  1. We got married Nov 6, 2004.

We filed for AOS, EAD, and AP early August 2006. Biometrics appointment was uneventful. Got interview notice for October 24, 2006. I was approved for conditional LPR status.

    CE,

Did you consult with a lawyer at any time?

Did you renew your TN after getting married?

That's the only thing that stands out to me.

Bear in mind that all of it could be administrative shuffling (xfer of file etc) and absolutely could mean: nothing.

    :)

Thanks for your thoughts......we used a lawyer for the paperwork/filing (didn't discover VisaJourney until after filing). Did not do anything with the TN after Green Card. We talked about the TN at the interview. The officer assured me that it was ok to keep working and that the TN is not needed anymore.

Is it possible that the FBI name check was not complete and thus SHE made the mistake to approve me?

    Ed.

  2. you should discuss the case history here,,you have to say everything about you and your wife,

please discuss your case , that will help

My history is not that complicated.

I'm from Canada. I came here in 1996 on a TN-1 Visa. Have renewed every year for almost 10 years without problems.

I met my wife at work a few years ago, "hung-out" for about 2yrs, suddenly discovered that she was "Hot!" and things developed from there.

We got married Nov 6, 2004.

We filed for AOS, EAD, and AP early August 2006. Biometrics appointment was uneventful. Got interview notice for October 24, 2006. I was approved for conditional LPR status. Got all kinds of notices and emails about approval and stuff. Green Card arrived in the mail early November.

At that time, I figured everything was done and over with until the emails posted earlier.

    Any ideas?

  3. My green card was received November 1.

(Previously Posted)I received the following email a few days ago:

Application Type: I130 , IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

    Current Status:

On November 14, 2006, this case was reopened on a USCIS motion, and the case is now in process. We will mail you a decision as soon as processing is complete. You can use our processing dates to estimate when this case will be done. Follow the the link below for current processing dates.

(new) Tonight I checked the CIS website and it now says:

Application Type: I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

Current Status: Case reopened or reconsidered based on USCIS determination, and the case is now pending.

We reopened this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN on November 14, 2006, and are now reviewing our earlier decision. We also mailed you a notice describing the next steps in the process. Please follow any instructions on this notice. Our review should be completed within 30 days. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service.

Before I was just annoyed that it was probably someone at CIS messing up. Now I'm concerned.

Anyone seen this before? Nothing in the mail yet. My concern is that the last time they sent me a RFE, I didn't get it.

    ...starting to lose sleep....

    Ed.

  4. Probably a mixup. They get confused sometimes.

I'd make an Infopass appointment, print out a copy of the email, and see if they can figure out what's going on.

Lawyer called CSIS. CSIS said they don't know why I was sent the email. CSIS then said to call them if we don't receive anything in the mail by December 14th.

However, the last time they sent me something (RFE), I didn't receive it. I was lucky that my lawyer received a copy of it.

...sigh...I thought this was all over.....

  6. So, is there ANYTHING I can vote in?

Not today, but I think American Idol will be back soon.

I received a reply today to an email I sent the State of Indiana yesterday morning:

    Thanks for your message.

Under Article 2, Section 2 of the Constitution of Indiana, United States citizenship is required to vote in any election conducted within the state of Indiana. Therefore, as the registration form implies, you would not be eligible to vote in any election in Indiana until you became a US citizen. Thanks again,

    Brad King

    Co-Director

    Indiana Election Division

Yup....American Idol it is......unless I'm banned from voting in that also.....The "American" in "American Idol" is what I'm concerned about. What if they become afraid that foreigners will be making "American Idol" UnAmerican?

    Ed.

  7. Ed,

I am happy you are excited about exercising your rights. I know one can vote in this election if you registered in time (w/greencard) but you can not vote in the presidental election.

    Good Luck and Congrats

Does that mean the State of Indiana is denying me my new "right" to vote by not allowing me to register for the election because I am not a Citizen?

    Ed.

  8. Hey everyone! I got my white "Green" card today. WoHOO!!! The picture is ugy and the finger print is funny looking....but hey,...I'll take it.

I have a question. On the USCIS website it says that Permanent Residency give you several rights in this country. The last one listed is: "To vote in local elections where United States Citizenship is not required."

The Indiana Voter Registration Form says that I cannot even register to vote if I am not a Citizen.

So, is there ANYTHING I can vote in?

    Ed.

  9. Greetings everyone!

I have been lurking on this forum for several months. I have not had anything to contribute but have found the information available to be very helpful.

    The following is our story:

I am from Canada; entered the United States with TN-1 Status Summer 1996.

    My wife is a USC.

We met Summer of 2001 at work (we work together).

We started "dating" sometime Summer of 2002.

We got engaged October 16, 2003.

    We married November 6, 2004.

My last TN-1 trip was Jan 12, 2006; valid until Jan 11, 2007.

We filed for AOS, EAD, and AP July 28, 2006

Receipts for each of these were received August 10; dated August 7; stating receipt date of July 30, 2006.

Received Biometrics notice on August 13; dated August 11; appointment date August 22, 2006.

On August 23 we received notice from lawyer that they received RFE for my wife's tax return. We never received this RFE and thus do not know what date this was generated.

Lawyer resent the requested information August 30, 2006.

September 15, 2006 we received a notice dated September 13 stating we had an interview October 24, 2006 in Indianapolis.

We arrived 10 minutes prior to our appointment time, checked in, sat down.

We were called approx 10 minutes after our appointment time, guided back to the DOA's office, raised our Rt hand, swore to tell the truth, the whole truth, and nothing but the truth; and sat down.

We signed a statement that we wanted to proceed without an attorney, and then were asked to produce ID. The questions were rather standard compared to ther stories I have read on this forum: 1) current address; 2) am I a terrorist, etc...; 3) confirmed how I entered this country (TN-1).

The questions to my wife were also rather standard: 1) Current salary; 2) How did we meet; 3) how long did we date; 4) Where was she born.

For proof of relationship, she asked for documents, we produced bank statements, pension statements, and insurance statements.

She then approved our application and advised us of the need to file for removal of the conditional status 90 days before the 2yrs comes up.

I asked her if she wanted to see the wedding pictures; she declined. I told her they were great pictures (sarcastically); she declined again.

She said the green card would be received in the mail in approx 2wks. I asked if it was ok for me to continue working where I am now or if I needed to stop working until the green card was received. She said is was not an issue. She also said they do not stamp passports anymore. She assured me it would be ok to continue working.

She congratulated us, walked us to the door. I said "last chance, ....are you sure you don't want to see our wedding pictures"; she laughed, and emphatically stated "No!".

    That was it.

We were back in our car after a total of 35 minutes.

There was no mention of the FBI name check. I didn't bring it up in the event that she overlooked it.

She also did not take my I-94 with the TN-1 status on it. I hope this does not become an issue.

  10. and to end this thread hopefully on a neutral terms: if your a real couple why feel attacked when its not you im talking about? so please calm down and get back with your own business.

    thank you for listening

    Andreas

You were doing such a great job of trying to explain your weak position.....and yet you throw in another insult at the end.

If you post something in a PUBLIC forum, and it is offensive to me, than I have a right to state that I am offended by it; just as you claim your right to make what I perceive to be very offensive statements.

YOU MADE IT MY BUSINESS. YOU used OFFENSIVE TERMS such as "Fifty Second Asian/White couples". You made it even more insulting by adding "etc."

Dude, just stopped insulting people. It IS possible to post comments and observations without insulting people. Most people on here do quite a good job of that.

    Ed.

  11. "Maybe me beeing a tall white Guy from Germany convinced her more than the fiftysecond Asian/white couple etc. It seeme dlike it in the waiting room because we were the only white folks there. "

I'm offended. It is a racist statement. Trying to hide it by claiming it is "fact" does not change anything.

I am offended that you are claiming that my marriage is "assembled" based on the fact that one is "white" and the other is "Asian".

I am offended that you are claiming that by "[looking] at the waiting room" you can determine that marriages between "Asian" and "White" are "assembled" but "European" couples are more likely legitimate.

I am deeply offended with your claim that you had superior "[convincing]" ability because you are "a tall white guy from Germany". Isn't this one of the root causes of the second world war?

I am deeply offended with your lumping of "Asian/White couple" with "etc." Who the heck is "etc"????? Who are you trying to lump me into to make your point more clear? What exactly are you saying about my people?

I find your statements very offensive.

    Ed.

    @all

thank you were glad its over and we can sleep a little more relaxed. in general i have to say it was faster than expected but with a lot of confusion from the USCIS in some situations.

I also think that the people that helkp you here do a good job but sometimes lack a bit of faith. what i mean is i read so many times that you have to get a lawyer that its not recommended doing the AOS route instead of K1/K3 visa retunr to your country road. i know these advices are meant in good thought bur can disenrourage young couples that dont have money for a lawyer or are simply unsure. im glad we went this road and it work with no hassle to all couples out there and ponder if they wanna dare to to AOS from visitor, student ot whatever visas i can honestly say: " if your intentions were clean not to come to stay and you have a relationship that works, try it!"

    @CarpiDiem

i was only commenting on the fact that it made a difference that we were different, stood out of the mass. thats all. not racist or anything, just the facts are that marriages from mexico, asia etc are more often "assembled" to get into the us than one few ones from European countrys. Just look at a waiting room or the official numbers.

    @makidesuu

its a printed letter with the signature of the local director so nothing personal but better to have this than nothing since i did not get a stamp or anything else.

  12. Thanks! It's pretty stressful (just because you want to work) but it can be done and thought I would share, because I know I was freaking out when I was just starting.

Another thing I should have mentioned, if you do go to a lawyer MAKE SURE they have a good background and understanding of NAFTA and the TN. Some laywers are scared of the TN status and may recommend things that aren't at all neccessary. Some might say you have to switch to an H1 (even through family based) This isn't the case. A TN can adjust status the same as other non-immigrants, they just have to be more careful with their timing :)

...and, switching to an H1 is more money for them.

  13. Hi all,

so I am here on a TN visa, but have met a wonderful man and we want to get married. So what the heck do I do? I dont want to mess up my TN cause I absolutely LOVE my job...but love him too???

My TN expires in april 2008? And I am planning to renew it

Any suggestions? I want to do things properly but cant/dont want to leave the US

    HELP!!

    :help:

    hugs

    Canuck in Cali

I'm here on a TN-1 Visa also. I used an attny to assist with paperwork and consult with throughout the process. He didn't think it was much of a problem to be go from TN-1 to Permanent Resident. Just needed to be aware of the dual intent issues. and file for EAD BEFORE the TN-1 expired. If the TN-1 expired BEFORE you get your EAD, you will need to get off the payroll of your employer. Otherwise, you will be in violation. After you get your EAD, you are not limited to the rules of the TN-1 anymore.

I hope that helps. But talk to your lawyer before you trust anything I say.

Question: TN-1 is limited to 1yr terms. How is it that your TN-1 expires in April 2008?
