  1. Just a piece of info that I didn't know when my husband handed in his info. I had a co-sponsor (my uncle) and I sent his tax papers. They asked my husband when he went on the interview for my uncle's proof of citizenship. Copy of his passport and Naturalization certificate. So just wanted to let you guys know. I don;t know if it is normal or not but better safe than sorry. At least you will have it if you need it and won't waste time or delay anything like they did to us. So now I have to make copies and send and he has to go to Isl. again

    I've been out for a while and not around to read/post. Hope all is well for everyone! Winter is here in a big way. We just had 2' of snow and temps are COLD! -22 F yesterday morning, brrrr!!!! I love winter though...

    Faal4anisa and ced8 Sorry for not replying to your questions sooner. We are just submitting our packet 3.5 back to the Embassy. It took some time to prepare all the documents we needed. We did not realize that for the K1 visa, you need nearly everything immediately (where as for the K3/CR1 you submit much more once your interview is scheduled). We were not prepared to submit it all quickly, so we've had a bit of a delay...

    Here is what was asked for in the K1 packet 3.5:

    Two copies DS-156

    One copy DS-230

    One copy DS-156K

    One copy DS-157

    Birth certificate (and english translation)

    Death certificate or Divorce certificate if previously married (and translations)

    I-134 (Affidavit of Support) from petitioner & supporting documents, including:

    Copies of petitioner/sponsors fed. tax returns

    Proof of employment

    Proof of assets

    Beneficiaries passport

    Two passport size photos

    Police certificates

    I sent off my certified I-134 and supporting docs to my fiance via UPS last week and it just arrived in ISB. He now has all his police certificates, etc... in hand so will be returning the packet to the embassy in the next few days. I will certainly keep my timeline updated as changes occur.

    Once he is assigned an interview date, he will schedule his medical exam.

    Just to point out something you mentioned for CR-1......

    We had to submit everything that you sumitted for our CR-1.....its K-3 that lets you submit everything on the date of the interview....

  2. Ok everyone so my husband had his interview today in Islamabad. He went through the whole process adn they are now asking for some additional paperwork. First of all my uncle who is my co-sponser I need to send proof of his status. He is a US citizen through Naturalization. SO iwill send a copy of his passport and naturalization certificate. Also when my husband came he came on PC and applied for political asylum. They have all this on record and nothing is hidden. Now when he went back to pakistan he has no proof of the Date he went back. He went back in 2002, they want proof. What kind of proof can we supply. They said if you don't have proof than u must supply us with an Affidavit. And also they want to know what his legal status was when he was here. I don't understand y they would need that because they have his old file from when he was here. And he overstayed his visit last time. I don't know but he will be going to see an attorney inshallah on Mon. They gave him a blue slip and said that he doesn't need to make another appointment just come when u have your pperwork ready. His interveiwer was a Chinese man I think he said and he was a little rude. I have not talked in much detail with him yet about the whole procedure I will do that tomm. He said that they didn't even look at our wedding pics or anything and he thinks that they seemed ok with the legality of our marriage.

    So does anyone have any idea of this what they think will happen? Anyone know any good immigration lawyer in Lahore?

    I am really at a lose and feel like we are stuck in the middle. Also his I-130 has been approved and they sent me bill for Affidavit of support. But I called NVC to find out if I have to fill out fee since I just did it for the K-3, and she said that dont do anything till I find out what is going on with this case. If I start the I-130 they will close teh K-3.

    Any news or words of wisdom will be appreciated...

  3. Salam everyone. First of all Eid Mubarek to all.

    So my husband just came out of "ITIKAF" last night and today I got an e mail saying that our I-130 was approved. Subhanallah. :dance: Ok but I am a little confused. He still has his K-3 interview on Nov. 24. And I know a few people that have applied for the I-130 and they got packets and had to send them things to the embassy. I never received anything from them. I just send them the application got receipt from them and now almost a year later I get the approval letter. So now what? Now are they going to ask me for all the things or what? I don't know what to do now. They said that they will send me the letter within 30 days. Anybody know the timeline for ISLAMABAD for these kind of cases? I know alot of you guys are still waiting. Please help if anyone knows.... :huh:

Yesterday I called some lawyer that my friend gave me the # for and he said that u need to do it from here. Does anyone know the way? And is it faster if I do it from here? I mean I did all the paperwork thru here so I am not sure.

    Also what is this Pre Paid Legal thing????

    I use my attorney for this hellish AP process with questions

    and I use him for my divorce, I used it for my interview with USICS.

  4. Hey does anyone else have problems with the www.immigrate2us.net site or is it just me??? I get to the first couple of pages but than when I click on a topic it just doesn't go further!!!

    Ok here is my question to everyone. If lets say one's K-3 approved and the I-130 is still pending. Can the person come to USA and without the approval for I-130 file for AOS or one has to wait for I-130 to get approved.

    And lets say If a person has a K-3 visa in hand and comes back to the States and if the I-130 gets approved, can the person go for Consular processing and AOS in the US (both at same times). Just to see where ever he can get an interview first?!

    If a person comes back for Consular processing for cr1-ir1 to the country and goes for Consular processing, if put on Admin processing can the person return to the US on his K-3 or do they cancel it?!

    I would be much obliged for a response from anyone who has any knowledge regarding this.

    1.. the person needs an APPROVED I-130 in order to AOS. its reflected in the guides. thats coz,

    your are AOS based on K-3 petiton. where as k-1 would have I-129f petition.

    2. I would think NOT. because, you have to state rather you want to AOS in the USA or Abroad.

    3. I think it would not be cancelled til you have decided on if you will AOS state side or abroad.

    you must bear in mind those on AP during this time. will experiance it during AOS in the USA.

    so its a chance you wanna take - then go for it. I would think its easier to AOS in the USA.

    its only a 10 min appointment.

    anyways these are my guesses..

  6. Well I don't know if I should wait for after his interview to get the waiver or find someone to start making it now. I mean on one side what if he doesn't need it and I canmake it later like someone suggested or I make it now and so he can have it at his inerview. I don't know what to do I am so confused. I tried to get onto the www.immigrate2us.net site a few times and it won't go through. Don't know if something is wrong with the server or not. But if you have some numbers of attorneys in NY or Jersey I would apprecate it. I will also talk to Laurel. I know that she is saying that she can get the case done faster, but is it true. I mean really is it up to her, ist't there a whole bunch of gov. BS to go through anyway??

    Ok well my husband wasn't actually deported he left on his own. On his records when u call this 800# and put in his alien # it comes up and says exclusion. SO I dont really know what that means. So he wasn't really deported under the expense of the U.S. I don't knw I am getting even more and more dishearted everyday. I just hope by some miracle of Allah that this goes through. I dont even know what to expect. I am just expecting the worst but hoping for the best. Thanks anyway guys!! You all have been very helpful.

    I looked on the website for the attorney, she is pretty expensive. I will look into it more though. I would like someone local in NY or even NJ. Anyone know of someone please let me know.

    Yes! an excellent resource on Waivers is www.immigrate2us.net, I would suggest hiring a good Waiver lawyer! As waivers can be really tricky. Laurel Scott is an excellent lawyer www.visacentral.net I think is her website.

    Waivers cannot be expedited, until and unless its a dire emergency. Is your husband in Pakistan or US? If he is in the US, your safe file all paperwork immediately if he isnt in deportation proceedings.

    If he was removed, then he has to file I-601 waiver. If you have filed for K-3 and CR-1 whatever reaches embassy first he would be interviewed for that. Then he would be refused a visa for over staying in the US and would be told that he can file for a waiver, then comes the fun part a waiver needs to be prepared along with fees and submitted. Your husband will be then finger printed and then the wait starts....

    Like I said, I know people who have been waiting two years AFTER there interview on waivers. Its just sad, but waivers just take forever (especially for people from Pakistan).

  8. OH MY GOD!!!! R U KIDDING ME.... almost 2 years. Oh my god I will just freaking go insane. This is ridiculous. I never knew about any of this immigration stuff till I got married (I am a born Citizen). I can't believe this, any way you think of speeding it up????

    OVer staying a visa means waiver (unless he was admitted in student status). If so, then waivers for Pakistan after submitting are taking 15 months minimum to approve! I know of cases pending for about two years now too!

    The waivers are sent to Rome for Adjudication

    Shon, a whole bunch of clearances came back to the embassy. Call DOS and ask them what they have to say!

  9. Hey can anyone tell me how they know which one is package 3 and which is package 4. I don't know the difference but my husband got a package for his interview. And I am reading how everyone is getting package 3 and sending things in and than get package 4. But he is saying it doesn't say anything about mailing anything in. That he thinks that he just takes everything to the interveiw. It has all the info for the medical report and police report and affidavit of support..etc in it.

    Also does anyone know if I have to actually show a bank statement or can I just get a letter stating that I have a certain amount in my account and get it notarized. How much should be the min that I show??? :help:

    Yes if the aide thinks you will need a waiver please start getting it ready now. I know of two others from Islamabad that had to file waivers and it does take some time to get them approved and I would guesstimate 6 months or longer. I will try and check the status and times of the others and post them for you.

    Aeysha is still in processing and has not gotten a visa for her husband and she is living in Pakistan yet with him if I am not mistaken.

    Shakil filed around the same time and he just got his approved in the last month. His case is in AR for name checks again and then he will come to the USA and his wife.

  11. Hey I just wanted to know something. My husband has his interview date on 11/24/06. HE was in america once before but he had overstayted his visa. HE has no criminal record though. I just wanted to know if you guys have had any experience with this, or know anyone who has. I want to know if any of you have any idea of the time it will take or even the possibility of him coming. I spoke to a Legal Aid and they told me that he will most probably require a waiver. And after sending the waiver that it could take anywhere from 6 months to a year or even more. But most probably it will be approved cause I am a born citizen here. Any advise from anyone would be appreciated. This is the month of Ramadan and I preying to Allah to help me. In this month by the grace of Allah anything is possible. :help:

    I'm having a hard time coping with not having my Ali here. All of this on top of studying at a very conservative college, I just feel like we are not wanted here in the US, and I don't know if I want to stay here if we will be treated unfairly because hes Muslim. But then I wonder if anywhere will really accept us (him being from a Muslim background and me from an American/Christian background) and if we just have to deal with it and stay strong. Anyone else having problems with this?? How do you plan on making it work out?

    I know exactly how you feel...i am a muslim convert (used to be christian) married a pakistani guy..anyway, i live in a small town in missouri and there are no other muslims here, im the only 1, it's not fun...but i don't care what they think of me, truly, my familly, friends, people feel so uncomfortable to look at me wearing a scarf...but the thing is that there are alot of people too who really appreciate it, and respect it...and are curious and ask questions, and it makes it really way better than the bad looks...like believe it or not i had like a 60 year old security officer from my college tell me that he "truly appreciates the way i dress" that he is "sick of the way these young girls dress these days" and i really think that when you are happy with yourself and appearance, others can sense that and may not like it, but atleast respect it.

    O yeah, and just stay busy busy busy, cuz it makes time fly...and don't talk about it alot, making yourself feel hopeless...im also staying in an apartment for the first time, it's hard, to raise my small child (1 yr old) alone...but it's up to Allah, He won't give me more than i can handle, and i take it as a compliment that Allah gave me such a challenge, and views me as someone strong enough to get through it insh'Allah.

    Don't forget also that no one controls your life, only Allah does...they aren't in "real" control, they just like to think they are...so just pray as much as you can, offer nafl and things like that, insh'Allah your prayers will be answered.

  12. Ok so I checked on the website and his K3 approval for USCIS was on Sept 12. Now how long does it usually take for him to get everything done and get an interview. I was looking on a lot of people's timelines and it seems like the norm is like 2 or 2 1/2 months. So what do you need to bring and how hard is the interview. Does anyone know if they are being harder on the men than the women?

  13. Ok so today I checked online and it said that my husband's i-129f case was approved. I want to know now what is to happen and how long it will take?

    I want to know how long will it take for him to receive his interview letter? Also are they going to ask for any evidence from him, what will they ask for?? Also what will they ask at the interveiw?? Do u guys think it is a better support if I am there when he goes for his interveiw? Cause I do think that they will probably be harder on the guys than girls due to all that is going on.

    And please tell me how long it took u guys from the approval letter till the interview?

  14. U r right that was my mistake. What I meant to say was that his I-129f application has been approved. And I wanted to know now what the steps will be. How long does it take for him to get an interview date. Will they ask him for any papers to be mailed to them? What he needs to take with him and what will they ask???

    Your post is a bit confusing. However, assuming he has his K3 visa in his passport and is ready to come to the US, there is a further stage that you have to go through.

    On K3 you have two choices, allow the 1-130 to run through and your husband to return to pakistan for the interview there, or apply to adjust status from within the US.

    If you adjust in the US, the US citizen is expected to attend the interview.

    However, if you are asking about the K3 interview itself, then you are not required to travel to Pakistan to attend that interview.

  15. I just checked online and it is saying that his case was approved on Sept. 12,2006. (mahshallah)

    They have sent me a letter and they are saying I should receive it within 30 days. Now I want to know what is next?

    Whawill happen now and how long should the whole process take till he gets here? And when he finally gets to interview what kind of questions will they ask him? And is it better if I am there with him through the interveiw? Please someone help me....
