  1. Hello

I am a slight bit confused at this point so maybe somebody can help me. I am a Us Citizen sponsering my mother and have turned in I-130.

My mother was married to an US Citizen for 16 years and the marriage ended in divorce. She gets SS benefits from her ex Husband and will get

    Medicare.

My question is regarding the Affidavit of support exemption. In the instruction it states that if she has 40 quarters or work credits of her own

or combined from her marriage she wouldnt need the I-864. I have have read in the past that you cannot count the work credits if the marriage

ended in divorce.( not stated on gov instructions for I-864W) So would her credits along with her ex Husbands count for eligibility?

    Thanks so much

  2. Hello

I have a short question and maybe somebody can help me. At the top right hand corner of the I-864 form there is a expiration date. My father (joint sponsor) filled out this form in Aug 07 and sent it to me, now I noticed the expiration date up top says 31 Oct.07. Does he have to fill it out again? I thought that was strange because the package I recieved from Frankfurt was also an expired form!! Thanks alot

  3. Hello

I need some help. I am getting all my paperwork together (package3) for our interview and I think there is a certain order I have to put the forms together. I have searched a while now and cannot find anything on that subject. Maybe somebody can help me with that?

I would also like to find out where I can find the instructons from the IRS publication that shows that you were not obligated to file taxes. The say if you did not file taxes please send a letter stating why not and a copy from the IRS instructions publication. I have looked everywhere and cannot find it.

    Thanks alot

    with kind regards

  4. Hello

I am currently filling out the I-654 form. I have two questions.

    1. Part3 ( Wife- USC petitioner, 2 children also USC, husband beneficiary ). I checked the box Nr 9. Iam sponsoring the following family members immigrating at the same time..... I listed in a-e myself, my children, and my husband (immigrant). I got a household size including my father as joint sponsor and his wife of 6. Was that correct so far? Do I need copies of the I-864 for each family member? I do not really classify myself and my USC children as immigrants, wich confuses me a little.

    2. My father (joint sponsor) does not meet the poverty guidelines, he is off by 3000.00 dollars. If we use assests to meet requirements (amount needed 15.000) can we use my assests savings of 30.000 dollars? I read somewhere you cannot mix income from sponsor and joint sponsor but it did not say assets? Thanks alot for your help

    kind regards

    Cindy

Hello there. I am assuming that you are currently living overseas. You do not need to include your father or his wife as they are not part of your household. On your I-864, if it's just you, your husband, and your two children, you should have a household total of 4.

I assuming your father is living in the US with his wife and has no dependants. He would fill out a separate I-864 with a household size of 3 (himself, his wife, and your husband). So your father only has to make enough money for 3 people. If he still doesn't meet the requirement, you can transfer some of your savings into one of his accounts. The assets shouldn't be mixed either.

I hope that makes sense! :)

Thanks for the quick answer. I am a little confused now. If my father has a household size of 3 on his form and I have a size of 4 on my form wich poverty guideline amount do we use?

  6. Hello

Today I went and made photos for me and my husband. I asked the guy If I should leave my glasses off. He said no tha  t is fine with glasses. We paid 30 Euros for 12 photos and now I read that your not supposed to wear glasses!!! Then I read in the forum it is ok to wear glasses as long as they are not tinted. So maybe someone can give me an exact answer. If not I will be going straight to that photographer tommorow. he told me he makes at least 30 photos a day for visa purposes.

    Thanks alot

  7. Hello

I am a USC living in Germany my husband is German and my children are also USC. My father is in the USA and will be our Joint sponsor, since I have no state side income. The only income we have is from my husband (German). Here are my questions

    1. If I understand correctly my father fills out the Support form in the USA and then sends it to me?

    2. Where does he get the forms from?

    3. Who is included in the household size? Would it just be my father his wife and my husband or all of us ?

    4. Should we also make copies of our German tax returns?

    Thanks alot for the help

  8. Hello

Here is my situation. I am a USC living in Germany since 1985 . I came to Germany as a military dependant got married and started a family. My husband is german and my children are USC. I would like to move back to the US with my family. The probleme is that I do not have a job in the US (no stateside income) and my husband cannot get a job until he has a Green Card. I have heard so many different things regarding me filing I-130 petition, some say I can with a joint sponsor others say I cannot. May father is in the US and would be willing to be a joint sponsor. The only proof of Domicile I could show in the US would be a Adresse and a Bank account, wich I am not sure is enough. If I am not able to sponsor my husband with a joint sponsor (my dad) what other options do I have to go back to my home country with my family? I would be greatful if somebody could give me some advise.

  9. Hello

I am new here and have a few questions concerning the I-130. I filled everything out but do not understand question nr 22 (adjustment of status). I am a us citizen and my husband german. Maybe somebody can explain it to me. Should I send the forms registerd mail? I thought I read something about that in the past but cannot find it now? thanks alot

Hello. Welcome to VJ. Unless your husband is currently living in the US with you, number 22 is ignored. I believe I wrote N/A on the blank lines.

Are you currently living in Germany with your husband and plan to file at the Frankfurt consulate?

Yes I am living with me husband in germany, and am going to apply DCF in frankfurt.

  10. Hello

I am a US Citizen, my husband is German an our children both have US passports. I have a question concerning the I-864 form. Do I have to put my husbands income (household income) on the form since I am not currently working or do I leave it blank? I thought the income only counts if it is a US income or continuing there. I will be using my father as a joint sponser. Thanks alot

  11. Hello

I am new here and have a question. I am an American Citizen living in Germany since 1985. I would like to apply for DCF in Frankfurt for my husband. Now my question is, I have never filed US taxes because I did not know I had to. I also have not been working in germany since 1997. As stated I must show the most recent tax return but I had no income, do I have to use my husbands income? I hope that is not a crazy question but I am totally confused and this is really all new to me. Thanks alot
