    My husband's GC will expired next year, im aware of filing I-751 within 90 days,

    im a bit worried about his job they might question him in regards to his GC being expired?

    Do they have any extension or do i need to apply for it.. he loves his job and i dont want him to be fired because of his status (GC being expired)

    You can relax, it isn't half as bad as you seem to imagine now. Your husband has to file a I-751 for a removal of condition in a 90 day window before his Green Card expired. When he files, his legal status is automatically extended until the USCIS makes a decision on his application, that means he can legally work and travel like any other permanent resident. As proof of his filing, he should receive a Notice Of Action (NOA) from the USCIS that serves as official proof that his status has been extended for one year beyond the experiation date of his GC. His employer, however, is not allowed to ask to see the new papers; your husband needs them only if starting a new job (or crossing borders). (This is a truth with reservations - if the employer works in a security sensitive field, there might be overriding rules that force the employer to check the immigration papers of his employess regularly.) In the unlucky case that his status is still pending after one year, your husband can get a stamp at a local USCIS office that extend the written proof of his status for another year.

    ME & MY HUSBAND WENT TO APPLY FOR HIS SSN HERE IN ILLINOIS BUT THE LADY THAT WORKS IN SSN OFFICE SAID WE HAVE TO WAIT FOR HIS EAD(EMPLOYMENT AUTHORIZATION) DUE BECAUSE HIS VISA IS FIANCEE AND THEY CANNOT JUST DISPENSE ANY SSN NUMBER TO US.. SO WE HAVE TO WAIT FOR IT TIL HE GET HIS EAD CARD NOW WE ARE IN THE PROCESS OF AOS/EAD.. PLEASE GIVE ME SOME FEED BACK ON WHAT TO DO OR IS THIS REALLY TRUE?

    hi PW,

    Regarding about your question we just got lucky that they didnt ask for it but i made sure that we have the AFFIDAVIT OF DISCREPANCY that we only paid for 300 pesos in a Public Notary place ( COMPUTERIZED) and have a lawyer signed it and seal it to make sure that the document is not fake and that the person stated with or without the middle name is that person... So far wala pa naman inask sa amin... They actually didnt even look at it... but DFA said his illegitimate so NO MIDDLE NAME under the law... So by the law of the PI we cannot have any cause it's his mom's last name kasi baka mukhang magkapatid sila ng nanay nya.. yun lang pero we havent received the visa but no AR either so were hoping for the best though...

    Hi Everyone,

    :thumbs: We GOT APPROVED!! :dance::dance: and the CO congrats my fiancee and said he will approve his visa.. Got the pink slip, hope they will release his visa soon...

    but of course we are aware that sometimes even though that your Approved you can be put on AR when they find anything wrong & we are aware with our little discripancy with my fiancee's BC.

    Were hoping that CO will let it slide and not to put us on AR but so far they didnt ask for anything, my fiancee mention that the Pre-interview (Lady) didnt even look at our BC,they she just ask for the copy from NSO...

    Quick question in our interview this coming march do they need a 2006 recent tax return cause i just read on another post she was put on AR because she cant provide a 2006 tax return...?? Just a question do they need it?? for march interview?

    On my Sweetie's BC there is a typo in her name. Her name is Gracia, but it was spelled Garcia on the BC. Her family went to court and had her name changed to Gracia from Garcia when she was 21 yo. We have read many people have been put on AR because of a discrepency in the BC. We have court documents confirming the legality of changing the name as well as baptismal and other evidence that she never used the "Garcia" name. My question is, would it be beneficial to get an NBI and CENOMAR under the "Garcia" name as well at the "Gracia" name? We would not, of course, offer this evidence unless it became apparent that the CO was having a problem with the change on the BC. Thanks for your answers in advance.

    In regards of your problem i suggest her to go to a public notary place where they can do an AFFIDAVIT OF DISCREPANCY. The lawyer can make that AFFIDAVIT letter stating that GARCIA & GRACIA is the same person on the the benificiary or in the petition. That's what we did and i consulted a lawyer in the philippines and i also here in US that handles immigration cases. This is not a big deal unless she's late registry then that's a problem. In the philippines alot of people had this problem this is a clerical error. She cannot change it because it's in the file already... i hope i can help im on the same boat..

    Hi Maylet,

    I am wondering about your case so i went and read your profile and find out that you really are so stress about it. Im sorry to hear that, i know how it feels to be on the same boat. Thats what happen to my friend's daughter when she put her middle name on her daughters BC and have the father signed even if they were not married and they will have a problem soon on that one but it was completely different case since they are not applying to go abroad. I feel bad that you have been through halfway on this journey and you are having problem just like me, its very disappointing but dont lose hope girl, things will going to be alright. At least you get all you need to get and gather to fix your problem but like me and my sweetie, we think every possible things and do every possible way to prevent if not lessen our frustration on this case. We may not have a guarantee not to be place on Ar but just do every possible things you can so that on the interview date you can present all that they want, if they ask for it.

    Hi again,

    The reason why i know this is because i talked to the people in DFA were we found out that we have a discrepancy in his passport because they didnt put the middle name of my fiancee on his passport. the supervisor and said under the law of the philippines if you were not recognize by the father you are a illegitimate and you automatically have to take your mother's last name but my fiancee mom didnt know what to put on his middle name and assume that she can put hers instead.. ummhhh wrong.. it's a big mess actually. So now what we did we went and ask around with what to do and ask the supervisor of DFA with what to do they said to us to go and get a notarized letter with a real good lawyer said to us that it's a clerical error.. plus if you ever change your name or any changes in NSO. They dont actually change it they will put a notation that u wanted to change it and you request it. So they will put your change your BC and put on a late registration because of the changes.Welcome to the philippines this is how they do things in our country we do things messy so.So that you can spend more money and so the government can corrupt it.. ( i know out of line ) but anyways The late registration is the problem because of marriage fraud issues they might think you just registered so you can skip the anullment thing if you think about it , its really expensive it will cost you about 4000 dollars for it . but we dont have this kind of issues no problem in regards to that.

    Now, What we did we applied for his NBI and CENOMAR one set w/ his middle name and the other one without to make sure that he got no crminal record or same name and his address since birth is the same now and same DOB. So i dunno what else can we prove the his middle name is an error, it's clear on his BC that he got no father's name and if you think about it he cannot have any middle name at all because if ever his mom and my fiancee is gonna look like brother and sister. The most important thing is his NAME AND LAST NAME the same in my petition and visa application and of course if the relationship is real. and it's a BONA FIDE RELATIONSHIP!!

    This is why im so annoyed because why can they catch those people whose not real nor got married for money. Why are they looking at people with Typo names nor missing letter or should not have any middle name (in america we really dont use our middle name) Just Name and LAST...

    Why can they put their time and effort to go and investigate those people whose using US citizen for money.

    I just got back from vacation in the philippines to visit my fiancee. Well whoever remember my dilemma with my fiancee' passport discripancy with his middle name. Well i went to DFA with them and i spoke to a supervisor about our issues with his middle name not stated on his passport. This is what i found out under the law of the philippines if you are declared as a illegitimate child and the father never signed your BC or have not recognize you as his child. You automatically have to take your mother's last name but his mom put her middle initial in her BC. EXAMPLE: his mother name: ROSE D. MEDINA and his mom put in the BC of her son's name: JOSE D.MEDINA.i guess his mom didnt know what to put at the time so she assume same as hers and if ever they put a middle name on his passport it's gonna be worse cause his mom is gonna look his sister instead of mother. So DFA suggested to go a lawyer to make an AFFIDAVIT OF DISCREPANCY. this will help to explain why his middle name is not stated on the passport. but on his NBI his middle name is stated and also on his CENOMAR...We did that i just dont know if USE honors such AFFIDAVIT..

    So please give me some advice here. I really need help here should we just stick with no middle name and explain to a CO why his name should not be on it. We dont want to change his BC because it's gonna look like he just registered late that's a big deal. So what should we do.

Last Name: Medina . So when i applied for K1 i included his middle name cause it's states on his BC. Now, when he went and get his passport, the lady that works at the passport place stated to him that they cannot include the middle name because that's his mom's middle not his..We are so confused . But it was stated on his BC...So now we have no idea what to do???

    So now...

    Are we gonna have a problem in the interview? Coz right now his passport doesn't stated anything except his first and last name.then they put - (dashes and leave it black so it's visible. We never thought this is gonna be a big deal but i guess it is...

    If even read: if you have a ring receipt too bring it with you for proof of engagement. True or untrue!

    If the ring doesn't look like a "normal" engagement ring, I suggest don't wear it since we know that this has caused someone grief during medical at St. Lukes. I definitely will not take a risk. An engagement ring usually has a diamond mounted on the center.

    If during interview they ask if you have an engagement ring, then say “yes, it’s right here inside my bag but it looks like a wedding band so I did not wear it today so you won’t suspect that I am married.” I’m sure that will make the consul smile. Just be honest and everything will be ok.

    Hello everyone, I am here with question again. I tracked our visa status at delbros.com and I feel a little nervous because my sons visa is for delivery tomorrow and mine still says that SHIPMENT PROCESS IN THE EMBASSY. My confusion is that if they grant my son a visa,how come mine isn't out yet when in fact my son is depending on mine. What should I need to expect? I am so worried.

    Don't worry, I'm sure your visa will be delivered together. I'm guessing that Delbros just failed to update your record in their database.

    just wondering, is ST Lukes doing some prescreening? would think there area would medical. now they can request new Cenomar? wondering if something they do on their own or ask to do by Embassy.

    I’m wondering that too. If they are authorized to pre-screen, however, they should only be allowed to suggest to get a Cenomar if they suspect someone of being married and not delay the medical. Questions about eligilibility should not stop them from conducting the medical. They are the hospital, not the US Embassy for heaven’s sake! St. Lukes is over-stepping their bounds.

    Still nothing, sigh...........

    hi too all,

    Yeah i just spoke to my fiancee in the philippines and he stated that he received a letter from manila embassy stated that the packet cannot be send to him due to the high volume of application of K1 visa... So he has to wait of maximum of 350 days... and so on ans so on...

    but i can see that the last interview date to some people here was on feb 22, 2006.

    our approval letter stated that the visa is only allowed till feb?? so is this ok because if we received it an interview date on march then the approval is already over due is this gonna be a problem???

    well i need some input on how to get that packets without waiting for it to arrived in my fiancee house add.., regarding the interview date im just gonna wait till march im ok with that... hehehe

    or even april no rush here especially with all the people applying for the visa...

    Thanks for the advices... i only put the initially on his application for K1.. Coz that's what it states on his BC.

    We seek for advice to my fiancee's uncle actually his a lawyer in the philippines. He stated to us to go to NSO to make a correction and bring his mom's BC to justify the mistake i think they said we can actually make the correction and put the middle name on the BC but my problem now is that, when we applied for K1 we included a copy of BC from NSO in the application(USCIS), Now on his interview they might see the changes and put him on AR right away and bit worried... So what now really confused ...

    Ok i have a few question i actually filed for my K1 and this is the problem my fiancee' last name is from his mom cause the was never married his biological dad. so his using his mom's last name and the middle name on his BC states only initial (one letter, no description) Example: Name:Jose Middle Name: D. Last Name: Medina . So when i applied for K1 i included his middle name cause it's states on his BC. Now, when he went and get his passport, the lady that works at the passport place stated to him that they cannot include the middle name because that's his mom's middle not his..We are so confused . But it was stated on his BC...So now we have no idea what to do???

    So now...

    Are we gonna have a problem in the interview? Coz right now his passport doesn't stated anything except his first and last name.then they put - (dashes and leave it black so it's visible. We never thought this is gonna be a big deal but i guess it is...

    My fiancee' did spoke to the people in City Hall & NSO but they said it's gonna take at 6 months to correct it and we have to pay 1000 ($20) pesos each letter. this is ridiculous i mean, what else can i do? need help here?...

    1. How would my fiancee know that the package is ready to be pick up or are they gonna send it to him?

    2. Does anyone here know what number can i contact if the package is ready to be pick up?

    3. Am i going to received a letter from manila embassy?

    I called NVC 11/9... and i spoke to a nice lady , but they said they havent received our case from CSC and it was approved 10/27/2006... i swear i dunno what the heck is CSC doing why can they just send the case to NVC???...im getting tired of CSC... NVC said i have to wait for 90 days more waiting...

    Well i guess i just need to wait.....
