passport/CPR GC

17 - Copy of his expired US passport - he renewed his recently and I believe won't be willing to send me a copy.

    Am I missing anything else?

I was naïve during my marriage and didn't get a lot of documents together, like putting both our names in every bills :( I loved him very much and now with the divorce I get to see his true colors in trying to hurt me as much as he can, for no reason, really. It's hurting enough, I just want this to be over... sorry for saying these things, it's just so hard some times, you trust your life to someone's hands and care and devote yourself, give up on your life and dreams in your place for love and in the end, once you have a life here, you're treated with so much despise from someone you once thought was the one... I have friends, a job, and my life is all in the US now.

    Thank you all.

  10. I'm getting divorced from my US Citizen spouse - hopefully will get the divorce decree soon and be done with this nightmare. I currently hold a GC valid for 2 years which will expire in July 2018. I have not yet filed for the ROC with divorce waiver because I still don't have the divorce decree.

I would like to pay a visit to my family in my home country after I file for the ROC (while it's still pending). Is this possible without getting in trouble? I know I have the right to stay in the US while my case is being reviewed, which can take a year, but I'd like to go visit the family for a couple of weeks, can I leave in the meantime?

  11. Hi all,

I just filed for divorce from my US citizen husband. I initially believed it would be uncontested and amicable but hes making this hard and low.

Now I'm worried that he might do something to send me back to my home country. Since I moved here, my life has been the USA and I have a job here and my whole life is here now. I want to stay.

We were married for 1 year and 5 months and my conditional GC expires on July 2018.

He has a lawyer but I cant afford one.

Can he do anything to send me back? I loved him very much and have many proofs of good faith marriage. He's a straight up bad person though, he wants me to get screwed. I have pictures, joint lease, tax return for 2016 filed with both our names, car insurance with both names, joint bank account, joint credit card, wedding pictures, holiday cards addressed to both of us, love emails, love letters etc.

  12. Hi, I'm filling out the divorce from my husband - US Citizen -, and I currently hold the 2y green card that will expire on Jul18'. I moved to the US on a K1 visa and moved my entire life here, I'm well adapted here, have a job and friends here. I'll get through this pain of divorcing...

Anyway, once I have the divorce decree on hand and fill the I-751 ROC individually, can I stay in the US while it's processing or do I need to leave the country, in case I don't have the ROC all done by Jul18?

Other question is... would it be possible to fill out for the I-751 prior to having the divorce decree??
