  1. Oops, sorry I said I-894,  I meant I-864

Someone included this information in their reply

" If the US citizen and K1 marry after the child turns 18 then the K1 can petition for the child after the K1 gets their green card, as long as the child is not married. If the child is under 21 then the K1/LPR can petition for an FB2A visa.."

I'm confused about this- Does this mean I have to wait until my spouse gets her green card before my 19 year old can  apply for AOS?  We were married after he turned 18 and he came four months after we married, so i thought  I just needed to file a I-864 for him,  but as i mentioned in my original question I don't understand why we haven't heard anything on his status for  a month.

  2. I am filing an AOS for my stepson who arrived after I filed the AOS for his mother and sister. I'm confused as to what information to include on the I864 for him. Do I fill out the affidavit as if he is the only one I'm sponsoring now or do I need to include information about his mom and sister again. (I filed an AOS for them 3 months ago)

    • For example in Part 2 do i list him as the principal immigrant?
    • Part 3 - Which box do I check 1,2,or 3?
    • Part 3-  What should I put for the total number of immigrants sponsoring? will it be 1 (him only) or three (mom and sister also)
    • Part 5-  Same as part 3 I don't know who to count

An entire forum dedicated to adjustment of status.   Probably a much better place to ask these questions

ok thanks. Here's another one for the "forum."  I'm skittish about what to send in reply for the USCIS's request for more documentation.  As I figure it, my income alone should be sufficient to meet the 125% poverty guidelines standard.  Household of four - $59,200 gross $44,100 adjusted) The 2019 125% HHSPoverty Guidelines say family of 4 =$32,187.  Should I send asset information just to be on the safe side?  The Part 7 instructions say it's not necessary but should I send it anyways?

  4. I recently sent in my Adjustment of Status (I-485) form and received back a "Request for Initial Evidence" saying that my documents in the I-864(Affidavit of Support)did not meet the 125% federal poverty guidelines.  I know that I meet the guidelines so I scoured my application and discovered that in part 5 I had listed my household size incorrectly.  How do I correct information on the application?  Do I need to send in another corrected application?    Also, Part 3(Form I-864) number 1, 2 , and 3 is a bit confusing to me. I am sponsoring my K1 Visa spouse and two children(one here, one to come in less than 6 months).  Do I need to check just one box or two?  I answered yes on 1 and 2

  5. My case has been reportedly sent out of the NVC(Nat. Visa Ctr.) to the embassy in Jakarta. My K1 fiance has had her medical and submitted the DS160 today.  (She also has my I-134 information.)  Would it be advisable to contact the U.S embassy by phone as a follow up requesting an appointment, or should we just wait until we here from them?  Also, does the NVC have anything to do now with the appointment in Jakarta, other than just sending them information?

  6. I just heard from the Nat. Visa  Center that they are sending my K1 application to the U.S Embassy in Jakarta.  Where do I send the I-134 affidavit of support to?  My fiancee?  The embassy?  Also, do I have to send 3 separate affidavits  for my fiancee and dependent children, or is one sufficient?  One last question I started the I-134 application a while back, but the current version expires 11/30/18.  Will I need to start a new one or will the one I have already started be grandfathered in?

  7. My application is now at the National Visa Center awaiting to be sent to the US Embassy in Jakarta.  It has a case # and an invoice #,  but to my horror, I  discovered that there is a wrong birth date for my fiancee on the form.  What should I do? Wait until it's sent to Jakarta and have her correct it there,  or make changes before it is sent.  If I need to make changes here, how do I do that?
