  1. Hi.... and thank u in advance for responses

    My mother in all entered the US in Sept 1998 illegally, during this time she had a child, paid taxes and lives in govt housing. I don't really understand how myself, the problems begin now with the recently approved I-130

    filled by her brother in 2003, this is now in the NVC awaiting a Visa availability which I'm estimating will take her into Feb or Mar '11. The question I have is will she qualify for the LIFE act being that she filed a petition in Aug '03? and can prove her stay in the US since '98? or does she have to return and get interviewed in her native country risking being banned for 3 to 10 years??

    That would be a cart where the horse's ### is well behind you rather than in your face.

    (And the (a)(9) EAD, like the (a)(6) EAD, is good for the duration of the initial I-94. At least my wife's was.)

    You are right....I can file for EAD before AOS...My husband I-94 is good for 2 years......Thanx Yadrak and all I will think over our options and try to file as soon as possible.......

  3. It seems like its cheaper to file here after your spouse come in the states. Its only $395 I thought it was more!! wowow Its $380 plus $70 to do it in DR!!

    I contacted a lawyer just to ask prices and told me that it was $765.....and that I had to apply for EAD, I didn;t have a choice. You guys are great!! I appreciate all the info I get here.

  4. I haven't started the AOS process as of yet......My husband is going from a K3 to the AOS........His medical was Oct '06 and his fingerprints Nov '06 can he use them here in the states?? We have decided not to apply for EAD are the fees for I-485 $395?? Is the processing time 6 months?? Just wondering which way would be better........E-Filling or in Person???

    There are sooo many options!! Thanx in advance

  5. Thanx Tracy you are a life saver!! In DR they don't send the passport DHL.......We pick them up at the embassy......So hopefully the visa will be issued the same day.

    Here is my update.......Today I need all your prayers!! :help:

    My husband was called by the embassy they said his prints are back!! :dance::dance: but I am still scared there might be something more!! He is to arrive at 7:30 AM ...Tracy or anyone else who has gone through this PLEASE help me, they didn't even tell him to bring his passport!!

    He is bringing the passport

    The green letter

    The $85 fingerprint fee

    and his federal ID

    Does anyone know if they will give him the visa the same day?? All that was said was Nov 7th 7am.....Go to window 26 and follow their instructions.....

Ally you know that the sponsor and co-sponsor must both count all their dependents......So if they filled with 3 dependents...They have to provide income for themselves+ 3 dependents+ you + 2children+ your husband= Total 8 people.......So double check or give us the numbers and we can tell you what the income should have been.......USCIS usually won't mess things like that up!!

  8. I know that is whats eating at me!! They even called my hubby at home and told him the visa was ready on the 30th and when I called the Visa Specialist said it had been issued!!

    There is somethig that is not right......His name check was over seen by USCIS NVC and the Embassy....how sad :crying::crying:

  9. I have never heard of AR done here.....It usually happens at the embassy.....They take fingerprints and then clear the person for Visa issuance

    They can do AR at any time you are in the processing. If they have pulled their case now it may be in detailed AR and a handful of cases are pulled at this level and reviewed. Name checks are done at all stages and in the final stages at the embassy level are the fingerprints and full set if you have had a name hit in any of the many data bases.

    Sorry to hear that you are in AR and hope that is goes fastly for you.

    Thanks for the info...Dipstick maybe is better at this point........Mines happened right before my hubby was to arrive that really hurt!! I'm loosing it and the process just keeps changing.....Only God knows girl and I hope having this resolved at this stage will speed things up in the future!!

    Does anyone know how long it take for the 10 finger prints to come back when taken at the embassy??

  10. That is what truly upset me......I called the Visa Specialist in DC and was told the visa was issued on the 30th of Oct and something came up with mu husbands name, prints were requested on the 31st.........This seems sooo unfair!! :crying::crying:

    This morning while speaking to Dept of State they told me it takes about 2 weeks........So I'm hoping it will be that long and not 2 months, maybe she made a mistake. The really ironic thing is the Interviewer actually told my husband she was sorry this was the first time she has done a K3 and she was unfamiliar with the processes.....

    God willing this will all work out, I was told this is called a security check. Its like an Admin review, but nothing further is needed.....

    Thank you to all , your kind words bring me confort......The babies and me just need my husband here!!

  11. Well everyone here is my heart felt pain!! I found out today just hours before my husband arrived........At around 4pm that there would be an admin review on his case. They took his fingerprints electronically and told him he would have to wait 2 months!! Why how.......I can't understand!! Why?? The consule stated she made a mistake, apologized and assured him, he would be with me by the time the baby came!!! That is sooo unexceptable!! Why had lamaze classes on monday.......I'm soooo destroyed!! Can anyone tell me a lil about admin reviews.......????
