    Which date to consider for I 485 - Receipt Date or Notice Date ?

    Hello Everyone,

    My employer has filed H1b Amendment + Extention in July 2018 and I have received RFE for the same .My current I-94 expired on Feb 28,2019 and I am on 240 day rule .I filed family based I - 485 on Feb 16,2019 and USCIS has send the receipt with receipt date as Feb 19,2019 and notice date as March 05 ,2019.

    Here is the summary :
    I-485 Filing Date - Feb 16,2019
    I-485 Received by USCIS - Feb 19,2019
    I-485 Notice Date - Mar 05,2019 
    I- 94 Expiration Date - Feb 28,2019

    Which date is considered for I 485 receipt date or notece date ?
    If my H1b will get denied then will the period Feb 28 - March 05 will be considered as illegal stay ?

    Hello ,
     
    I am currently on H1B Visa and it's valid till Feb 28 2019 . My I 94 and Petition is showing end date of 28th Feb 2019 . I have applied for an amendment and extension through my Employer and i can wait 240 days in US waiting for H1b Extension decision.My Wife is currently on H4 Visa with same expiry date 28 Feb 2019.
     
    My Sister in law has filed I 130 for my Wife on 03 Jan 2005 (F4 India Category) and current Visa Bulletin is showing Filing Date 1 Feb 2005.
     
    Can I file I 485 now ? If no then can i file i 485 after 28th Feb when my Visa will not be valid and I will be in 240 days rule?

    My Sister in law has filed I -130 for my wife in January,2005 and We came to US on H1 and H4 in Dec 2014 from India . Right now  "A. FINAL ACTION DATES FOR FAMILY-SPONSORED
         PREFERENCE CASES " is 15 Aug 20013 and "B . DATES FOR FILING FAMILY-SPONSORED  VISA APPLICATIONS" is 01 May 2004 . 

     

    When can we file I 485 (AOS) ? Should we file according to Dates for Filing Family-Sponsored Visa Application(B)  or Final Action Dates for Family -Sponsored (A) ?

     

    Any Help is appreciated .
