Did you admit to the interviewer you purposely filed for a K-1 instead of a CR-1 because you wanted the fastest path to the US? That isn't a misunderstanding that is misrepresentation.
Your chances of getting a tourist visa after being denied a K-1 visa are next to none. You are an extreme risk of never leaving the US. I suggest you learn how to respect US immigration law if you expect the same kind of respect back.
Ok

An expedite wouldn't apply in this case as she is no longer pregnant. You can't expedite because a USC needs childcare (I would've done this myself). His wife has the option to return to live as a family in Senegal.
Tx u got my point ...

Right so you were denied because traditional marriage, but not married enough for a spouse visa until you did the court marriage. Probably not as bad as having a marriage cert and claiming not married but still not able to appeal.
Tourist visa still a long shot as US wife and child due, tourist visa being for tourism not to live with wife and child whilst you wait for visa.
Ok tx but not like a kind of respect it was just we dnt understand and we strong desire to live together before she gave birth..hope u will understand tht...

Was you marriage considered legally binding in the country in which it was undertaken and do you have marriage certificate or equivalent from that? If you didn’t go to court would your country still consider you married?
Or did you have a traditional marriage but in your country it isn’t legally binding until you have the court marriage, therefore too married for fiancé visa but not married enough for spouse visa?
According to our cultures we married a# is celebrated in the mosquee and abt the paper is not compulsory...but we finaly got our certicate of marriage after being denied of fiancee visa but to be clear when we applied for fiancee we dnt yet go to the court but traditionally we married ..hope u get me now

This is why you were denied, this is material misrepresentation. You lied about being single and free to marry in your petition and visa application.
Seriously this is the second person today to come on here having lied and applied for a fiancé visa when already married.
You will not get a visitor visa, you have already proven dishonest in order to try and circumvent immigration rules to make it quicker for yourself because you think your reason is valid. Pregnancy isn’t a reason to expedite and it isn’t a reason to violate immigration rules.
Nooo we just having misunderstandings abt the fact if i said married lime our culture is the union is made in a mosquee and not in a court ...in the tradition we married but officially not like we dnt go at tht time to the court .....in the name of usa juridiction we not married as we dnt go yet to court n sorry for my english in french will be more clear

Wait what?
You applied for a fiancé visa even though you were married?
Yes as she was pregnant and need to go back to usa we thought was the fastest and we applied for fiancee visa...

You can apply for anything but with a US Citizen "wife" you will not be granted a "non-immigrant" visitor visa. If you were married at the time you interviewed for a fiance visa, then being married would be the reason your fiance (K1) visa application was denied. If you claimed to be unmarried when you were actually married, then you have a lot bigger problems than a wife in the US who needs you.
Yup we admitted was a mistake because we were thinking is the fastest one then we tried..so do u mean i can apply for the tourist as our Cr1 is on process...? Am i lucky to get the tourist visa??

Ok.. you can either refile the i129f petition with its fees or file i130 petition with its filing few as well but I feel cr1 will be preferable as I was also previously denied a fiance visa too in March 2017 but now we are in the cr1 route
Yes we did already applied for the spouse visa and it has been in process ..but the matter my wife had a baby and need my assistance from now so is it possible for me to apply touris while waiting for spouse visa getting ready ...

Returned fiancé visas seem to be left to expire and you don’t actually get sent anything, very rare to get something anyway.
When end you were denied you would have been given a slip of paper, what did it say or what did it have ticked? This is you reason for denial.
Anything clear thy mention in the paper ..i realy don’t understand whts happen ...??

Being pregnant is not an advantage in the eyes of the CO. It may even lengthen the process because they will ask for a DNA test.

Do you want fast or do you want a better chance of approval ?! As I said all returned K1's are dead on arrival but returned spousal visas get a rebuttal chance. It's your gamble. You may or you may not get approved with another K1. Nobody knows what will happen. Yes it takes longer but it's also cheaper in the long run because you don't have to file for AOS and can work right away and do not have to wait for several months for work authorization. You need to also overcome the reason for the refusal and get some visits for real face time in to prove a bona fide relationship, not just chats.
Ok tx u so much for all the clearance, she went to visit me last time and she is planing to do it again this coming months and the fact is she is currently pregnant is it an advantage for us for spouse application??

If your K1 visa has been refused and returned to USCIS then it will be expired and not reviewed.
Yes, you can file again whenever you want to. Overcome the reason for refusal or you will be denied again. I suggest a CR1 and lots of visits. What did the 221g paper say as ?
Ok ii wana file again k1 as its faster spouse visa..is it good idea??

Hello i have been denied of visa fiancee the last february ..when i checked my visa status ,it is eaying on Administrative Processing , how long it will take for tht ,i already waiting for now 4 months ..can i reapply now a new one k1 or spouse visa..? Tx

It is best to wait for the reason for denial. It will take some time but it will be sent to you. You could be denied a spousal visa for the same reason you were denied a fiance visa. Did you have any red flags in your case?
A spousal visa takes 1 year.
Red flag ? Where i supposed to see it? It s just when i check on my visa status online ,it s mentionned : Administrative Processing..

What was the reason for your denial?
If you reapply you will likely be denied again unless you overcome the reason why you were denied in the first place.
No thy ddnt mention why im denied..can u tell me hw long it will take for marriage visa?

Your petition will be returned to USCIS, at that point it can take 6 months about before you get an official notice that the petition has finally expired.
From now can we apply a new k1 visa or we have to wait till they let us know?
