My husband has his interview next month and will get a tuberculosis test like everyone else at the medical exam. He is HIV positive so I already
know that he will have to get further tests and if tuberculosis is found he would need to get treatment for approximately nine months. By the time it takes to get the test results (which takes approximately 8 weeks) and the course of treatment (if needed) that is up to nine months it could take about a year. Would they hold his place in line since he would be under going medical treatment or if one year passes would I need to start the entire petition process again? Thanks for all your help!

Why are you doing a waiver? HIV is not a reason for denial anymore
We had to do the 601-A waiver because he entered the country illegally.

I am a US citizen and sponsoring my husband to become a U.S. permanent residence. My husband is HIV positive and that was disclosed in all the paperwork
submitted by my lawyer and also in the 601-A hardship letter. We knew that part of the medical exam would include a test for tuberculosis. He has been
tested in the past for tuberculosis and his results always came back negative. We were confident that the tuberculosis test in the medical exam would
also be negative. I just read recently (last night!) that all HIV positive immigrants applying for a visa must undergo further testing for tuberculosis. The results
of the "further testing" would take up to 3-6 months to get. I assumed that if the x-ray at the interview came back negative for tuberculosis than everything would be
fine. His interview is in two months and I do not know what to do. Has anyone else experienced this or have any knowledge of this situation? Thank you!

My husband may need to stay in Mexico after his medical exam for treatment before he is cleared to come to the U.S. My question is that his treatment (may take up to 9 months) and the time for him to wait to get his new interview scheduled is more than one year would I need to start the petition process all over again or would he be able to just get back in line for the interview even though a year had passed? Thank you!
