  1. I had the same situation. I called after 25 days and was told the same as you, had to wait 30 days.

    on the 29 day I received my app back rejecting the app due to that my stepdaughter could not be included on the I-751. This has since been resolved only after contacting my Senators office. I hope you dont get yours sent back..but be prepared.

  2. Update today.

    I had the KY Senators office get involved. They spoke with the VSC 5 times before the problem was fixed. Seems that in the computer system it showed my stepdaughters card being issued 5 days before my wifes. They said that since it was issued not on the same day or within 90 days after my wifes card that she could not be included on the I-751. I had to send copies of I-94 cards and K-1,K-2 visas with entry stamps and copies of all appointments showing they both arrived in the US together to the senators office and they faxed all to the VSC. The officer at the VSC finally figured out it was a typo on the stepdaughters card. The VSC said to send back the original I-751 to the attention of a special officer and the app will be processed asap. They also said that it didnt matter that she is 21 yrs old now as long as she entered the US with my wife and was under 21 at that time and that she can be included with my wifes I-751.

  3. Is a conditional green card still valid if the holder was outside the US for more than 1 year but didnt obtain a re-entry visa but is in the process of obtaining a returning resident SB-1 visa? If the SB-1 is granted do we have to do AOS all over again? Will it effect a pending I-751, or if the I-751 is approved and we have received the NOA letter extending the conditional card for 1 year? I can give more details if needed.

    I wasnt sure where to post this, so if it needs to be moved please do so.

  4. I called the customer service center today. They said that there should not be any problems if my stepdaughter arrived at the same time, she was not sure why they sent the application back. She told me to resend the same application, not a new one, with the same check, and to make copies of the I-94 when they first arrived in the US and also copies of all the approval notices we have during the process, I-485, I-765 and the letters received when we went to the interview for the conditional green cards stating that both were now LPR as of 12/26/2006. She said the typo for the issues date on my stepdaughters card of issue date 12/20/2006 should not have caused any problem. Also called the Kentucky Senators office in Louisville. They were very helpful. I faxed copies of the application and copies of green cards to them today. The case worker said she would call me back today and let me know if there was any other problem and told me not to worry, that all seemed in order and that the VSC made a mistake. If the Senator needed to get involved, he would do so immediately.

    I'll let everyone know what happens. I am resending the application today overnight mail.

  5. Be sure to let us know how that phone call goes for you. I tried that and was told that under no conditions could 2 people get 2 green cards on one I751 with 1 fee. They don't care what the CFR says. They don't care what the instructions say. It aint gonna happen.

    You have to pay an additional $80 biometric fee for the child.

    I submitted a check for $625.00..included bio fee for both people. Just as it says to do on the I-751 instructions page.

  6. For my step-daughters card..it is obvious a typo was made on the issue date. I looked through my files and found the original letter given to both my wife and step-daughter on the day we went to Louisville for the interview to obtain the conditional cards. Both letters state that on this day 26th December 2006 you are now LPR in the US. Both cards arrived in the mail on the same day. They are consecutive numbers but the issue date on our my step-daughters card is 12/20/06 not the same as my wife 12/26/06. Obvious typo since the letters clearly state as of 12/26/06. I will call USCIS on monday and hopefully get this taken care of. There should be no reason to get a senator involved or go for infopass. I hope that I can resubmitt the same package along with copies of the letter issued on 12/26/06.

    Do you have copies of the original letter issued when you went for the interview?

  7. New update. I received a NOA today from the VSC. It says nothing about the daughter being 21 now and connot be included. It states they she cannot be included because according to section 216.4 of CFR8 she cannot be included because she didnt receive her conditional green card on the same date or within 90 days of her mother. Both went to the interview for the conditional card at the same time.

    The daughters card was issued 12/20/06 and mothers card 12/26/06, are they telling me that because the daughters card was issued before my wifes that this is why she canot be included?

    Her card was issued first and not on the same day or within 90 days of her mothers?

    What should I do now?

  8. My fiancee arrived in the US Sept 2006 we got married 3 weeks later. When we went to the SS office to apply for a SS two days later they said that there was a new rule in place and that applicants that arrived with a K-1 visa could not rec a SS number until they had the green card. I called the SS office and they confirmed this. I even went to the SS office with printed documents from the USCIS site that said she was able to get the SS number. They said that the information wasnt up to date and still denied her the SS number. We had to wait until December when we got her 2 yr card to apply for the SS number.

  9. I filed I-865 when we moved and did the AR-11 online. I printed the confirmation for the AR-11 and sent that along with a copy of the confirmation of the I-865 when we filed the I-751. I sent the I-751 on 11/05 rec at the VSC 11/07 but the check hasnt been cashed and nothing from the VSC. Does anyone think it might be a problem with the address? We sent the address changes 10 months before sending the I-751.

    Forgot to add that I didnt get confirmation in the mail for the AR-11

My husband and I have been through much of the immigration process successfully and we are now in the final round - we just applied to remove conditions from his green card and received our Notice of Action pretty soon after (yes!!!). We recently moved and we just did my husband's change of address online, including the AR-11. However, my question is - do I, as his spouse and being the US citizen need to do anything? Do I need to fill out any forms? And if so, which ones? Any help would be sooooooooooo appreciated! Thanks!!! :help:
