  1. Hello,

    I have paid my fee and will need to submit online the i864a soon. I'm having a little trouble with 2 things.

    Part 4 it says to include 3 years of income and I've done this. in the instructions it says this - NOTE: you MUST attach a photocopy or transcript of your federal income tax return for only the most recent year.   Have any of you had success with this? or did you need 3 years?

    Also, I file the 2555, Foreign Earned Income Exclusion, which makes my income 0 for the USA but my income is well over $60,000 a year.  I am allowed to do this, so I don't have to pay taxes in 2 countries.  It says in the instructions: If you were not required to file a Federal income tax return under U.S. tax law for any other reason, attach a typed or
    printed explanation including evidence of the exemption and how you qualified for it.  I did file but I had the 2555 showing my foreign income and then subtracting it from my earned income so I don't pay taxes.  Do any of you do this?  Will I be ok?

    Part 5 where it says I,  The sponsor - Name.. then it has a box with (Indicate number) I'm attaching a photo.  What is this?  it's not even explained in the help document. 

     

    Also, on the form it says in part 6 to indicate this number. I have no other people or no household members, so I can leave this blank?

     

    Any advice or help would be appreciated. Thank you.

    Pivot cases are approved in 1 to 2 weeks after paying fees and  submission of documents.

    Non-pivot cases are approved in 60 days after paying fees and submission of documents.

    Secondly interview depends on beneficiary consulate.

    Some consulates are busy so interview is sceduled in 2 3 months,in some consulates interview date is given after 1 month.

    I certainly hope it's not ~10 months. I survived Hellbraska (Nebraska). I'm hoping 5 months is more accurate. So far, been at NVC for 5 weeks waiting on a case number. All the required documentation has been sent to my lawyer, so hopefully once we get a case number the process will go quite fast. My husband's job contract is up at the end of June. Thankfully he already has a tourist VISA and could potentially wait out the time from the end of his job contract to the interview here.

    We are at 11 weeks waiting on a case number. Yesterday I called again and she said they finally see us in the system and was even able to see our case file. She said it's only 1-2 weeks from a case number.  The lady we talked to yesterday we very nice and informative.    We filed May 1, 2017 (really april, but this is what they said)  We honestly have been waiting for this whole ordeal almost 365 days.   My job ends Jun 15th and we have no more apartment and 1 have the leave the apartment by June 30th.  My husband does NOT have a tourist visa and cannot enter the USA, even if he did, we'd have to come back to Brazil to the interview.  I just cannot believe it's taking this long.. unbelievable!

    I think you may run into problems given that u will be in China. It will depend on your consular officer interviewing ur husband.  Since it is a family reunion visa, hard to explain if the person who he is to be with is not there.  Owning a home doesn’t prove your domicile.

    if you are applying spousal visa, u r applying for a green card. I think you should have just applied for a travel visa, which is normally granted for 10 years and you can stay up to 6 months...but a bit late for that...

    When I call they say that we are not in the system yet. They say that they have our file and they have a new system and are putting everyone in the system a new way. They apologize for the wait but that's all they will tell us.  I didn't apply for the tourist visa because 1 year ago we were only married 5 months and he didn't have a job. With Latin america they are very strict on who can get a travel visa.  If it is anyone that they think will be a problem and be an illegal immigrant they will not approve.  He didn't have a job at the time and no money, so they would not approve it.  I do believe we can maintain his green card even if I have to travel to china and work while he stays with my Sister and brother in law, until his English is better.  We own a home there, so I don't think it will be a problem.  What do you think?

    anyway, have u started to get all your documents ready and scanned in?  That’s what you can do while you are waiting.  Since u will be going off to China, do you have a good intent to re-establish domicile in the US?  I think you need to proof that.  Also, if your husband will go with you to China, you may have trouble with the green card...as you are supposed to stay in the US with the green card...

    All of the documents are ready we just are waiting for the appointment now. I own a home in the USA and I travel and live abroad for 2-3 months at a time and return to the usa for 2-3 weeks, he will be going with me while I work. We plan to live in the USA but not for 2 more years. I plan to seek work in the USA then.  He doesn't necessarily need a green card to work until then as long as he keeps his visa to travel with me or do you suggest that we apply for the green card since I own a home there?  I know I don't understand how everything works yet, so I am very grateful for any help or suggestions.

  7. aywang, I see it's difficult for you as well.  I hope it works out quickly for your and your family.  Unfortunately I can't and won't leave my husband, so we will wait here until it's ready. I hope within the 5 month range which will be late July.  We have to go to the USA, then I have to go to my next job which is in China.  We need to get his USA visa finished before we leave for work in China.  It's all very stressful. 

  8. Our file was sent to NVC on January 29th. When we call it says, February 7th and they still say, "we apologize for any inconvenience but your file is still being entered in the system and has gone over the time, we hope to be able to help you soon.  We filed the i130 over 1 year ago and still don't have a visa.  My job here in Brazil is over June 15th and we will be homeless after the 30th of June.  I have asked for it to be expedited and they denied it.   No matter what, they will not help.   We don't even have a interview time or fee payment yet.  I suppose we will just live in a favela after June 30th because I'm not leaving the country without him.   I just don't understand why if I'm an american it takes over a year and a half to get a visa for my husband.   I even submitted a i129 to ask to just enter the country until it's finished and it was denied too.  I just don't know what to say.  If you do things the right way, you are just treated so badly.
