    I am asking on behalf of a friend who came to the US and filed asylum, which she got approved.

    Is there a chance for such a person to bring her kids to join her in the US considering her current status? Can she apply for her kids to join her as she is under the Asylum category. It was a very difficult situation for her at her home country and she had to escape to safety while her kids are with trusted family members.

     

    Any suggestions will help. TIA

  4. Hello fellow VJ people.

     

    I honestly appreciate your advice/suggestions about this situation. This is extremely tough on me and a baby who just turned 1 year old.

     

    My cheating and very manipulative spouse wants to file for divorce in January 2018. He is claiming that we were last intimate in January 2017 (when my baby was barely 3-months old following a high risk pregnancy and a caesarian section birth.). He has been controlling and manipulating the whole situation like i am not a human being. I am so drained and tired of this mess.  

     

    My question is: he filed joint petition with me in July 2017 to ROC, and our state requires 1 year legal separation before filing for divorce. He is claiming that as long as we were not intimate, that for him is the separation date for him so he started counting since January 2017. This is a man that doesn't want to work on his marriage for a second, and heavily cheating on me. Meanwhile, I was trying to work on the marriage, but him not so much. 

    So with us filing a joint petition in July 2017, and he is claiming separation date to be January 2017, to file for divorce in January 2018, does this dates have any implications on my ROC filing?

     

    - Or I should just let him go ahead and file for divorce in January 2018 and then notify USCIS. Does this complicate things for me in anyway? I have all evidences of proving that our marriage was entered in good faith, till this man side-lined and started gas-lighting me. I am so tired and can't take these anymore. I need to go back to the happy and cheerful person I used to be. This guy has drained me emotionally and mentally. I need to be alive, active and happy for my child.

     

    What I was hoping for was to get a documented evidence of a legal separation where we agree on everything so I can move. Because knowing how manipulative and vindictive he is, he could come back tomorrow and accuse me of kidnapping our baby even though he verbally agreed that I can move out of state to be with my family where I can get support. But now seeing that he doesn't wan to write a legal separation with the real date, it becomes hard.

     

    -Will appreciate your suggestions/advice. This is so draining!

     

     

  5. Thank you so much everyone that responded. Definitely won’t allow myself to be bullied into signing any wrongfully dated document.

     

    I will wait till I receive the original separation agreement than just believing his words of mouth.

     

    i definitely have enough evidences of entering the marriage in good faith. I never saw this trouble coming. I grew up in a 2- parents home with my parents married for almost 50 years before my mother died this year. I definitely will be strong for my baby.

    I will appreciate your inputs here. I have been married to my spouse since December 2014. I recently filed for a joint petition with my US citizen spouse for removal of condition in July 2017. He has been emotionally, verbal, mental and financially abusive to me, but I didn't report any of the situations to the cops except one.  He has also been having extra-marital affairs. He has refused every request to work on our marriage and became more manipulative by the day. This is so tiring for me with a one-year old baby. 

     

    My Spouse recently told me he filed for separation and wants a divorce, that his lawyer will send me the separation agreement for my signature. He seems to be back-dating the date on the separation agreement which I am yet to see to satisfy himself, and it looks like there is an overlap in his dates he told me.

     

    If we filed JOINT petition in JULY 2017, and he wants to backdate the Separation Date to JANUARY 2017, how does this affect me as the petitioner? He is basically doing everything to suit himself. If this dates don't matter, I am tired of going-back and forth with him. And once the separation legal papers are signed, do I go ahead to inform USCIS of change of petition type? Even though Divorce proceeding have not begun?

     

    I am tired of living life like this, marriage is meant to be enjoyed, and not everyday-being vindictive to me because he filed for me. 

  7. I recently mailed out my ROC package, and was wondering if USCIS will go with the mailing address on th completed submitted i-751 form. 

    I wanted to change my address online but it says I mus have a receipt number to be able to do it.

    I had tried changing the address a month ago without a receipt number, but NEVER recived a change of address acknowledgement from USCIS.

     

    I am hoping they work with the address in my submitted form and send my NOA1 to the address in my form so I can use that receipt number to proceed with a change of address again online. Does anyone know how this works? or will they use the old address on file? TIA.

    I am preparing my package to send to USCIS shortly, and would appreciate if you all can look through and let me know if I am missing something you might think is necessary .

     

    Also I wanted to know how detailed the explanation for different addresses on pg 2 of 11 on form i-751 can be. I already have a two-page explanation for having two different addresses as it happened with seeing a doctor i was used to compared to moving out of state and starting all over with another doctor, coupled with the fact that no doctor was willing to accept me at the point in my pregnancy in the new state, so I had to go back to my precious state, hence I stayed apart from my husband for about 5 months while he visited regularly and was there for baby delivery and dedication, and then we moved back home after Doctor certified we could fly.

    I don't know if it is okay to be too detailed in the explanation as I dont know if someone is willing to read the 2-page explanation (I hope they read it). Hence my husband signed a lease while I was away, and we never bothered to add me to the lease once I arrived back.

    Documents I will be sending:

    1)         Joint Account Check for I-751 Application Fee - $595.00  

    2)         Joint Account Check for Biometric Services Fee - $85.00

    3)         Form I-751: Petition to Remove Conditions on Residence

    i have evidences of his emotional abuse to me even when I was pregnant with our baby, I have a witness to it too. Thought we were were working on our marriage so I never reported him to the doctor or the police.

     

    i have been researching and it looks like i must have a police or doctor's  report.

     

    He is also having extramarital affairs and I have evidences for those. 

     

    What can can I do as he is manipulating me and threatening me and also wanting to send  me out of the house with my baby?

     

    please help.... anyone in a similar situation without any reports but with evidences?

  10. I am married to a US citizen and he has been emotionally and verbally abusing me in the last one year. I have been enduring it, hoping we can work on this marriage, but it appears my spouse chooses to make life unbearable for me, and he doesn't want to work on the marriage as he is already cheating on me. 

    He probates and re-probates about working on the marriage so he cannot be trusted. He most recently started threatening not signing documents for the removal of condition on my green card, and then comes back next day and be cool with signing it. This is a lot for someone with a new baby to go through. 

    I have 5 months to the end of my conditional green card, and I am seriously considering moving out of state and leaving him so I can breathe some fresh air, and move on with my life.
     

    The state we currently reside in requires a 1 year legal separation before divorce is granted. If I were to file for divorce, there is no way it will be finalized before my conditional green card expires.  I have evidences of him cheating heavily on me, and had spoken to a lawyer, who said that if there was any police report of domestic violence, then it would be easy for me to file on my own under battered spouse waiver.  We have a baby between us and have a lot of pictures and tax returns with some joint financial responsibilities shared between us in the last three years. 
     

    He mentioned i should use an attorney for my ROC which I didn't think was necessary, but I don't know what he wants to do. So another question I have will be: if i were to use an attorney, do i let him know what is going on even if this husband of mine will sign the papers? This guy has dealt with me mentally and emotionally that I am finding it difficult to trust anything coming out of his mouth recently.

     

    I will appreciate advices/suggestions from people who have gone through similar issue, and would like to know how they went about filing to remove the condition on their green card. Please kindly share your story.
