  1. that's wonderful! I am glad and happy for you.  As a person going through this and have been successful, can you suggest what else documentation we need to prove that our marriage is bona fide?  We only got joint bank account, lease and rental agreement, gym membership, electricity bills, internet bills, healthcare directive, photos of the weeding, affidavit sworn by third party (just 2), printed messages, and plane tickets.  Anything I can add to this?  Thanks much!

  2. we met a month after I got here in the US (November) and have known him since then.  He/we did not expect that having a tax transcript this late is it required that's why he never bother to get this done soon especially he did not expect to met and marry someone this soon either.  He is filing his taxes now but it will be too late to send the forms by the time we received the the tax transcript we are waiting.  I am not sure sure if I should send out all for documents now or wait out until I get the transcript, or go home and do a CR visa (which would mean I have to start all over again) gathering all the required documents we have.

  3. this is what is stated in the specific instruction under "I-864 Specific Instruction".  It also stated in the application form. under number 18.a.  There is a note under stating "You MUST attacha  photocopy or transcript of your federal income tax return for only the most recent tax year.

     

    Item Numbers 18.a. - 20. Federal Income Tax Return Information You must provide either an Internal Revenue Service (IRS) transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years. Form I-864 Instructions 07/02/15 N Page 8 of 16 You are not required to have the IRS certify the transcript or photocopy unless specifically instructed to do so by a Government official; a plain transcript or photocopy is acceptable. Telefile tax records are not acceptable proof of filing. Do not submit copies of your state income tax returns. Do not submit any tax returns that you filed with any foreign government unless you claim that you were not required to file a Federal individual income tax return with the United States Government and you wish to rely on the foreign return solely to establish the amount of your income that is not subject to tax in the United States. If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return with your spouse and are qualifying using only your income.

     

     

  4. Thank you for your response. I have the 2014 to 2016 W2's and 6 pay stubs in total.  I will give it a try and send the application along with the of the forms.  I am assuming that I will receive and RFE if I don't file it correctly but at this point I don't really want to be out of visa and living here unlawfully.  I would prefer to go home and all but we came all this way only for me to go home.  And we have all the forms except for this one.

Hello All, I am a B2 visa holder married a US citizen but visa will be expiring soon.  Can I stay in the country while I am in the process of gathering all the requirements even my visa expires?  Would that affect my application in the future?  We are only missing I-864 right now, and my spouse did not file his taxes for the last two years. Based on my research it will take two to three weeks before you can get your tax transcript. What is the best possible way we could do this?

Hi am trying to submit I-130 concurrently along with I-485.  My question is, can you file I-864 (affidavit of support later on).  I married a US citizen and my B1/B2 expires on the 18th of April. We would like to send our application before then but my spouse does not have a tax transcript. If we request one now it will be too late to send the application.  Please help!!!!
