  1. I keep busy but yes, I feel like my life is kind of on hold. On the cusp of big change. And the closer it gets, the less I feel like doing stuff here. I just want to get over there and start living life together already.

(but it still scares me a little. ;) )

i agree...i.feel the same.......its almost as if i,m just going through the motions of living my life here........and gezzzzzzzzzzz..i got alonggg longg road ahead!!....lol but hey goodd things come to those who wait....i go to bed earlier knowing that the sooner i wake up the sooner another day starts, and ends and the sooner i,m closer to starting the begining of the rest of my life with my soulmate....x.but boy! the rollercoaster ride of emotions is hellish!..lol

  2. meauxna,

Not necessarily, not any more, solving the formerly difficult problem of explaining why relatives living in the same household had to be counted even though there was no financial interdependence. With the final ruling, relatives living in the same household only have to be counted as household members if there is financial interdependence (as demonstrated by tax return) or if they are going to contribute support to the sponsored alien (by entering into an I-864A with the sponsor).

    ....

At I-864 time, if still living at home, he will have to include his parents on the affidavit, making his current wage insufficient.

Thanks, Y. Darn those new forms anyway. :) I will review that section more carefully now.

OP: Not everyone is aware that fiances may not be work authorized for their first 4-6 months in the US.

we wont actually be fiances..we will be husband and wife
  3. hestouchedmysoul,

The information that you've discovered is the announcement of the (then) new K3 and K4 visas.

    Yodrak

so i sussed the k-3 spousal route was the one for me..then discovered this nformaton..which seems to imply yet another method for me to go through..and does state not having to wait or get k-3 k-4..does this apply to me any help appreciated? WASHINGTON -- To reduce the separations immediate family members of U.S. citizens may experience while waiting abroad for an immigrant visa, the Immigration and Naturalization Service (INS) is implementing a new K nonimmigrant visa provision, which was published as an interim rule in today's Federal Register.

The rule expands the K visa status, currently available to fiancé(e)s of U.S. citizens, to include the spouse of a U.S. citizen, who is waiting abroad for an immigrant visa, and the spouse's children. This will allow them to enter the United States as nonimmigrants, re-unite with their family here, and then apply for immigrant status while in the country. It is one of several immigration benefit provisions created by the Legal Immigration Family Equity Act (LIFE Act) enacted last December.

Under this new nonimmigrant visa classification, spouses of U.S. citizens may be granted K-3 nonimmigrant status, and the spouse's unmarried children (under 21 years of age) may be granted K-4 nonimmigrant status. Obtaining a K-3/4 visa is not required, however. Spouses of U.S. citizens and their children may skip applying for a K visa and directly obtain their immigrant visa abroad from the Department of State.

thanks yodrak.i did wonder that when i read it but what confuses me is when it states"obtaining a k-3/k-4 visa is not required" and that even that process can be skipped and can directly obtain the immigrant visa from abroad??.i,m lost!...am i of the understanding.........i can go to usa marry my fiance then if wanted go for an aos? or go to usa marry return home to England..file for cr1, k-3.......?? am i able to then move to usa while these are still pending to wait the outcome?..hm..all very confusing, thanks for yr help

  5. i,m maybe alittle confused on this..but so it would be london dealing with my afidavid?..even though i,m moving to the usa ..sorry its all new to me..i just thought as i was moving there and my fiance is american it would be the american dollar guide i would need to follow??.thanks for your help much appreciated

It's "Affidavit", it's not "yours", but your USC's, the amount IS in US dollars per year (poverty guideline) and "London" = US Consulate in London England.

Oh, 'his own business' is not obviously an asset. It could've been something, or nothing. Well, now it's nothing. Dang, how will 3 of you live on that wage?

At I-864 time, if still living at home, he will have to include his parents on the affidavit, making his current wage insufficient.

no he won,t still be living at home at that time.. i will also be recieving $1000 amonth towards the care of my daughter which will also be added to the pot......and i myself have substancial savings from selling my property here in the uk..and then obviously when able to work..i,m qualified in interior design..i shalll go back to work and do so........so to be honest, i,m thinking we will manage fine..........thanks for your input

  6. OP: Are you sure London asks for 125%? I-134 asks for 100% above the poverty guidelines and only some consulates/embassies ask for 125%.

I'm still not sure if this is after or before tax, but it's the minimum required, which supposedly means that if you're above, you're, no matter how much or little above you are.

In my case we too are barely above and I am counting on them taking in consideration that we meet the requirements even if barely.

awwwwwwww..thanks for your repley ..and goodluck too you..both....do you or he have any assets as i have read this can help...i also may look into self sponsor ..as i,m sure iread you could do this somehwhere if you..had acertain amount of savings!!?...lol..which i havnt !.but given the time it takes to go through the process..i can maybe save enough!!.....anyway heres hoping we both get by on what we have!.thanks aga :D in.x

It's 125% before taxes. This should give you some leadway.

    Thanks,

thanks very much....thats great..lol.i can relax slightly now! lol.......

  7. whilst reading as much as info on the affivdavid of support..there are still afew questions i seek...i will explain alittle...............my fiance 18mths ago had his own bussiness..obviously this would be classed as an asset his own home etc etc....his company got sued....leaving him having to sell his home and his ample wage now dropping to $21,000...now he currently doesnt own his own home and is back living with his parents so that he can save once again..so when i move over we can go and buy a house together. Now what i was wondering, after looking at the poverty guidelines for 3 people myself ,my daughter and my fiance in the household...following the guidline which states for 3 people is $20,750.........so we just scrape through?? or is the guide the absolute minium you can earn?..or do they actually like you to earn above this...and is this before or after tax?...also the only asset i guess he has would be his car until we move in together..is this going to be aproblem?.....i,m also guessing the answer would be no....but would they not take into account any savings i have myself..or any income i would immediatley be bringing in myself once over there? :D i really cant seem too find much on this, any help appreciated thankyou

  8. ..i cant actually seem to get a clear answer.

Might I suggest that that is due to your method of asking?

PS: I'm one of the been-there-done-that and I did give my opinion, so maybe you did get what you wanted afterall.

no i dont really agree its my method of asking......whichever way i,ve asked..shouldnt make agreat deal of difference to the questions....but obviously after reading many more...some peoples experiences are very different to others.and some folks journeys have been quicker than others so...in hindsight..i,m guessing i,m going to get the general jist ..but..but each case is different..and am going to have to move forward..but at least i have an idea..of whats ahead in the long journey to follow...thanks for your help...

  9. hestouchedmysoul,

Just to be sure that all the loose ends are tied up - the I-130 is a prerequisite for a family-based immigrant visa, in your case it will probably (hopefully) be a CR-1. Whether the I-130 is filed in the USA at a USCIS Service Center or overseas by DCF, the visa is the same - the only difference is how long it takes to get the visa starting from the time the petition is submitted.

    Yodrak

    hestouchedmysoul,

I think you misunderstand something. DCF refers to a US citizen Filing an I-130 petition Directly with a US Consulate (or USCIS field office) abroad rather than with a USCIS Service Center in the USA. Since you reside in the UK, that would mean after marriage your husband would want to file his petition with the USCIS office in London. However, USCIS-London will not accept petitions for processing unless the petitioner is resident in the UK (I forget the proper term for the status).

Your fiance does not have the requisite status in the UK, and so cannot have his petition processed by DCF following your marriage.

    Yodrak

I completely understand now........shame but hey worth a try i guess!.....so i,m thinking best to apply for the k-3 and the cr-1...and then see which ever progresses the quickest?.thankyou very much

hi yodrak.you,ve been really helpful thankyou.....would i not need the family based one though due to me having adaughter whom i obviously would want to bring across with me?and i have read amongst here that you can apply for the cr-1 and the k3..and then..continue with whichever is the quickest abandoning the other?? thanks again....

  10. hi..i,m marrying in november in New Jersey......then was intending to go the k-3 cr-1 route..but have now discovered consular filling.my question is.......what criteria do you have to have to be eligable?.....and how do i find out about which offices would allow this..and do you have to reside in that area??.many thanks

I know this reply will sound harsh--take it as you will. I have a feeling that you won't be back to this thread because you cross posted your question across the board and already got your answer.

There is a ton of information on this website, but you have to do some looking. Some, as in, loook for an FAQ. Look at things called Guides. Read the first page of posts in a forum to see if your topic is addressed.

This is not an immigration consultation office. It's a collection of resourses for people who want to file their own cases for immigration benefits, or to learn the process so they can manage their hired help (attorneys) properly.

You had questions--they burst from your brain/fingers straight to the page. Your questions have all been answered a thousand or more times. It's true: if you can't be bothered to look at the gifts of information already in front of you, why should anyone else be troubled to wrap them with shiny bows and deliver them to your door?

This isn't just directed at you, dear OP. Obviously your offense was not so great to touch off this response. And since it's buried in this tiny dark corner of VJ, probably very few will read it anyway. But maybe, just maybe, one or two people will see it and will consider what it means to Do It Yourself.

each to their own.............im new here only found site and joined yesterday.sorry for making afew mistakes..but hey nobodys perfect!!!.and its not that i cant be botherered in the least!...i,m at the start of my journey....so am very unfamiliar with what is what.and yes i have read up info at all sorts of ports and sites...some which actually conflict the other.and many atime..i cant actually seem to get a clear answer.hence might i add asking on here folks who have already been their done that...........for their opinions.....and..i,m sorry if i have annoyed you so much....but it really was your choice to leave areply when you really didnt have to...thanks anyway.....

I'm assuming your current plan is to marry in NJ, then return to England to wait for the CR1 and K-3?

You won't be able to DCF.

yes thats correct, thats the plan....what would the reason be for not being able to do dcf...??? many thanks..x

For DCF in the UK, he would have to have legal residence there.

ah..isee thankyou very much....without sounding daft...it would be me moving over to the us to be with him..the same still applies??thanks
